The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to the variation to allow off-sales Monday to Sunday from 10 am to 10 pm, to on-sales terminal hour on Friday and Saturday to 1 am, to allow on-sale from 11 am Sunday, and to allow receptions, club and other group meetings and indoor sports during core hours.

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to the variation to allow alcohol to be sold for consumption on the premises until 1 am Mondays to Sundays, to allow alcohol to be consumed in the garden and seated areas immediately outside the clubhouse and at the north side of the bowling green, and to allow children and young persons access to the clubhouse when participating in coaching sessions, spectating during matches and for the duration of private functions, subject to the conditions that alcohol can only be consumed in the garden and seated outdoor areas from 11 am to 9 pm Monday to Sunday during the months September to June and 11 am to 10 pm Monday to Sunday in the months of July and August, all persons must be seated when consuming alcohol in these areas. The Committee should ensure that patrons do not cause noise that would disturb local residents and that there would be no amplified music or vocals in the outside area.

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to allow the variation to allow alcohol to be sold for consumption off the premises from 11 am until 9 pm daily (subject as narrated below for Sundays) and to allow home delivery and for the change of premises name from 'Simpson's' to 'The Selkie'. (Under Planning Permission 10/00405/FUL, operating hours on a Sunday are allowed from 11 am to 6 pm only. However, hospitality restrictions are currently relaxed due to COVID-19. Once COVID restrictions are lifted, operating hours would revert to 11 am to 6 pm on Sunday.

The Board, having heard from a Licensing Standards Officer, an officer from City Development and the Board's Legal Adviser, agreed to refuse the application.

 

III PREMISES LICENCE - REVIEW HEARINGS

 

(i) 172, THE CAIRD, 172 NETHERGATE, DUNDEE

 

The Board, having heard from the licence holder, the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser, agreed that the licence be suspended for a period of one month.

 

IV PERSONAL LICENCE - REVIEW HEARINGS

 

(i) PETER MARR

 

The Board heard from the licence holder, the Licensing Standards Officer, the Chief Constables representative and the Boards Legal Adviser.

 

Thereafter, the Convener moved that the Board endorse the licence. As an amendment, Councillor Cruickshank moved that the Board suspend the licence for a period of one month. On a division, there voted for the motion - the Convener, Bailie Roberts and Councillors Alexander, Rome, McIrvine and Scott (6); and for the amendment - Councillors Lynn and Cruickshank (2) - whereupon the motion was declared carried and the licence endorsed.
