The minute of meeting of this Committee of 19th June, 2023 was held as read.

I DECLARATION OF INTEREST

 

Councillor Malone declared an interest in the item of business at Article II(c) of this minute by virtue of knowing an objector to the application, took no part in the proceedings and withdrew from the meeting during its consideration.

 

II PLANNING APPLICATIONS

 

(a) 23-00204-FULL - CHANGE OF USE TO SHORT-TERM LET - 26 THORTER ROW, DUNDEE - FOR MR ALAN FRENDO-CUMBO

 

The Committee acceded to requests for a deputation to address the Committee relative to objections to the application, by Adrian Stewart, City Centre and Harbour Community Council, and Ashley OBrien, Managing Estates Ltd, which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

The Committee also acceded to a request for a deputation to address the Committee in support of the application by Alan Frendo-Cumbo. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Bailie Roberts, moved approval of the application, subject to the conditions recommended by the Head of Planning and Economic Development.

 

As an amendment, Councillor McHugh, seconded by Councillor Cruickshank, moved refusal of the application, on the grounds that the application is contrary to Policy 30(e) of National Planning Framework 4 as the proposed short-term let would have an unacceptable impact on the amenity of the area and would result in the loss of residential accommodation where such loss is not outweighed by demonstrable economic benefits. There are no material considerations of sufficient weight to justify approval of the application.

 

On a division, there voted for the motion - the Convener, Depute Lord Provost Cordell, Bailies Roberts and Sawers and Councillors Hunter, Rome, Tolland, Scullin, Coleman and Crichton (10); and for the amendment - Bailies Keenan, Wright, Macpherson and Scott and Councillors Anderson, Lynn, Cruickshank, Finnegan, McHugh, Malone and Duncan (11) - Councillors El-Nakla and Shears taking no part in the vote due to losing connection during the proceedings - whereupon the amendment was carried and the application was refused.

 

(b) 23-00232-FULM - APPLICATION UNDER SECTION 42 OF THE TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997 (AS AMENDED) TO GRANT PERMISSION SUBJECT TO CONDITIONS DIFFERING FROM 10, 11, 12, 13 AND 14 TO 22-00775-FULM - LAND TO SOUTH OF JACK MARTIN WAY, CLAVERHOUSE EAST INDUSTRIAL ESTATE, DUNDEE - FOR SCOTTISH HYDRO ELECTRIC TRANSMISSION PLC

 

The Committee approved the application, subject to the conditions recommended by the Head of Planning and Economic Development.

 

(c) 23-00314-FULL - ERECTION OF TWO STOREY DWELLINGHOUSE WITH FLUE - LAND TO WEST OF BOWLING GREEN, ADELAIDE PLACE, DUNDEE - FOR MR SEAN DAVEY

 

The Committee acceded to a request for a deputation to address the Committee relative to objections to the application, by Timothy Evans, which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

The Committee also acceded to a request for a deputation to address the Committee in support of the application by Sean Davey. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.
