In the case of Application No 1, the Committee noted that an application had been made for a Taxi Operators Licence to replace an existing Taxi Operators Licence with an electric vehicle. The existing licence holder was George Mitchell, OP127. Directors of Dundee Cabs Ltd were George Mitchell and Mohammed Hashmi. Thereafter, having heard a representative on behalf of the applicant and having considered the advice of the Legal Officer, the Committee agreed that the application be granted.

 

(f) APPROVED LIST OF ELECTRIC VEHICLES - ADDITION TO LIST

 

It was reported that the Hyundai Kona EV presented by the Taxi Centre had been assessed by the Plant and Vehicle Officer and that having received the appropriate certification, it was recommended that this be added to the approved list of electric vehicles.

 

The Committee agreed that the vehicle be added to the approved list of electric vehicles.

In the case of Application Nos 1 to 11, the Committee agreed to resolve under Section 50(A)(4) of the Local Government (Scotland) Act 1973, that the press and public be excluded from the meeting for these items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act and that the matters be considered in the private part of the agenda.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

V CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) SECOND HAND DEALER - NEW APPLICATION

 

There was submitted an application by Company M for a Second Hand Dealers Licence. There was submitted a letter of objection from the Chief Constable relative to this application. There were also submitted comments from Building Control and City Development relative to this application. The Committee gave consideration to the content of the documentation. Thereafter, having noted that the applicant had failed to provide a copy of the Corporate Tax Reference Number and insurance details and having heard a representative of the Chief Constable, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted until the meeting of this Committee to be held on 6th June, 2019, subject to any necessary approval being received from Building Control and the submission of the Corporate Tax Reference Number to the satisfaction of the Licensing Office and the surrender of the existing licence and that the matter be recalled to the meeting of this Committee to be held on 6th June, 2019 for an update on the operation of the licence.

 

(b) STREET TRADER - NEW APPLICATION AND VARIATION

 

There was submitted an application by Mr W W for a Street Traders Licence. The Committee noted that application had also been made to vary Conditions 9 and 10 which required the vehicle to be moved every 15 minutes and not to return within one hour. There was also submitted a letter of representation from the Chief Constable relevant to this application and comments which had been received from City Development. The Committee gave consideration to the content of the documentation. Thereafter, having noted that planning consent for change of use of land was required and having heard a representative of the Chief Constable, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted, subject to the condition that planning permission was obtained at which time the licence would become effective and that the conditions in relation to the requirement to move location every 15 minutes be removed.

 

(c) TAXI DRIVER - RENEWAL APPLICATION AND UPDATE

 

(i) Reference was made to Article V(d) of the minute of meeting of this Committee of 1st November, 2018, wherein the Committee agreed to grant an application by Mr C M for a Taxi Drivers Licence and to recall the application to this meeting of the Committee for an update from the Chief Constable on the operation of the licence. There was submitted an application by Mr C M for renewal of his Taxi Driver's Licence. There was submitted the original letter of representation from the Chief Constable relative to this application. Thereafter, having heard a representative of the Chief Constable, an agent on behalf of the applicant and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken and that the application be granted.

 

(d) TAXI OPERATOR - REQUESTS FOR VARIATIONS

 

(i) There was submitted a request by Mr A M for a further 28 day extension to place an electric vehicle on service in the operation of the licence. The Committee noted that extensions had previously been granted under delegated powers. The Committee gave consideration to the content of the application. Thereafter, having heard the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted.

 

(ii) There was submitted a request by Mr T N to vary the conditions of his licence to allow the licence holder to place a saloon car vehicle on service in operation of the licence in place of a wheelchair accessible vehicle. There was submitted supporting documentation which had been received from the applicant. The Committee gave consideration to the content of the documentation. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that consideration of the application be deferred to the meeting of this Committee to be held on 7th March, 2019 to allow the applicant to submit written documentation regarding the suitability of other wheelchair accessible vehicles which were available from the approved list of wheelchair accessible vehicles and that, in the meantime, the licence holder be issued with a Wheelchair Exemption Certificate and that they make contact with the Licensing Office with regard to the processing of their application further.

