Pre Application Consultation
The City Council is continuing its work to ensure that the implementation of the new planning legislation over the next nine months and beyond takes place smoothly.
In terms of actions being taken by the Scottish Government, a set of Regulations were laid before the Scottish Parliament in December 2008 and will come into force in April and August 2009. These Regulations give effect to various aspects of the new legislation.
The Planning etc. (Scotland) Act 2006 (Commencement No. 7) Order 2009 brings into force the new provisions on Pre-application Consultation with Communities (PACC) from 6 April (Section 11 of the 2006 Act introduces new sections 35A, B and C to the Town and Country Planning (Scotland) Act 1997). The Planning etc. Scotland) Act 2006 (Saving and Transitional Provisions) Order 2009 ensures the requirements on PACC apply only in relation to applications made on or after 3 August 2009
From 6 April prospective applicants will be able to carry out PACC in relevant cases. (PLEASE NOTE THAT THESE REQUIREMENTS RELATE TO NATIONAL AND MAJOR DEVELOPMENTS ONLY.) in anticipation of making a planning application in that regard on or after 3 August. There is no statutory requirement to carry out such consultation in relation to planning applications made before 3 August.
This information will be of particular relevance to developers and their professional advisers who are contemplating making planning applications to the Council in early August 2009.
