II PREMISES LICENCE - REVIEW HEARINGS - NON-PAYMENT OF ANNUAL FEE

 

In accordance with Schedule 3, Paragraph 10 of the Licensing (Scotland) Act 2005, each premises licence holder must pay the annual fee by the 1st October each year. The Licensing Department by law, have to send a reminder letter out before the annual fee is due. This letter was sent out to the registered address of the premises or their legal agent during August, 2022. If people had failed to pay by the 1st October, 2022, then a second letter reminding them to pay immediately was sent out, a third letter was sent in November, 2022. During the month of December, 2022, LSOs contacted premises who had still failed to pay. The premises that have still not paid are listed below.

 

Accordingly, the Board agreed to hold review hearings in respect of the undernoted premises:-

 

(i) BRASSERIE ECOSSE, 4 SHORE TERRACE

 

Having heard from the Licensing Standards Officer and the Board's Legal Adviser, it was noted that the annual fee had not been paid, therefore the Board agreed to revoke the licence.

 

(ii) LYRICS MUSIC BAR, ST ANDREWS LANE

 

Having heard from the Licensing Standards Officer and the Board's Legal Adviser, it was noted that the annual fee had not been paid, therefore the Board agreed to revoke the licence.

 

(iii) VINE OF LIFE, 173 STRATHMARTINE ROAD

 

Having heard from the Licensing Standards Officer and the Board's Legal Adviser, it was noted that the annual fee had not been paid, therefore the Board agreed to revoke the licence.

 

(iv) CARBON & LUSH, 21 SOUTH WARD ROAD

 

Having heard from the Licensing Standards Officer and the Board's Legal Adviser, it was noted that the annual fee had not been paid, therefore the Board agreed to revoke the licence.
