Mandatory Scheme of Delegation

The new Planning Act and the Regulations which provide further details require all Councils to submit to Scottish Ministers a mandatory Scheme of Delegation for approval.  This is required to explain Councils' arrangements for deciding different classes of application in accordance with a hierarchy of developments which is set out in detail in the Regulations.

On 2 July 2009 Scottish Ministers approved the Council's Scheme which will come into force for applications decided, under the terms of the Scheme, on or after 3 August 2009.

The proposed Scheme if similar in many ways to the Council's previous Scheme of Delegation approved in February 2009.

All large scale applications (categorised as either "national" or "major" in the hierarchy) will continue to be decided by elected members of the Council in Committee.  More minor scale applications (i.e. those categorised as "local" in the hierarchy) will be delegated for decision to an "appointed officer".  However the Council has decided that certain categories of "local" application should be determined by the Committee regardless of the delegated powers.  These are application which :

  • attract six or more valid written objections and the application is recommended for approval 
  • attract an objection from a statutory consultee and where the application is being recommended for approval
  • are recommended for approval and which are significantly contrary to the development plan and is recommended for approval 
  • the Council has decided should be dealt with by Committee as opposed to the "appointed officer"
  • are submitted by or on behalf of the Council or where the Council has a financial interest
  • the Director of City Development considers should be determined by Committee rather than the "appointed officer" and
  • require the submission of an Environmental Impact Statement
  • an application submitted by or on behalf of an Elected Member of the Council.  (Summary clarified 26:11:09)

Discretionary Scheme of Delegation

At the same time the Council took the opportunity to revise its discretionary Scheme of Delegation which deals with those types of application not covered by the Statutory Scheme and other planning matters.
