Advert/advertisement - any word, letter, model, sign, placard,
board, notice, awning, blind, device or representation, whether illuminated or not, in the
nature of, and employed wholly or partly for the purposes of, advertisement, announcement or
direction, and (without prejudice to the foregoing provisions of this definition), includes
any hoarding or similar structure used or designed, or adapted for use and anything else used,
or designed or adapted principally for use, for the display of advertisements, and references
to the display of advertisements shall be construed accordingly.

Animation - Animation is defined as the "act of giving life
to"; vigour; liveliness - For the purposes of this questionnaire Animation would cover an
advert whose constituent parts either move or appear to move because of intermittent
lighting or similar.

Area of Special Advertisement Control - This is geographical
area defined by the planning authority in which they consider a stricter degree of
advertisement control is justified.
|
Background Illumination - Lighting used to illuminate an
advert either from the rear or lighting that shines on directly or indirectly the overall
area of the advert. This would not include lighting which internally illuminates the individual
characters of the advertisement.

Building - includes any structure or erection, and any part of
a building, as so defined, but does not include plant or machinery comprised in a building.
|
Building or similar work - For the purposes of these
regulations building work relates to construction projects such as house building, major
road works etc or projects involving engineering operations of a similar nature.
|
Business - employment, trade, profession or occupation.
|
Commercial Purposes - Activities which are carried out in
pursuit of commerce where goods and services are traded where profit is the main motivation.
|
Conservation Area - These are areas of special architectural
or historic interest, the character or appearance of which it is desirable to preserve or
enhance. To find out whether your property is within a conservation area please contact the
Planning and Transportation department or check the title deeds to your property.
This information should be included in this document.

Demonstration of agricultural methods or processes - For the
purposes of these regulations demonstrations of agricultural methods are shows or similar
gatherings where the principal subject matter is agriculture related such as the
Royal Highland Show or the Angus Show.

Designated in a current development plan - An area zoned in
either an adopted local plan, structure plan or subject local plan which has not been
superseded by another development plan.
|
Enclosing - enclosed land means land which is wholly or for
the most part enclosed with any hedge, wall, fence or similar screen. This definition does
not include any public park, public garden, or other land held for the use or enjoyment of
the public.

First Floor level - In the U.K. the first floor is taken
as the "second" floor when counting up from ground level where the main external entrance
to a building is taken from, this being the ground floor.
|
Flat - means a separate and self-contained set of premises
whether or not on the same floor and forming part of a building from some other part of
which it is divided horizontally.
|
Forecourt - in relation to the display of advertisements on
any building, the ground floor level of that building.
|
Ground Level - in relation to the display of advertisements
on any building, the ground floor level of that building.
|
Illuminated Advert - An advertisement which is designed or
adapted to be illuminated by artificial lighting, directly or by reflection, for the purposes
of advertisement, announcement or direction.

Industrial - economic activity involving manufacture and trade.
|
Local event of a religious, educational, cultural,
social or recreational character - for example village fetes, village hall activities,
church gatherings, pageants as distinct from commercial events hosted by commercial enterprises.

Main Display Window - The main glazed area of a business
premises (usually used for retail but not exclusive to retailing) usually with a street
frontage, where the goods being sold or the services being offered can be seen from public areas.
|
Moving Feature - These are taken as being constituent parts
of an advertisement that either move as part of the advert or appear to move because of
intermittent lighting as part of the advert.
|
Recreational - in relation to an institution shall not apply
to any institution for the carrying on of sport, games or physical training primarily as a
commercial undertaking.
|
Road Frontage - That part of a building, yard or curtilage
which fronts directly onto (or immediately adjacent to) a road as defined in the
Roads (Scotland) Act 1984.
|
Sale of Goods or livestock - For the purposes of these
regulations the sale of goods and livestock relate to things like car boot sales, auctions,
cattle auctions etc.

Site - in relation to an advertisement means any land or
any building, other than an advertisement as herein defined, on which an advertisement is
displayed.
|
Shop Premises - Property where the principal use is for the
retail sale of goods to visiting members of the public.
|
Statutory Undertakers - any person mentioned in section 275(1)
of the Town and Country Planning (Scotland) Act 1997 or persons authorised by any
enactment to carry on any railway, light railway, tramway, road transport, water transport,
canal, inland navigation, dock, harbour, pier or lighthouse undertaking or any undertaking
for the supply of hydraulic power or water and a relevant airport operator
(within the meaning of Part V of the Airports Act 1986); any public gas transporter,
the Post Office and the Civil Aviation Authority. Any holder of a licence under section 6
of the Electricity Act 1989.

Window - For the purpose of this questionnaire a window is
taken as a substantial window forming part of an elevation where the main function of that
window is for display purposes.
