Dundee's Local Review Body, Notice of Review Form and Guidance Notes

At its meeting on 1 July 2009 the Council's Policy and Resources Committee considered and approved the Council's arrangements for consulting its Local Review Body. This is a small Committee of Councillors who, which officer support, will consider certain types of planning appeal LOCALLY as opposed to the previous arrangements where all appeals against the refusal of planning permission are submitted to Scottish Ministers through the Directorate for Planning and Environmental Appeals.

The Council has decided to form a Local Review Body which will

  • be a Committee of the Council
  • comprise 3 elected Members with 6 substitute members
  • meet on a regular monthly basis, depending on business to be conducted
  • meet in public
  • be supported by committee services, legal and planning officers of the Council

Decision Notices in respect of planning and related types of application are accompanied by a statement outlining the rights which the applicant has to challenge the decision by means of either appeal to Scottish Ministers or by seeking a review from the Council's Local Review Body (see above).

The right to a Review by the Council's Local Review Body applies to those applications decided by the "appointed person" i.e. officers, under the Council's Mandatory Scheme of Delegation.  A right of Review is also available to applicants for a local category of applications where the Council has failed to reach a decision within the statutory time period of 2 months (or where that period is extended as a result of other statutory procedures).

The right to seek a Review lasts for 3 months from the date of the Decision Notice or 3 months from the date of expiry of the period allowed for determining the application.
