In the case of Application No 2, the Committee noted that the applicant was not present, and agreed that the matter be considered in their absence. Thereafter, having noted that the applicant had failed to provide a medical certificate, complete an approved SVQ Taxi Driver Training course and supply a copy of their Unique Tax Reference Number to confirm they were registered for tax purposes, the Committee agreed that the application be considered incompetent.

 

In the case of Application No 3, the Committee noted that the applicant was not present, and agreed that the matter be considered in their absence. In the case of the above proposals, the Committee acceded to requests for deputations which had been received from Willie Lees of RMT Union (Dundee Branch) and Chris Elder of Unite The Union to address the Committee relative to this item of business. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew. Thereafter, having heard a representative of the Roads and Transportation Corporate Fleet Division, the Senior Environmental Compliance Officer and consideration of the advice of the Legal Officer, the Committee agreed to adjourn consideration of the proposals to the meeting of this Committee to be held on 5th March, 2020 to allow for further consideration of the proposals at the meeting of the Taxi Liaison Group to be held on 11th February, 2020.

 

(k) APPROVED LIST OF ELECTRIC VEHICLES - ADDITION TO LIST

 

It was reported that a MG ZS Excite Saloon Car presented by The Taxi Centre had been assessed by the Assistant Transport Manager and that having received the appropriate certification, it was recommended that this vehicle be added to the approved list of electric vehicles. A copy of the assessment was submitted.

 

The Committee agreed that the vehicle be added to the approved list of electric vehicles.

V HOUSING (SCOTLAND) ACT 2006

 

(a) LANDLORD REGISTRATION - HEARINGS

 

Reference was made to Article VI(b) of the minute of meeting of this Committee of 7th November, 2019, wherein it was agreed to adjourn the hearings in relation to the suitability of 12 registration holders to be registered as landlords to this meeting of the Committee to allow works to be completed to the satisfaction of the Private Sector Services Manager and for the appointment of a Factor to be made and for an update to be provided in this regard. There were submitted the original letters of information from the Senior Environmental Compliance Officer and the Private Sector Services Manager relevant to the sustainability of the 12 registration holders to be registered as landlords. The Committee noted that two of the registration holders were not present or represented and agreed that the matters be considered in their absence. Thereafter, having heard the Private Sector Service Manager, the Senior Environmental Compliance Officer, the remaining registration holders either on their own behalf or by representatives for the registration holders and consideration of the advice of the Legal Officer, the Committee agreed that consideration of the matters be further deferred to the meeting of this Committee to be held on 26th March, 2020 to allow for an update on the matters to be provided by the Private Sector Services Manager and the Senior Environmental Compliance Officer and to allow for all of the registration holders to liaise with the Private Sector Services Manager during the intervening period as follows:-

 

(i) for the appointment of a Factor who was listed on the Property Factor Register to be agreed by the other registration holders to have day to day management responsibilities for the upkeep and maintenance of the properties and common areas including garden ground;

 

(ii) for outstanding works to be completed to the satisfaction of the Private Sector Services Manager; and

 

(iii) for applications to be finalised and submitted to the Private Sector Services Manager for the installation of a secure door entry system at the properties let at this location by the registration holders.

 

The Committee further decided that the registration holder Mr R P be deemed not to be a fit and proper person to remain on the Register of Landlords unless:-

 

(iv) he paid all outstanding Fixed Penalty Notices in respect of the three properties at the location which were owned by him; and

 

(v) he completed and submitted an application to the Private Sector Services Manager in respect of the installation of the aforementioned secure door entry system, all of this to be done by the meeting of this Committee to be held on 26th March, 2020.

 

VI CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI OPERATOR - REQUEST FOR VARIATION

 

Reference was made to Article V(c)(ii) of the minute of meeting of this Committee of 1st February, 2018, wherein it was agreed to grant the application by Mr J R for a variation of his Taxi Operator's Licence to substitute a saloon car vehicle for a wheelchair accessible vehicle. There was submitted a further application by Mr J R requesting a variation of a second Taxi Operators Licence to allow him to substitute a saloon car vehicle for a wheelchair accessible vehicle. There was submitted a copy of the supporting documentation which had been provided by the applicant relevant to this application. The Committee gave consideration to the content of the documentation. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the request for variation be granted.

