The Private Rented Housing Panel (PRHP) can help Scottish tenants and landlords resolve their differences. From 3 September 2007, the prhp will provide tenants with a way to force landlords to do necessary repairs. All rented properties must meet the repairing standard at the beginning of the tenancy. It is then the tenants responsibility to inform the landlord should the property drop below this standard during the course of the tenancy.

What is the Repairing Standard?

The standard is fairly basic. A house meets the repairing standard if:

a) it is wind and watertight and in all other respects reasonably fit for human habitation,

b) the structure and exterior of the house (including drains, gutters and external pipes) are in a reasonable state   of repair and in proper working order,

c) the installations in the house for the supply of water, gas and electricity and for sanitation, space heating and heating water are in a reasonable state of repair and in proper working order,

d) any fixtures, fittings and appliances provided by the landlord under the tenancy are in a reasonable state of repair and in proper working order,

e) any furnishings provided by the landlord under the tenancy are capable of being used safely for the purpose for which they are designed, and

f) the house has satisfactory provision for detecting fires and for giving warning in the event of fire or suspected fire.

Should the house fail to meet the repairing standard you should first notify your landlord in writing. A standard letter is available to download on the PRHP website. You should keep a copy of this letter and any proof of delivery.

Should the repairs requested not be carried out in a reasonable time you should apply to the PRHP for them to assist. An application form and guidance notes can be downloaded at from the PRHP website.
