What can Private Landlords do about their Antisocial Tenants?

Antisocial Behaviour can make people’s lives a misery. If someone complains about your tenant or your tenant complains about the antisocial behaviour of others, you are required under the Antisocial Behaviour Act (Scotland) 2004 to take action.

As a landlord you can do several things to make it easier to deal with antisocial problems

  • At the start of a tenancy, stress the need to behave reasonably.
  • Think about including a section on antisocial behaviour in your tenancy agreement that explains what the consequences of antisocial behaviour are.
  • Make sure the neighbours of your property know who to contact if they have a problem with antisocial behaviour from your tenant. Consider getting a leaflet or card printed with your contact details on it.
  • Keep accurate and dated records of any action that you have had to take.

If you receive complaints about your tenant

  • Talk to your tenant – make them aware that their behaviour is causing problems
  • Talk to the neighbours – find out how bad the behaviour is and keep records. Keep them informed about action you take.
  • Give warnings: Verbal and written – keep records of when you issued these and why.
  • Give Notice: If behaviour is serious or frequent and you have given reasonable warnings, give Notice
  • Take Legal action: If the behaviour doesn’t improve, go to Court to have them evicted.

If your tenant is a victim

  • Meet with them and find out details of the problem.
  • Ask them to keep a diary of any incidents.
  • Advise of any action that can be taken.

Dundee City Council has a team dedicated to tackling antisocial behaviour. The team can be contacted at any time for support and advice.

We can offer a number of services to Private Landlords, such as:

  • Taking action to obtain an Antisocial Behaviour Order (ASBO) if the behaviour causes distress and alarm to the community.
  • Helping people affected by antisocial by referring them to our Victim Support Officer
  • Referring suitable cases to Dundee Community Mediation
  • Installing surveillance equipment to get evidence of antisocial behaviour
  • Providing Out of Hours help in certain cases
  • Providing legal advice.
  • Training on all aspects of antisocial behaviour – including legislation, interviewing, and evidence gathering.
