The minute of meeting of this Licensing Board of 21st March, 2002 was held as read.
I LICENSING (SCOTLAND) ACT 1986
(a) SECTION 32 HEARINGS
Reference was made to the minute of meeting of the Licensing Board of 21st March, 2002, wherein it was agreed that Section 32 Hearings be held in respect of the following premises:-

In respect of Huxters, the Board, having heard from an officer of the Environmental and Consumer Protection Department and an agent on behalf of the licence-holder, agreed that no action be taken but that monitoring of the premises by the Environmental and Consumer Protection Department should continue.
In respect of The Central Bar (Ground Floor), the Board, having heard from an officer of the Environmental and Consumer Protection Department, an agent for the licence-holder and the licence-holder agreed that a closure order be served on the licence-holder for that part of the premises.
In respect of The Central Bar (First Floor), the Board, after having been advised that the licence-holder had not received proper notification of a Hearing for this part of the premises, agreed that consideration be deferred to a future meeting.

In the case of Application No 1, the Board, after having heard an agent on behalf of the applicant, and the advice of the legal officer, agreed that the applications for renewal of licence and renewal of Sunday Opening and Children's Certificate be refused.
There being no objections, the Board agreed that the remaining applications be granted.

In the case of Application No 1, it was noted that the applicant was not present and having heard an officer from the Environmental and Consumer Protection Department and a representative of the Chief Constable, the Board agreed that the application be refused.
In the case of Application No 2, the Board after having heard an agent on behalf of the applicant, agreed that the application be refused.
