(g) SCHEME OF DELEGATION - AMENDMENT

 

It was recommended that the Scheme of Delegation be amended to include consideration of full applications for Private Hire Driver, Street Trader, Taxi Driver and Window Cleaners where there were no objections and all necessary documentation (insurance, medicals etc) were in place. These types of application were invariably granted by the Committee without any discussion. The delegation would save some Committee time and would allow all applications to be dealt with and identification badges issued between meetings.

 

Should an applicant have satisfied all requirements within 21 days of lodging the application, a temporary licence could be applied for at a cost of 20 to cover the period up to the 21st day, following which, the full licence would be granted. It was recommended that consideration of this also be delegated to the Clerk in consultation with the Convener.

 

The Committee agreed to the amendments to the Scheme of Delegation as indicated.

(o) HOUSES IN MULTIPLE OCCUPATION - REQUESTS FOR VARIATION

 

There were submitted the undernoted requests for variation:-

In the case of Request Nos 1 to 4, there being no objections, the Committee agreed that the requests for variation be granted.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

(i) There was submitted an application by Mr Z O for a Houses in Multiple Occupation Licence.

 

The Committee, having heard the Legal Officer, agreed that consideration of the application be deferred to a future meeting of the Committee.

 

(ii) There was submitted an application by Mr W R for a Houses in Multiple Occupation Licence.

 

The Committee, having heard the Legal Officer, agreed that consideration of the application be deferred to a future meeting of the Committee.

 

(iii) There was submitted an application by Mr W R for a Houses in Multiple Occupation Licence.

 

The Committee, having heard the Legal Officer, agreed that consideration of the application be deferred to a future meeting of the Committee.

 

(b) TAXI DRIVER'S LICENCE - RECALL OF SUSPENSION

 

There was submitted an application by Mr S B for recall of the suspension of his Taxi Driver's Licence.

 

The Committee, having given consideration to the advice of the Legal Officer and having heard the agent on behalf of the applicant, the applicant on their own behalf, and consideration of the letter of support which had been submitted on behalf of the applicant, agreed to the recall of the suspension with immediate effect.

 

(c) WINDOW CLEANER'S LICENCE - RENEWAL

 

Bailie Roderick A J Wallace declared a non-financial interest in this item of business by virtue of the actions taken in a professional capacity by a relative and left the Chamber during its consideration.

 

There was submitted an application by Mr A M for renewal of his Window Cleaner's Licence.

 

The Committee noted that this application had been deferred from the Licensing Committee of 17th February, 2008 to allow the outcome of a trial.

 

The Committee noted that the applicant was not present and agreed that the application be considered in their absence.

 

Thereafter, having given consideration to the advice of the Legal Officer and the Clerk, and consideration of the original letter of objection and having heard a representative of Tayside Police, the Committee agreed that the application be refused.
