Do I need Planning Permission?
MAJOR CHANGES TO HOUSEHOLDER PERMITTED DEVELOPMENT
The Town and Country Planning (General Permitted Development) (Scotland) Amendment Order comes into force on 6 February 2012. Any development commenced on or after this date is covered by the new rules (development commenced before this date and completed before 31 August 2012 is covered by the old rules).
The effect of the changes is to liberalise the rules governing when planning permission is required for householder development in line with the Scottish Government Agenda to Modernise the Planning System.
This legislation radically changes the rules covering when planning permission is required for householder development. If you want to obtain written confirmation whether planning permission is required for a development you intend to carry out, you will need to submit an application for a Certificate of Lawfulness. The forms and guidance notes can be accessed at https://www.dundeecity.gov.uk/forms/planningapps.php (Please tick the bottom left box which states "Cert. of Lawfulness (Proposed Use/Development)". The fee for such an application involving householder development is currently £80.
Please remember that if your dwelling is a Listed Building or lies within a Conservation Area there are much stricter rules governing what can be done without obtaining permission.
