Up and Running!
The date for the introduction of the main changes introduced by the new planning legislation (3rd August) has now passed and the Council is continuing to work to ensure that the implementation of the new changes takes place as smoothly as possible.
Here are some of the most significant changes.
Applying for Planning Permission
The most significant change is that new forms and guidance notes are now in use.

From now on the Council will undertake the notification of neighbours as soon as possible after the submitted application meets the statutory requirements, can be registered as valid and placed on the Planning Register.
A press advertisement may be needed. This takes place where an applicant is unable to serve notice on a site owner; where the Council cannot identify those with interests in neighbouring land; where a "bad neighbour" development is involved (e.g. licensed premises, restaurants or hot food shops); or where there is a departure from the development plan. The new legislation indicates that the cost of these advertisements must be recovered from the applicants concerned. The Council has decided that a charge of £100 will be imposed where such an advertisement is required.
Deciding Applications
The Council's Scheme of Delegation as approved by Scottish Ministers is now being applied as is its discretionary Scheme of delegation covering other aspects of its planning business. Decisions made under the statutory Scheme are the subject of potential review by the Council's new Local Review Body as opposed to an appeal being made to Scottish Ministers. From now on Decision Notices will be accompanied by additional or replacement information. For example
- reasons for all decisions will be given, not just reasons for refusal
- reference will be made to the plans which have been approved/refused
- information as to which method of appeal applies either to the Council's Local Review Body or to Scottish Ministers)
- Forms for return to the Council relating to when the development is started and completed
