I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2023

 

On a reference to Article III of the minute of meeting of the City Development Committee held on 5th December, 2022, wherein it was agreed to instruct and authorise the preparation of an Order to alter parking restrictions to promote road safety, prevent obstruction and remove/alter loading facilities for businesses. There was submitted Agenda Note AN30-2023 reporting that the proposed Order was duly drafted and during the statutory consultation period no objections were received.

 

The Order was duly advertised and four objections were received.

 

The Committee agreed to make the order despite the objections.

 

III TREE PRESERVATION ORDER - GARDEN GROUND TO WEST OF 13B RICHMOND TERRACE, DUNDEE

 

There was submitted Agenda Note AN31-2023 reporting that on 22nd June, 2023, the Council made a Tree Preservation Order (TPO) on garden ground to the west of 13B Richmond Terrace, Dundee. The site was located within the West End Suburbs Conservation Area. The TPO was served to protect and preserve the arboreal amenity of the area.

 

It was reported that objections were received and that the Head of Democratic and Legal Services and Executive Director of City Development would now undertake the necessary procedures and confirm the above Tree Preservation Order.

 

The Committee noted the position.

 

IV DEVELOPMENT PLAN SCHEME 2023

 

There was submitted Report No 253-2023 by the Executive Director of City Development, setting out the 2023 Development Plan Scheme for the preparation of the Dundee Local Development Plan.

 

The Committee agreed:-

 

(i) to approve the Development Plan Scheme 2023 as set out in Appendix 2 of the report;

 

(ii) to remit the Head of Planning and Economic Development to publish and implement the Development Plan Scheme 2023 and to send two copies to Scottish Government and place copies in public libraries in Dundee; and

 

(iii) to remit the Head of Planning and Economic Development to undertake an annual public consultation in respect of the Participation Statement.

 

V RETAIL STUDY 2023

 

There was submitted Report No 252-2023 by the Executive Director of City Development, providing an overview of the key outcome from the Review of Retailing in Dundee 2023 which was attached as Appendix 1 of the report. The review was conducted by external consultants Roderick MacLean Associates, and Ryden to gain an up-to-date understanding of the retail landscape within the Citys network of centres and to form part of the evidence gathering stage of the review of the Local Development Plan.

 

The Committee agreed:-

 

(i) to note the key outcomes of the retail review and their implications for the Citys network of centres and the next Local Development Plan; and

 

(ii) to approve the Retail Study 2023 as a material planning consideration.

 

VI SUSTAINABLE TRANSPORT DELIVERY PLAN

 

There was submitted Report No 265-2023 by the Executive Director of City Development, seeking approval of the draft Sustainable Transport Delivery Plan, that set out an ambitious 10-year programme of infrastructure projects targeted to improve sustainable transport in the City and support the regions transition to net zero transport.

 

The Committee agreed:-

 

(i) to approve the draft Sustainable Transport Delivery Plan attached as Appendix 1 of the report;

 

(ii) to delegate the Head of Sustainable Transport and Roads to carry out a consultation on the draft Plan with key stakeholders and to finalise with changes as appropriate; and

 

(iii) to delegate the Head of Sustainable Transport and Roads to pursue external funding available to enable progression of the projects identified in the plan.

 

VII DISABLED PERSONS PARKING PLACES ANNUAL REVIEW

 

There was submitted Report No 254-2023 by the Executive Director of City Development on the requests for disabled parking bays which required to be added or removed from the Dundee City Council (Disabled Persons Parking Places) (On-street) Order 2011. 

 

The Committee approved the preparation of a Traffic Regulation Variation Order to affect the changes to the on-street disabled parking bay provision in the relevant Traffic Regulation Order for Dundee.

 

VIII PAVEMENT PARKING EXEMPTION ORDER

 

There was submitted Report No 255-2023 by the Executive Director of City Development seeking approval for the preparation and making of an Exemption Order to exempt roads from the forthcoming national footway parking prohibition. 

 

The Committee agreed:-

 

(i) to approve the preparation of an Exemption Order under Section 52 of the Transport (Scotland) Act 2019 to exempt the roads listed in paragraph 5.2 of this report, with the exception of Fleming Gardens East, Fleming Gardens West, Fleming Gardens North and Wedderburn Street as previously intimated to members, from the forthcoming national footway parking prohibition and to thereafter publish the proposed Order in accordance with the Pavement Parking Prohibition (Exemption Orders Procedure) (Scotland) Regulations 2022; 

 

(ii) to approve the making of the Exemption Order in the event that no representations were received by the Council in response to the publication of the proposals, or representations were received but were subsequently withdrawn; and

 

(iii) to approve the preparation of a Traffic Regulation Variation Order to affect changes to the waiting restrictions in the relevant Traffic Regulation Order for Dundee. 

 

IX TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY

 

There was submitted Report No 250-2023 by the Executive Director of City Development, detailing tenders received and requesting decisions thereon.

 

(a) PERTH ROAD DISTRICT ENVIRONMENTAL IMPROVEMENTS 

 

The Committee agreed to accept the tender with the highest score for cost and quality from TN Gilmartin in the sum of 131,678.18, together with allowances of 60,321.82, giving a total expenditure of 192,000.

 

(b) BROUGHTY FERRY MONIFIETH ACTIVE TRAVEL AREA 1C CASTLE GREEN AND MILL STREET SHARED CYCLEWAY AND FOOTWAY INCLUDING CASTLE LANE/ESPLANADE JUNCTION IMPROVEMENT

 

The Committee agreed to accept the tender from Tayside Contracts in the sum of 1,005,139.11, together with allowances of 250,000, giving a total expenditure of 1,255,139.11.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

X SALE OF LAND AND BUILDINGS

 

There was submitted Report No 251-2023 by the Executive Director of City Development seeking approval for the sale of land and buildings.

 

The Committee agreed to the sale on the terms and conditions outlined in the report.
