The minute of meeting of this Committee of 16th December, 2003 was held as read.

I MARCHBANK CIVIC AMENITY SITE - PHASE 1 - TENDERS RECEIVED

 

There was submitted Report No 61-2003 by the Director of Planning and Transportation and the City Engineer giving details of offers received for the construction of a new civic amenity site at Marchbanks.

 

The Committee agreed to accept the lowest offer by D A Kennedy Construction Limited amounting to 176,496.32 to which required to be added allowances of 28,503.68 and 20,000 for fees, making a total expenditure of 225,000.00.

 

The Committee noted that D A Kennedy Limited had listed the undernoted sub-contractors:-

 

G & B Roadmarkings

King Contractors (Perth) Limited

Alpha Fencing

Bandry Builders Limited

Dundee Plant Co Limited

 

II SECTION 18 HEALTH AND SAFETY AT WORK ETC ACT 1974 - HEALTH AND SAFETY COMMISSION - GUIDANCE TO LOCALAUTHORITIES

 

There was submitted Report No 896-2002 by the acting Director of Environmental and Consumer Protection on revised mandatory Section 18 Guidance issued by the Health and Safety Commission to local authorities who were responsible for enforcement in defined commercial premises. This Guidance had been developed following advice from the Health and Safety Executive and the Local Authority Enforcement Liaison Committee. The revised guidance would replace all previous guidance made under Section 18.

 

The Committee agreed:-

 

(i) that the mandatory Section 18 Guidance issued by the Health and Safety Commission be adopted; and

 

(ii) that the acting Director of Environmental and Consumer Protection be remitted to determine and implement the means by which compliance in terms of staff and resources could be attained to enable the Council to meet its statutory health and safety enforcement obligations.

The Committee resolved under Section 50 (A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted item of business on the grounds that this would involve the likely disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 7A to the above Act.

 

III CIVIC GOVERNMENT (SCOTLAND) ACT 1982 -SECTION 87(1) - BUILDINGS IN NEED OF REPAIR

 

There was submitted Agenda Note AN43-2003 reporting that notices had been served on owners of various properties requiring works to be carried out.

 

The Committee agreed that the acting Director of Environmental and Consumer Protection be authorised to carry out the works should the owners not comply within the time allowed in the notices.
