To provide, maintain and regulate disabled parking bays in accordance with the Disabled Persons' Parking Places (Scotland) Act 2009.

In addition, offer the enforcement of any disabled parking bays operated by private off-street organisations and businesses.

The Disabled Persons’ Parking Places (Scotland) Act 2009

On the 1st of October 2009, The Scottish Government introduced the Disabled Persons' Parking Places (Scotland) Act 2009. The Act now makes it a requirement that all current disabled parking bays become legally enforceable.

The aim of the Act is to provide improved access for disabled drivers and penalise inconsiderate drivers who abuse the current advisory system.

All Councils’ within Scotland have a duty to make all on-street disabled parking bays and all off-street disabled parking bays in Council operated car parks enforceable.

It has also been a requirement of the Act that Council’s contact all owners of private off-street car parks and ask if they would like their disabled parking bay provision enforced on their behalf.

Any disabled parking bays and corresponding signage which do not conform to Traffic Signs and General Directions 2002 will be altered so that they meet the criteria of the Act. This means that many spaces city-wide will require some form of alteration work. Any disabled parking bay which does not have the correct signage will also have a new sign and possibly a new post erected adjacent to the bay.

New applications will be batched together in additional TRO’s on a bi-annual basis.

The Legal process for creating a TRO can take on average of 9-12 months depending on whether any objections are received which would require additional time to resolve.

All current on-street and off-street disabled parking bays have been measured and the process for upgrading the bays is underway. Please note that the TRO for on-street bays has been made and all bays are now legally enforceable.

Due to the quantity of bays which require new signing/lining alterations (which do not meet current specifications), Transport Scotland granted Dundee City Council dispensation which allows the legal enforcement on all sub-standard disabled bays for as long as it takes to upgrade them to Traffic Signs and General Directions 2002 standards.

Any disabled parking bays which are not required, or have not been accounted for will be removed or reallocated to a potential outstanding applicant in the vicinity.

Council Operated Off-Street Disabled Parking

Dundee City Council has taken the introduction of this Act as an opportunity to increase the provision of disabled parking bays in our accessible car parks to approximately 6% of the total car park capacity.

There may be a short disruption to our car parks while the necessary work is carried out at each individual location.

Private Off-Street Disabled Parking

Dundee City Council has written to approximately 850 businesses city-wide to ascertain if they operate, or have use of an off-street parking facility and if they would like us to enforce these bays on their behalf. The disabled parking bays will also need to meet the criteria outlined in Traffic Signs and General Directions 2002 before the bays can be legally enforceable.

All Councils also have an obligation to contact any new developments within 3 months of the development being granted Planning Permission.

Applying for a Disabled Parking Bay

In order to apply for a disabled parking bay, you must comply with the following criteria:

  • The applicant must a Blue Badge holder
  • The applicant must not have access to private off-street parking facilities
  • The applicant’s vehicle must be registered at the same address at that of the Blue Badge holder
  • If the application is an organisation, the vehicle must be registered at the same address as the organisation and is to be used by, or on behalf of the organisation to carry disabled persons’.

Frequently Asked Questions.

If I apply for a disabled parking bay, how long will it take to be marked and enforceable?

From the time your application in received, there is an obligation to begin the statutory process within 6 months. The TRO takes approximately 9-12 months from the beginning of the statutory process.

Applications are dealt with on a first come, first serve basis. Our contractor is then sent the request for works bi-annually and the work will be carried out in due course. The disabled parking bay will remain unenforceable until the signing, lining and Traffic Regulation Order (TRO) is in place.

There is damage to sign/post/lining which will require maintenance work to be carried out (i.e. lines required to be refreshed). Who do I need to contact?

  • Identify all on-street and off-street disabled parking bays in its area
  • Make all identified disabled parking bays enforceable
  • Keep all disabled parking bays under review
  • Annually report to The Scottish Government with findings
  • Contact private car park owners every two years to request enforcement
  • Contact new developments to request enforcement

What are the duties of privately operated car parks?

  • Contact us to inform us if they wish The Council to enforce their disabled parking bays
  • To arrange signing and lining within their car parks to comply with Traffic Signs and General Directions 2002 specifications if enforcement is requested
  • To contact us when the additional signing and lining work is complete.