 

(iii) There was submitted a request by Mr G D to vary the conditions of his licence to allow the licence holder to place a saloon car vehicle on service in operation of the licence in place of a wheelchair accessible vehicle. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. There was submitted supporting documentation which had been received from the applicant. Thereafter, having considered the advice of the Legal Officer and receiving confirmation that the applicant had requested that consideration of the application be deferred to a future meeting, the Committee agreed to defer consideration of the application to the meeting of this Committee to be held on 7th March, 2019 to allow the applicant to be in attendance.

 

(e) TAXI OPERATOR - REQUEST FOR EXTENSION OF TIME TO PLACE A VEHICLE ON SERVICE

 

Reference was made to Article VII(a) of the minute of meeting of this Committee of 6th December, 2018, wherein it was agreed to grant the application by Ms B S for an extension of time until this meeting of the Committee to allow the licence holder to place a vehicle on service in the operation of the licence. The Committee noted that extensions had previously been granted under delegated powers. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having considered the advice of the Legal Officer, the Committee agreed that the application be granted until the meeting of this Committee to be held on 28th March, 2019.

 

(f) TAXI OPERATOR - REQUEST FOR WHEELCHAIR EXEMPTION CERTIFICATE

 

There was submitted a request by Mr D M for a Wheelchair Exemption Certificate. The Committee gave consideration to the content of the application. Thereafter, having heard the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted and that the licence holder be issued with a Wheelchair Exemption Certificate.

 

(g) PRIVATE HIRE OPERATOR - SUSPENSION HEARING

 

Reference was made to Article II(b)(i) of the minute of meeting of the Licensing Sub-Committee of 1st November 2018, wherein it was agreed to hold a hearing in relation to the fitness of Company P to be the holder of a Private Hire Operators Licence. There was submitted a letter of information from a Licensing Standards Officer relevant to the alleged conduct of Company P during the currency of their Private Hire Operators Licence. The Committee gave consideration to the content of the letter. Thereafter, having heard a Licensing Standards Officer, an agent on behalf of the licence holder and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken and that the licence holder be issued with a verbal warning as to their future conduct.

 

(h) PRIVATE HIRE OPERATOR/TAXI DRIVER AND TAXI OPERATOR - SUSPENSION HEARING

 

Reference was made to Article VI(e)(ii) of the minute of meeting of this Committee of 10th January, 2019, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr A M during the currency of his Private Hire Operator, Taxi Driver and Taxi Operator Licences to this meeting of the Committee to allow the licence holder to obtain information he was requesting through the subject access process. There was submitted the original letter of information from City Development in relation to the alleged conduct of Mr A M during the currency of his licences. The Committee gave consideration to the content of the letter. Thereafter, having heard representatives from City Development, a representative on behalf of the licence holder, the licence holder on their own behalf, a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken and that the licence holder be issued with a written warning as to their future conduct, subject to the condition that he did not use the charging facility at the location as narrated in the letter from City Development and that the matters be recalled to the meeting of this Committee to be held on the 6th June, 2019 for an update to be provided on the operation of the licences.

 

(i) TAXI DRIVER - SUSPENSION HEARINGS

 

(i) Reference was made to Article VI(f)(i) of the minute of meeting of this Committee of 17th January, 2019, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr O L during the currency of his Taxi Drivers Licence to this meeting of the Committee to allow the licence holder to be in attendance. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr O L during the currency of his Taxi Drivers Licence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken and that the licence holder be issued with a written warning as to their future conduct.

 

(ii) Reference was made to Article II(iv) of the minute of meeting of the Licensing Sub‑Committee of 1st November 2018, wherein it was agreed to hold a hearing in relation to the alleged conduct of Ms R T during the currency of her Taxi Drivers Licence. There was submitted a letter of information from a Licensing Standards Officer relevant to the alleged conduct of Ms R T during the currency of her Taxi Drivers Licence. The Committee gave consideration to the content of the letter. Thereafter, having heard a Licensing Standards Officer, an agent on behalf of the licence holder and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken and that the licence holder be issued with a verbal warning as to their future conduct.

 

(j) TAXI DRIVER/TAXI OPERATOR - SUSPENSION HEARING

 

Reference was made to Article II(c)(i) of the minute of meeting of the Licensing Sub-Committee of 1st November 2018, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr M H during the currency of his Taxi Driver and Taxi Operators Licences. There was submitted a letter of information from a Licensing Standards Officer relevant to the alleged conduct of Mr M H during the currency of his Taxi Driver and Taxi Operators Licences. There was also submitted a letter of support from an agent on behalf of the licence holder. The Committee gave consideration to the content of the documentation. Thereafter, having heard a Licensing Standards Officer, an agent on behalf of the licence holder and consideration of the advice of the Legal Officer, the Committee agreed that no further action be taken.

