At a MEETING of the LICENSING BOARD held remotely on 29th June, 2023.

The minute of meeting of this Board of 18th May, 2023 was held as read.

Prior to the commencement of business, the Convener referred to the death of former Bailie Rod Wallace, a former Convener of the Licensing Board, and paid tribute to the public service rendered by him.

I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board, having heard from the applicant, the Chief Constables representative, a Licensing Standards Officer and the Board's Legal Adviser, agreed to grant the above application, subject to the conditions that CCTV to the satisfaction of the Chief Constable is to be in effect at all times within the premises and surrounding areas, and will be made available to Police Scotland at any time, and all amplified vocals shall be controlled as to be inaudible in any residential accommodation and there shall be no live performances or karaoke after 12 midnight and only background music can be played after this time.

The Board, having heard from an agent on behalf of the applicant, a Licensing Standards Officer and the Board's Legal Adviser, agreed to grant the above application.

(b) VARIATIONS (MAJOR)

The Board, having heard from an agent on behalf of the applicant, a Licensing Standards Officer and the Board's Legal Adviser, agreed to allow the variation to increase off-sales capacity from 32.76801m2 to 40.29051m2, subject to all other necessary permissions being obtained.

The Board, having heard a Licensing Standards Officer and the Board's Legal Adviser, agreed to allow the variation to extend the beer garden to the additional car park area, subject to all other necessary permissions being obtained.

The Board, having heard from an agent on behalf of the applicant, a Licensing Standards Officer and the Board's Legal Adviser, agreed to allow the variation to add restaurant facilities both within and outwith core hours.

The Board, having heard a Licensing Standards Officer and the Board's Legal Adviser, agreed to allow the variation to allow children and young persons access to funeral and weddings, Monday to Fridays 11.00 am to 11.00 pm.

II TRANSFER APPLICATION

(i) THE SHUTTLE BAR, 22/28 POLEPARK ROAD, DUNDEE

The Board, having heard from the applicant, the Boards Legal Adviser, the Chief Constables representative and the Licensing Standards Officer, agreed to grant the application for transfer of the premises licence to Ryan Fleming.

III PERSONAL LICENCE REVIEW

(i) RYAN FLEMING

The Board, having heard from the applicant, the Chief Constables representative and the Boards Legal Adviser, agreed to endorse the licence.

(ii) MARK McQUEEN

The Board, having heard from the Chief Constables representative and the Boards Legal Adviser, agreed to endorse the licence.

(iii) ASHLEY SCOTT

The Board agreed to defer this review to the August meeting of the Board to allow the licence holder to be in attendance.
