I SCOTTISH PLANNING POLICY 8 - TOWN CENTRES AND RETAILING

 

There was submitted Agenda Note AN296-2006, making reference to Article I of the minute of meeting of this Committee of 12th December, wherein the Committee approved the City Council's response to the Scottish Executive's consultation on Draft Scottish Planning Policy 8: Town Centres (SPP8) and agreed to forward it to the Executive for its consideration. It was reported that having assessed the consultation responses received, the Executive had made certain revisions and had published the final version of the guidance. This now constituted the national policy framework for town centres and retailing and would require to be taken into account in development plan preparation and in the determination of relevant planning applications.

 

The Committee noted the revisions to the guidance.

 

II HOUSES IN MULTIPLE OCCUPATION - SUPPLEMENTARY PLANNING GUIDANCE

 

This item was withdrawn.

 

III WINTER MAINTENANCE POLICY AND LEVEL OF SERVICE 2006/07

 

There was submitted Report No 502-2006 by the Director of Planning and Transportation seeking approval for the proposed winter maintenance policy and level of service for winter 2006/2007.

 

Committee approved the policy and level of service for winter 2006/2007 as outlined in the report.

 

IV REVIEW OF CAR PARKING CHARGES

 

There was submitted Report No 440-2006 by the Director of Planning and Transportation considering whether there was any need to increase parking charges up to April 2008 and advising of a proposal to introduce charging in Ferguson Street Car Park.

 

The Convener, seconded by Councillor Macpherson, moved that no increases in parking charges on street, or in the off street car parks be made prior to April 2008, and that consideration of the proposal to introduce charging in Ferguson Street Car Park be deferred.

 

As an amendment, Councillor Fitzpatrick, seconded by Councillor Fordyce moved that consideration of the proposal to introduce charging in Ferguson Street Car Park be deferred, and that the proposal that no increases in parking charges be made prior to April 2008 be not approved.

 

On a division, there voted for the motion - the Convener, Lord Provost Letford, Bailies Farquhar, Powrie and Mackie, Councillors Shimi, Keenan, Sturrock, Hind, Morrow, Macpherson, Wallace, Webster and Scott (14); and for the amendment - Councillors Don, Duncan, Beattie, Andrew Dawson, Fitzpatrick, Roberts, Barrie, Will Dawson and Fordyce (9); Bailie Borthwick declining to vote - whereupon the motion was declared carried.

VI NEW ROADS

 

(a) APPLICATION FOR ROAD CONSTRUCTION CONSENT

 

There was submitted Agenda Note AN298-2006 detailing the undernoted applications for road construction consent. The Committee approved the applications subject to conditions which had been agreed with the applicants:-

(b) LIST OF PUBLIC ROADS

 

It was further agreed that, on satisfactory completion of these roads, and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

VII VACANT AND DERELICT LAND FUND, FORMER LAWSIDE WORKS, MILTON STREET - GRANT

 

There was submitted Agenda Note AN299-2006, making reference to Article VII of the minute of meeting of this Committee of 17th April, 2006, wherein the Committee approved the draft programme of works proposed under the Vacant and Derelict Land Fund for 2006-2008.

 

Reference was also made to Article I of the minute of meeting of the Development Quality Committee of 23rd January, 2006, wherein planning permission was granted for residential redevelopment of the site of the former Lawside Works, Milton Street, which was on the vacant and Derelict Land Register.

 

It was reported that the site was large and required substantial investment to retain and reuse the existing fabric of the Listed Buildings and other original buildings that were to be retained on the site. In addition to these exceptional costs, due to the history of the site and the potential contaminated land the developer would have to undertake contamination mitigation works.

 

The tender cost obtained by the developer for the demolition, facade retention and works to refurbish the Listed Buildings was 285,900. The tender cost for the mitigation works to deal with the contaminated land and abnormal ground conditions on the site was 52,900.

 

It was therefore agreed that a 50% grant towards these abnormal costs of 169,400 be made from the Vacant and Derelict Land Fund, to be payable when demolition works were completed, work on the facade retention and Listed Building refurbishment undertaken and development work on the new houses/flats started, all of which required to be completed before March 2007.

Further reference was made to Article VI of the minute of the meeting of this Committee of 13th March, 2006 regarding late substitute projects for 2005/2006. It was reported at that time that a further 50,000 was required to undertake the works to the site at Baldovie Industrial Estate. It was reported that the correct amount approved by the Scottish Executive for this additional work was 150,000 and that this was consistent with the amount actually incurred for works on this site.

 

The Committee noted accordingly.

 

VIII CONVERSION OF ROADS TO FOOTPATH (PATERSON STREET, DUNDEE) ORDER 2006

 

There was submitted Agenda Note AN300-2006, making reference to Article V of the minute of meeting of this Committee of 17th April, 2006, wherein it was agreed to convert part of Paterson Street into a footpath in order to limit pollutants and assist in creating a safer environment for pedestrians in this residential area.

 

It was reported that the Order was duly prepared and advertised in the Dundee Courier and Advertiser and the Edinburgh Gazette, and the relevant statutory undertakers consulted. No objections had been received.

 

The Committee therefore agreed to authorise and confirm this Order, and authorise formal publication of the confirmation, after which the Order would become operative.