 

(b) TAXI DRIVER - NEW APPLICATION

 

There was submitted an application by Mr D F for a Taxi Drivers Licence. The Committee noted that the applicant was not present and agreed that the matter be considered in their absence. There were submitted letters of objection from the Chief Constable and the Senior Environmental Compliance Officer relevant to this application. Comments had also been submitted by the Corporate Finance Division. The Committee gave consideration to the content of the documentation. Thereafter, having heard the Legal Officer, the Committee agreed that the application be considered incompetent.

 

(c) TAXI DRIVER'S LICENCE - SUSPENSION HEARINGS

 

(i) Reference was made to Article II(f) of the minute of meeting of the Licensing Sub‑Committee of 9th January, 2020, wherein it was agreed to suspend the Taxi Drivers Licence held by Mr L B with immediate effect and to hold a hearing in due course in relation to the suitability of Mr L B to be the holder of a Taxi Drivers Licence. There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr L B during the currency of his Taxi Drivers Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to note that no further action was required as the Taxi Drivers Licence held by Mr L B had ceased to have effect by reason of his being disqualified from driving by the court.

 

(ii) Reference was made to Article VII(f)(i) of the minute of meeting of this Committee of 7th November, 2019, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr S C during the currency of his Taxi Drivers Licence to this meeting of the Committee to await the outcome of court proceedings and to continue the suspension of the Taxi Drivers Licence held by Mr S C during the intervening period with immediate effect. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr S C during the currency of his Taxi Drivers Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to further adjourn the hearing in relation to the alleged conduct of Mr S C during the currency of his Taxi Drivers Licence to the meeting of this Committee to be held on 30th April, 2020 to await the outcome of court proceedings and to continue the suspension of the Taxi Drivers Licence held by Mr S C during the intervening period with immediate effect.

 

(iii) Reference was made to Article VII(c)(i) of the minute of meeting of this Committee of 5th December, 2019, wherein it was agreed to further adjourn the hearing in relation to the alleged conduct of Mr G McM during the currency of his the Taxi Drivers Licence to this meeting of the Committee to await the outcome of court proceedings and to continue the suspension of the Taxi Drivers Licence held by Mr G McM during the intervening period with immediate effect. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr G McM during the currency of his Taxi Drivers Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having heard the representative of the Chief Constable and consideration of the Legal Officer, the Committee agreed to further adjourn the hearing in relation to the alleged conduct of Mr GMcM to be the holder of a Taxi Drivers Licence to the meeting of this Committee to be held on 26th March, 2020 to await the outcome of court proceedings and to continue the suspension of the Taxi Drivers Licence held by Mr G McM during the intervening period with immediate effect.

 

(iv) Reference was made to Article VI(b)(ii) of the minute of meeting of this Committee of 9th January, 2020, wherein it was agreed to further adjourn the hearing in relation to the alleged conduct of Mr G M during the currency of his Taxi Drivers Licence to this meeting of the Committee to await the outcome of court proceedings and to continue the suspension of the Taxi Drivers Licence held by Mr G M during the intervening period with immediate effect. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr G M during the currency of his Taxi Drivers Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer and consideration of the content of letters of support

which had been tabled on behalf of the licence holder, the Committee agreed to suspend the Taxi Drivers Licence held by Mr G M for the unexpired portion of the licence with immediate effect and to continue the suspension of the Taxi Drivers Licence held by Mr G M.

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that the Taxi Drivers Licence held by Mr R B be suspended with immediate effect and that a suspension hearing be held in due course in relation to the fitness of Mr R B to be the holder of a Taxi Drivers Licence.

(iv) Reference was made to Article III(b) of the minute of meeting of this Sub‑Committee of 7th November, 2019, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr B M during the currency of his Taxi Drivers Licence. There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr B M during the currency of his Taxi Drivers Licence. The Sub‑Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Sub-Committee agreed that no further action be taken and that the licence holder be issued with a written warning as to their conduct during the currency of their Taxi Drivers Licence.

 

(v) Reference was made to Article II(a)(vi) of the minute of meeting of this Sub‑Committee of 3rd October, 2019, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr G McL during the currency of his Taxi Drivers Licence to this meeting of the Sub-Committee to await the outcome of court proceedings. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr G McL during the currency of his Taxi Drivers Licence. The Sub‑Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed to further adjourn the hearing in relation to the alleged conduct of Mr G McL during the currency of his Taxi Drivers Licence to the meeting of this Sub-Committee to be held on 26th March, 2020 to await the outcome of court proceedings.

