Action the Council takes against benefit fraudsters
- Reassessment of benefit
- Recovery of overpaid benefit obtained because of the Fraud Offence (this applies to all cases appropriate under the terms of the Social Security Administration Act 1992 and later amendments)
- Administrative Caution
- Administrative Penalty (30% of the overpayment)
- Prosecution
- Report where appropriate on Proceeds of Crime to the DWP Financial Investigation Team
Repeat Offending
Where it is established that an individual has committed a previous benefit offence and the investigation leads to a proven fraud, the Council will, where there is sufficient evidence, report the matter to the Procurator Fiscal.
