I DECLARATIONS OF INTEREST

 

Councillor Malone declared an interest in Article II(a) by virtue of his employment at Abertay University.

 

Councillor El-Nakla declared an interest in Article II(b) by virtue of knowing the applicant.

 

II PLANNING APPLICATIONS

 

(a) 23-00133-FULL - CHANGE OF USE TO MIXED USE SPACE FOR TRAINING, EDUCATION, CONFERENCES, BUSINESS AND MEDIA EVENTS AND FUNCTIONS AND ASSOCIATED ALTERATIONS - 10 WATERS EDGE, CAMPERDOWN STREET, DUNDEE - FOR CHROMA DEVELOPMENTS LTD

 

The Committee acceded to requests for a deputation to address the Committee in support of the application, by Robert Evans of Rydens and Chris van der Kuyl of Chroma Ventures, which was recommended for approval. After the deputation had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Councillor Flynn, moved approval of the application, subject to the conditions recommended by the Head of Planning and Economic Development.

 

As an amendment, Bailie Macpherson, seconded by Councillor Alexander, moved approval of the application, subject to the conditions recommended by the Head of Planning and Economic Development, and subject to Conditions 2 and 3 respectively being deleted on the grounds that there was sufficient mitigation in the form of sound proofing and controls on hours of operation and controls on the use of external areas; because the premises already has planning permission for a restaurant and bar; and because there are several other premises in the surrounding area that had less planning restrictions in terms of number of patrons or hours of operation.

 

On a division, there voted for the motion - the Convener, Bailies Keenan and Wright and Councillors Flynn, Tolland, McIrvine and Shears (7); and for the amendment - Depute Lord Provost Cordell, Bailies Roberts, Sawers, Macpherson and Scott and Councillors Alexander, El-Nakla, Hunter, Lynn, Rome, Cruickshank, Finnegan, Scullin, Coleman, Crichton and Duncan (16) - Councillor Malone taking no part in discussions - whereupon the amendment was carried and the application was approved, subject to Conditions 2 and 3 respectively being deleted on the grounds that there was sufficient mitigation in the form of sound proofing and controls on hours of operation and controls on the use of external areas; because the premises already has planning permission for a restaurant and bar; and because there are several other premises in the surrounding area that had less planning restrictions in terms of number of patrons or hours of operation.

 

(b) CHANGE OF USE TO SHORT-TERM LET - 26 THORTER ROW, DUNDEE - FOR MR ALAN FRENDO-CUMBO

 

The Committee acceded to requests for a deputation to address the Committee relative to objections to the application by Adrian Stewart and Sheena Wellington, City Centre and Harbour Community Council which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, the Committee acceded to a request for a deputation to address the Committee in support of the application by Alan Frendo-Cumbo. The deputation was unable to join the meeting therefore it was agreed that the application be deferred in order that the deputation be given an opportunity to be heard by the Committee.

 

(c) 22-00491-FULL - PLANNING PERMISSION FOR ERECTION OF BUILDINGS FOR USE AS SHORT-TERM LET ACCOMMODATION AND AS DOMESTIC STORAGE - 10B WEST GROVE AVENUE, DUNDEE - FOR MR ANDREW BRUNTON

 

It was reported that a request had been received for a deputation to address the Committee from Andrew Brunton, Brunton Design Studio, in support of the application. Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Head of Planning and Economic Development and, in the circumstances, declined to hear the deputation.

 

(d) 23-00183-FULL - OUTBUILDING TO THE REAR OF GARDEN GROUND OF A DWELLINGHOUSE - WHITELAWSTON DRIVE, LIFF, DUNDEE - FOR MR M ISHRAQ

 

The Committee acceded to a request for a deputation to address the Committee relative to objections to the application by Calum Murray, Paul and Traci Lowden-Stoole and Steven Beattie which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew, noting that due to connectivity issues Steven Beattie agreed to withdraw his deputation request.

 

Councillor Shears moved deferral of the application in order that further details of sun movement be provided, but failed to find a seconder, whereupon the motion fell.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Head of Planning and Economic Development.