 

(vi) Reference was made to Article II(a) of the minute of meeting of this Sub‑Committee of 5th December, 2019, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr C M during the currency of his Taxi Drivers Licence. There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr C M during the currency of his Taxi Drivers Licence. The Sub‑Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, a representative on behalf the licence holder, the licence holder on their own behalf and consideration of the advice of the Legal Officer the Sub-Committee agreed that no further action be taken.

 

(vii) Reference was made to Article II(b) of the minute of meeting of this Sub‑Committee of 3rd October, 2019, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr K R during the currency of his Taxi Drivers Licence. There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr K R during the currency of his Taxi Drivers Licence. The Sub‑Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Sub-Committee agreed that no further action be taken and that the licence holder be issued with a verbal warning as to their future conduct during the currency of their Taxi Drivers Licence.

 

(viii) Reference was made to Article II(a)(ix) of the minute of meeting of this Sub‑Committee of 3rd October, 2019, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr W S during the currency of his Taxi Drivers Licence to this meeting of the Sub-Committee to await the outcome of court proceedings. There was submitted the original letter of information from the Chief Constable relevant to the alleged conduct of Mr W S during the currency of his Taxi Drivers Licence. The Sub‑Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that no further action be taken.

 

(b) WINDOW CLEANERS LICENCE - SUSPENSION HEARING

 

Reference was made to Article II(a) of the minute of meeting of this Sub‑Committee of 7th November, 2019, wherein it was agreed to hold a hearing in relation to the alleged conduct of Mr J S during the currency of his Window Cleaners Licence. There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr J S during the currency of his Window Cleaner's Licence. The Sub-Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. The Sub‑Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub-Committee agreed to adjourn the hearing in relation to the alleged conduct of Mr J S during the currency of his Window Cleaners Licence to the meeting of this Sub-Committee to be held on 26th March, 2020 to await the outcome of court proceedings.

 

(c) TAXI DRIVERS LICENCE - REQUESTS FOR SUSPENSION HEARINGS

 

(i) There was submitted a letter of information from a Licensing Standards Officer relevant to the alleged conduct of Mr G K during the currency of his Taxi Drivers Licence. The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard a Licensing Standards Officer and consideration of the advice of the Legal Officer, the Sub-Committee agreed that a hearing be held in due course in relation to the alleged conduct of Mr G K during the currency of his Taxi Drivers Licence.

 

(ii) There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr A C during the currency of his Taxi Drivers Licence. The Sub‑Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub-Committee agreed that a hearing be held in due course in relation to the alleged conduct of Mr A C during the currency of his Taxi Drivers Licence.

 

(iii) There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr J C during the currency of his Taxi Drivers Licence. The Sub‑Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub-Committee agreed that a hearing be held in due course in relation to the alleged conduct of Mr J C during the currency of his Taxi Drivers Licence.

 

(d) SKIN PIERCING AND TATTOOIST LICENCE - REQUEST FOR SUSPENSION HEARING

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr M D during the currency of his Skin Piercing and Tattooist Licence. The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub-Committee agreed that a hearing be held in due course in relation to the alleged conduct of Mr M D during the currency of his Skin Piercing and Tattooist Licence.

 

The Convener agreed that the undernoted items of business be considered as a matter of urgency in terms of Standing Order No 17(b) in view of the timescales involved.

 

(e) TAXI DRIVERS LICENCE - REQUEST FOR SUSPENSION HEARING

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr S Z during the currency of his Taxi Drivers Licence. The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub-Committee agreed that a hearing be held in due course in relation to the alleged conduct of Mr S Z during the currency of his Taxi Drivers Licence.

 

(f) TAXI DRIVERS LICENCE - REQUEST FOR IMMEDIATE SUSPENSION

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr L B during the currency of his Taxi Driver Licence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that the Taxi Drivers Licence held by Mr L B be suspended with immediate effect and that a suspension hearing be held in due course in relation to the alleged conduct of Mr L B during the currency of his Taxi Drivers Licence.