 

VI HOUSING (SCOTLAND) ACT 2006

 

(a) HOUSES IN MULTIPLE OCCUPATION - NEW APPLICATIONS

 

Reference was made to Article IV(b) of this minute, wherein it was agreed to consider the 11 applications submitted by Company J for Houses in Multiple Occupation Licences in the private part of the proceedings.

 

There were submitted 11 applications by Company J for Houses in Multiple Occupation Licences. There was submitted a letter of representation from the Private Sector Services Manager relevant to these applications. A copy of the overprovision reports were also submitted. The Committee gave consideration to the content of the documentation. Thereafter, having heard the Private Sector Services Manager, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the applications be granted, subject to the applicant lodging appropriate managing agent accredited training documentation with the Private Sector Services Manager to his satisfaction in order to accord with the requirements of revised Scottish Government legislation.

The Sub-Committee gave consideration to the content of the letter.

 

Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer and supporting documents which were tabled by the licence holder, the Sub-Committee agreed that no further action be taken and that the licence holder be issued with a verbal warning as to their future conduct.

 

(ix) Reference was made to Article II(e)(iii) of the minute of meeting of this Sub-Committee of 4th October, 2018, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr N S during the currency of his Taxi Drivers Licence.

 

There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr N S during the currency of his Taxi Drivers Licence.

 

The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Sub-Committee gave consideration to the content of the letter.

 

Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub-Committee agreed to adjourn the hearing until the meeting of this Sub‑Committee to be held on 28th March, 2019 to await the outcome of court proceedings.

 

(b) TAXI OPERATORS LICENCE AND TAXI DRIVER'S LICENCE - SUSPENSION HEARING

 

Reference was made to Article II(f) of the minute of meeting of this Sub-Committee of 4th October, 2018, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr M M during the currency of his Taxi Operators Licence and Taxi Driver's Licence.

 

There was submitted a letter of information from the Environmental Compliance Manager relative to the alleged conduct of Mr M M during the currency of his Taxi Drivers Licence and Taxi Operators Licence.

 

The Sub-Committee gave consideration to the content of the letter.

 

Thereafter, having heard a Licensing Standards Officer, an agent on behalf of the licence holder, the licence holder on their own behalf and consideration of the advice of the Legal Officer and consideration of supporting paperwork which was tabled by the agent on behalf of the licence holder, the Sub-Committee agreed to adjourn the hearing until the meeting of this Sub-Committee to be held on 27th June, 2019, to allow the licence holder to attend the PAM Group for a medical examination to confirm that he met Group 2 standards and that he was medically fit to be the holder of a Taxi Driver's Licence and for an update report to be provided from the licence holders consultant physician.

 

(c) WINDOW CLEANERS LICENCE - SUSPENSION HEARING

 

Reference was made to Article II(d) of the minute of meeting of this Sub-Committee of 4th October, 2018, wherein it was agreed to adjourn consideration of the hearing in relation to the alleged conduct of Mr A W during the currency of his Window Cleaners Licence to this meeting of the Sub-Committee to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr A W during the currency of his Window Cleaners Licence.

 

The Sub-Committee gave consideration to the content of the letter.

 

Thereafter, having heard a representative of the Chief Constable, an agent on behalf of the licence holder, the licence holder on their own behalf and consideration of supporting documents tabled by the agent on behalf of the licence holder and the advice of the Legal Officer, the Sub-Committee agreed that no further action be taken and that the licence holder be issued with a verbal warning as to their future conduct.

 

(d) TAXI DRIVERS LICENCE - REQUESTS FOR SUSPENSION HEARINGS

 

(i) There was submitted a letter of information from a Licensing Standards Officer relative to the alleged conduct of Mr P M during the currency of his Taxi Drivers Licence.

 

The Sub-Committee gave consideration to the content of the letter.

 

Thereafter, having heard a Licensing Standards Officer and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr P M to be the holder of a Taxi Driver's Licence.

 

(ii) There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr W S during the currency of his Taxi Drivers Licence.

 

The Sub-Committee gave consideration to the content of the letter.

 

Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that a hearing be held in due course in relation to the fitness of Mr W S to be the holder of a Taxi Driver's Licence.
