I DRAFT REGULATIONS ON DEVELOPMENT PLAN EXAMINATIONS - CONSULTATION PAPER

 

There was submitted Report No 126-2008 by the Director of Planning and Transportation advising the Committee of the comments to be forwarded to the Scottish Government on the Draft Regulations on Development Plan Examinations.

 

The Committee agreed to note and endorse the comments of the Director of Planning and Transportation, prepared for submission to the Scottish Government as the City Council's response to the Draft Regulations on Development Plan Examinations.

 

II NATIONAL PLANNING FRAMEWORK FOR SCOTLAND 2 - DISCUSSION DRAFT

 

There was submitted Agenda Note AN39-2008 advising that the Scottish Government had published "The National Planning Framework for Scotland 2" for discussion in January 2008.

 

The Committee noted that NPF2 recognised the main strategic issues facing Dundee and remitted to the Director of Planning and Transportation to submit comments to the Scottish Government generally welcoming the direction of NPF2 and providing comments on the detailed aspects of the document.

 

III SCOTTISH PLANNING POLICY SPP3 - PLANNING FOR HOUSING - CONSULTATIVE DRAFT

 

There was submitted Report No 111-2008 by the Director of Planning and Transportation advising the Committee of the comments to be forwarded to the Scottish Government on the Consultative Draft of Scottish Planning Policy SPP3 - Planning for Housing.

 

The Committee agreed to note and endorse the comments of the Director of Planning and Transportation, prepared for submission to the Scottish Government as the City Council's response to the Consultative Draft of Scottish Planning Policy SPP3 - Planning for Housing.

 

IV LOCHEE CONSERVATION AREA - DESIGNATION

 

There was submitted Report No 107-2008 by the Director of Planning and Transportation seeking approval for the designation of Lochee Conservation Area and authority to consult on the Conservation Area Character Appraisal.

 

The Committee agreed to:-

 

(a) approve the proposed draft Lochee Conservation Area for consultation purposes based on the boundary outlined in the attached Conservation Area Character Appraisal document; and

 

(b) remit the Director of Planning and Transportation to consult with the local community and interested parties on the terms of the Conservation Area Character Appraisal document and to report back with the results within three months.

 

V DOWNFIELD PRIMARY SCHOOL - SITE PLANNING BRIEF

 

There was submitted Report No 103-2008 by the Director of Planning and Transportation advising the Committee of the findings of the public consultation on the Draft Downfield Primary School Site Planning Brief and seeking approval of the Finalised Brief.

 

The Committee agreed to:-

 

(a) note the findings from the public consultation;

 

(b) approve the Downfield Primary School Site Planning Brief as supplementary planning guidance to the Dundee Local Plan Review 2005 to direct the future development of the site; and

 

(c) refer the final Site Planning Brief to the Development Quality Committee as a relevant material planning consideration.

 

VI MOSSGIEL PRIMARY SCHOOL - SITE PLANNING BRIEF

 

There was submitted Report No 105-2008 by the Director of Planning and Transportation advising the Committee of the findings of the public consultation on the Draft Mossgiel Primary School Site Planning Brief and seeking approval of the Finalised Brief.

 

The Committee agreed to:-

 

(a) note the findings from the public consultation;

 

(b) approve the Mossgiel Primary School Site Planning Brief as supplementary planning guidance to the Dundee Local Plan Review 2005 to direct the future development of the site; and

 

(c) refer the final Site Planning Brief to the Development Quality Committee as a relevant material planning consideration.

 

VII DRAFT ERSKINE STREET YARD SITE PLANNING BRIEF

 

There was submitted Report No 66-2008 by the Director of Planning and Transportation seeking approval of a Draft Site Planning Brief in respect of the above site, in order to proceed to consultation with adjacent owners and interested parties.

 

The Committee agreed to:-

 

(a) approve the Draft Site Planning Brief for the purposes of consultation;

 

(b) remit the Director of Planning and Transportation to consult with adjacent owners and interested parties on the content of the Draft Site Planning Brief; and

 

(c) remit the Director of Planning and Transportation to report back on the results of the consultation.

 

VIII DRAFT FORMER DENS METALS SITE PLANNING BRIEF

 

There was submitted Report No 67-2008 by the Director of Planning and Transportation seeking approval of a Draft Site Planning Brief in respect of the above site in order to proceed to consultation with adjacent owners and interested parties.

 

The Committee agreed to:-

 

(a) approve the Draft Site Planning Brief for the purposes of consultation;

 

(b) remit the Director of Planning and Transportation to consult with adjacent owners and interested parties on the content of the Draft Site Planning Brief; and

 

(c) remit the Director of Planning and Transportation to report back on the results of the consultation.

 

IX COMPULSORY PURCHASE ORDER OF DERELICT BUILDING AND LAND AT 3 KEMBACK STREET,STOBSWELL

 

There was submitted Report No 110-2008 by the Director of Planning and Transportation seeking authority to promote a Compulsory Purchase Order in respect of a derelict building and land at 3 Kemback Street, Stobswell to secure the redevelopment of a vacant and derelict building within the Stobswell Regeneration Area as an integral part of the redevelopment of the adjacent Tay Spinners site.

 

The Committee authorised the Depute Chief Executive (Support Services) to promote a Compulsory Purchase Order to acquire the building and land at 3 Kemback Street to allow the comprehensive redevelopment of this building and land and the adjacent Tay Spinners site in accordance with the approved Planning Application.

 

X THE FINALISED FIFE STRUCTURE PLAN 2006/2026 - HOUSING LAND REQUIREMENT RE-APPRAISAL

 

On a reference to Article V of the minute of meeting of this Committee of 22nd October, 2007, there was submitted Agenda Note AN40-2008 advising that Fife Council had approved the proposed modifications to the Finalised Fife Structure Plan (2006) arising from the re-appraisal of the Housing Land Requirement and submitted these to Scottish Ministers on 27th December, 2007.

 

It was reported that the proposed modifications did not fully address the City Council's previous concerns and that the Director of Planning and Transportation had therefore forwarded objections to Scottish Ministers.

 

The Committee noted accordingly.

 

XI CONFIRMATION TO TREE PRESERVATION ORDER - LAND TO THE SOUTH OF RIVERSIDE AVENUE

 

There was submitted Agenda Note AN41-2008 advising the Committee that in October 2007, the Council received a request to severely prune trees at the above location. The trees in question screened several industrial units and greatly enhanced the visual amenity of this approach road into the City.

 

It was reported that on 12th November, 2007, the Council had made a provisional Tree Preservation Order on the site in order to protect and preserve the arboreal amenity of the area.

 

It was further reported that an objection was received from a party who disputed the value of the trees contained within group 4. The Council's Forestry Officer had reconsidered his decision to include these trees in the said Tree Preservation Order and recommended this group be deleted.

 

The Committee authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures and confirm the above Tree Preservation Order with this modification.

 

XII NEW ROADS

 

There was submitted Agenda Note AN48-2008 detailing the undernoted application for road construction consent:-

The Committee approved the application subject to conditions agreed with the applicant and further agreed that, on satisfactory completion of these roads and, if so requested by the applicant, it be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.
