I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II SCOTTISH FIRE AND RESCUE SERVICE QUARTERLY PERFORMANCE REPORT - 1ST JANUARY, 2023 TO 31ST MARCH, 2023

 

There was submitted Report No 165-2023 by Area Commander Sharp, providing information regarding the performance of the Scottish Fire and Rescue Service against the priorities, outcomes and performance indicators detailed within the Local Fire and Rescue Plan for Dundee 2020/2023, to facilitate local scrutiny.

 

The Committee agreed to note, scrutinise and question the content of the report.

 

Thereafter, Councillor Short, seconded by Bailie Dawson, moved that the Committee requests that the Chief Executive of Dundee City Council writes to the Chair of the Scottish Fire and Rescue Board, Dr Kirsty Darwent, to convey the Council's deep regret and opposition to the proposed temporary withdrawal of one fire asset from the Dundee City Council area. In addition, such a letter should seek an immediate reversal of the decision and review of the process that led to it being made.

 

As an amendment, Bailie Macpherson, seconded by Councillor Duncan, moved that:-

The Committee notes that the Scottish Fire and Rescue Service Local Senior Officer has highlighted that these reductions sit around the financial challenges presented by the Resource Spending Review and the flat cash budget settlement.

 

It therefore also instructs the Chief Executive to write to the Cabinet Secretary for Justice asking for consideration to be urgently given for an uplift in Scottish Fire and Rescue Service core funding in 2023/2024 and subsequent years to 2026/2027.

 

On a division, there voted for the motion - the Convener, Lord Provost Campbell, Depute Lord Provost Cordell, Bailies Dawson and Sawers and Councillors Alexander, Anderson, El-Nakla, Flynn, Hunter, Lynn, Rome, Short, Smith and Tolland (15); and for the amendment - Bailies Keenan, Wright, Macpherson and Scott and Councillors Cruickshank, Malone, McHugh, McIrvine, Scullin, Shears, Coleman, Crichton and Duncan (13) - whereupon the motion was declared carried.

 

III DUNDEE LOCAL POLICING AREA QUARTERLY POLICE REPORT - 1ST JANUARY, 2023 TO 31ST MARCH, 2023

 

There was submitted Report No 172-2023 by Chief Superintendent Davison, providing information regarding the performance of Police Scotland against performance indicators that would facilitate local scrutiny.

 

The Committee agreed to note and scrutinise the operational report.

 

IV ANTI-SOCIAL BEHAVIOUR REPORT - 1ST JANUARY, 2023 TO 31ST MARCH, 2023

 

There was submitted Report No 150-2023 by the Executive Director of Neighbourhood Services, providing an overview on the reporting figures to the Neighbourhood Services Anti-Social Behaviour (ASB) Team for the period 1st January, 2023 to 31st March, 2023.

 

The Committee agreed to note the content of the report.

 

 

There was submitted Report No 152-2023 by the Executive Director of Neighbourhood Services, summarising 2022 air quality monitoring data results and progress made with Air Quality Action Plan measures; providing an update on air quality monitoring data for the early months of 2023; providing feedback on Lochee Road air quality modelling work; and giving an update on Dundee Low Emission Zone (LEZ) scheme workings.

 

The Committee agreed:-

 

(i) to note the content of the report;

 

(ii) to remit the Executive Director of Neighbourhood Services to continue to take forward the Councils Air Quality Action Plan (AQAP) measures during 2023, and submit the 2023 Air Quality Annual Progress Report to the statutory bodies;

 

(iii) to note the information provided in Appendix 2 of the report on provisional air quality monitoring data for the months of January to April, 2023;

 

(iv) to note the outcome of the detailed air quality modelling assessment of the preferred Option 2 proposal for Lochee Road as outlined in Report No 175-2021 to the 21st June, 2021 City Development Committee (Article IV of the minute of meeting of City Development Committee of 21st June, 2021 refers); and

 

(v) to note the progress being made on awareness raising campaigns and enforcement infrastructure installation for the Dundee LEZ scheme in the lead up to enforcement commencing in May, 2024.

 

VI USE OF REGULATION OF INVESTIGATORY POWERS (SCOTLAND) ACT 2000 AND REGULATION OF INVESTIGATORY POWERS ACT 2000

 

There was submitted Report No 82-2023 by the Executive Director of Corporate Services, advising of the use made by the Council of the powers under the Regulation of Investigatory Powers (Scotland) Act 2000 and the Regulation of Investigatory Powers Act 2000 from 1st April, 2022 to 30th April, 2023 and asking the Committee to note that the actions arising out of the recent inspection of the Council by the Investigatory Powers Commissioners Office had all been completed.

 

The Committee agreed:-

 

(i) to note the use which the Council had made of powers contained in the Regulation of Investigatory Powers (Scotland) Act 2000 and in related powers contained in the Regulation of Investigatory Powers Act 2000 between 1st April, 2022 to 30th April, 2023 as detailed in Appendix 1 of the report;

 

(ii) to approve the Councils continued proportionate use of the powers, where necessary, in the areas of crime prevention and detection or preventing disorder, in the interests of public safety and for the purpose of protecting public health;

 

(iii) to continue to use the powers to prevent and detect anti-social behaviour; and

 

(iv) to note the actions arising out of the recent Inspection of the Council by the Investigatory Powers Commissioners Office noted in paragraph 4.7 of the report had all been completed.
