I DECLARATION OF INTEREST

 

Bailie Roberts declared an interest in respect of Article III by virtue of a family members involvement with Police Scotland Youth Volunteers.

 

II SCOTTISH FIRE AND RESCUE SERVICE QUARTERLY PERFORMANCE REPORT - 1ST OCTOBER, 2021 TO 31ST DECEMBER, 2021

 

There was submitted Report No 145-2022 by Area Commander Gibson providing information for the Committee regarding the performance of the Scottish Fire and Rescue Service against the priorities, outcomes and performance indicators detailed within the Local Fire and Rescue Plan for Dundee 2020/2023, to facilitate local scrutiny.

 

The Committee agreed to note, scrutinise and question the content of the report.

 

III DUNDEE LOCAL POLICING AREA QUARTERLY POLICE REPORT - 1ST OCTOBER, 2021 TO 31ST DECEMBER, 2021

 

There was submitted Report No 143-2022 by Chief Superintendent Davison providing information for the Committee regarding the performance of Police Scotland against performance indicators that would facilitate local scrutiny.

 

The Committee agreed to note and scrutinise the operational report.

 

IV ANTI-SOCIAL BEHAVIOUR - 1ST OCTOBER, 2021 TO 31ST MARCH, 2022

 

There was submitted Report No 139-2022 by the Executive Director of Neighbourhood Services providing an overview on the reporting figures to the Neighbourhood Services - Anti-Social Behaviour Team for the period 1st October, 2021 to 31st March, 2022.

 

The Committee agreed to note the content of the report.

 

V AIR QUALITY UPDATE

 

On a reference to Article V of the minute of meeting of the Environmental Services and Sustainability Committee of 20th February, 2006, there was submitted Report No 138-2022 by the Executive Director of Neighbourhood Services providing a summary of the results of the most recent full year's (2021) air quality monitoring data and action measures linked to the Councils Air Quality Action Plan; providing an interim update on monitored air quality levels for the first part of 2022; providing information on the performance of the Scottish Government funded bus retrofitting scheme within Dundee and providing an update on the introduction of the Dundee Low Emission Zone scheme.

 

The Committee agreed to:-

 

(i) note the content of the report;

 

(ii) remit the Executive Director of Neighbourhood Services to continue to take forward the Councils Air Quality Action Plan (AQAP) measures during 2022, and submit the 2022 Air Quality Annual Progress Report to the statutory bodies;

 

(iii) note the information provided in Appendix 2 to the report on provisional air quality monitoring data for the months of January to April, 2022;

 

(iv) note the information on the emission levels of retrofitted buses operating across Dundee; and

 

(v) note that approval for the Dundee Low Emission Zone scheme was received from the Scottish Ministers on 19th May, 2022, enabling the scheme to be introduced on 30th May, 2022, as scheduled.

 

VI USE OF REGULATION OF INVESTIGATORY POWERS (SCOTLAND) ACT 2000 AND REGULATION OF INVESTIGATORY POWERS ACT 2000

 

There was submitted Report No 80-2022 by the Executive Director of Corporate Services advising the Committee of the use made by the Council of the powers under the Regulation of Investigatory Powers (Scotland) Act 2000 and the Regulation of Investigatory Powers Act 2000 from 1st April, 2021 to 31st March, 2022 and also noting the actions arising out of the recent Inspection of the Council by the Investigatory Powers Commissioners Office.

 

The Committee agreed to:-

 

(i) note the use which the Council had made of powers contained in the Regulation of Investigatory Powers (Scotland) Act 2000 and in related powers contained in the Regulation of Investigatory Powers Act 2000 between 1st April, 2021 to 31st March, 2022;

 

(ii) approve the Council's continued proportionate use of the powers, where necessary, in the areas of crime prevention and detection or preventing disorder, in the interests of public safety and for the purpose of protecting public health and, in particular, agreed to continue to use the powers to prevent and detect anti-social behaviour; and

 

(iii) note the actions arising out of the recent Inspection of the Council by the Investigatory Powers Commissioners Office.

 

VII COMMUNITY PAYBACK ORDERS ANNUAL REPORT 2020/2021

 

There was submitted Report No 146-2022 by the Executive Director of Children and Families Service providing, the 9th Annual Report on the local operation of Community Payback Orders (CPOs) covering the period 2020/2021. The Criminal Justice and Licensing Act (Scotland) 2010 imposed a duty on local authorities to submit annual reports on CPOs. The report would be embargoed until the Scottish Government published a national Annual Report and it highlighted the contribution CPOs made locally to community safety and social inclusion. The statistical information for 2021/2022 had not yet been submitted to Scottish Government but to bring the report more up-to-date and explain justice responses to the changing public health landscape, a broad overview of activity in the last 12 months was also included.

 

The Committee agreed to:-

 

(i) note continued progress made in relation to the operation of Community Payback Orders as outlined in the report;

 

(ii) note that the effective delivery of Community Payback Orders continued to be an important element of the City Plan and the Community Justice Outcome Improvement Plan; and

 

(iii) instruct the Executive Director of Children and Families Service to provide a further report on the operation of CPOs in 12 months.

 

VIII VALEDICTORY

 

The Convener, on behalf of the Committee, paid tribute to Martin Dey, Service Manager, Children and Families Service, upon his retiral later this month and wished him well for the future.
