I DUNDEE CITY REGION STRATEGIC DEVELOPMENT PLAN AUTHORITY

 

There was submitted Report No 274-2008 by the Director of Planning and Transportation reporting the proceedings of the meeting of the Interim Joint Committee of the Dundee City Region Strategic Development Plan Authority which was held on 26th March, 2008.

 

The Committee agreed:-

 

(a) to endorse the remit of the Interim Joint Committee;

 

(b) to an allocation of up to 50,000 from the existing Planning and Transport Budget to cover initial costs of establishing the Strategic Development Plan Authority; and

 

(c) to approve the draft documents required for the formally constituted Joint Committee included in Appendix II of the report.

 

II SCOTTISH ROAD SAFETY STRATEGY CONSULTATION DOCUMENT

 

There was submitted Report No 264-2008 by the Director of Planning and Transportation outlining the purpose, content and proposals contained within the Scottish Government's 'Scottish Road Safety Strategy' and Dundee City Council's response.

 

The Committee agreed to note the purpose, content and proposals contained within the consultation and endorse Dundee City Council's response contained within Appendix 1 to the report.

 

III CYCLING, WALKING AND SAFER STREETS (CWSS) PROJECTS COMMENCING 2008/2009

 

There was submitted Report No 286-2008 by the Director of Planning and Transportation seeking approval for a programme of works for the year 2008/2009 funded from additional grant capital ring fenced by the Scottish Government for Cycling, Walking and Safer Streets (CWSS) projects.

 

The Committee approved the proposed programme of works for the year 2008/2009, as detailed in the report.

 

IV RECLASSIFICATION OF ROADS - NORTH EAST CORRIDOR

 

There was submitted Report No 266-2008 by the Director of Planning and Transportation, reviewing the classification of roads in the North-east corridor.

 

The Committee approved the proposed reclassifications shown in Appendix 1 to the report and remitted to the Director of Planning and Transportation to apply to the Scottish Government for ratification of these proposals.

 

V STREET LIGHTING PARTNERSHIP

 

There was submitted Report No 261-2008 by the Director of Planning and Transportation, providing an update on progress and performance of the Street Lighting Partnership with Tayside Contracts on the delivery of the Street Lighting Services to 31st March, 2008.

 

The Committee noted the content of the report and agreed that the Director of Planning and Transportation be remitted to report back annually to the Committee with the ongoing progress of the Partnership.

 

VI GELLATLY STREET ROAD RECONSTRUCTION

 

There was submitted Agenda Note AN98-2008 advising the Committee that in view of the limited timescales available, the Depute Chief Executive (Support Services) and the City Engineer, after consultation with the Convener and Spokespersons of the other Groups, had accepted an offer from Tayside Contracts through the Roads Maintenance Partnership to carry out road reconstruction works at Gellatly Street as part of the Central Waterfront Development. The contract amount was for 332,755.97 which, together with allowances of 40,000 for public utilities, 35,000 for CDM Co‑ordinator and professional services and 27,244.03 for contingencies, made a total expenditure of 435,000.

 

The Committee noted accordingly.

 

VII GELLATLY STREET CAR PARK

 

There was submitted Agenda Note AN99-2008, advising that in August, the Holiday Inn Express would be opening in Dock Street adjacent to the Gellatly Street Car Park. There would be a link between the two and agreement had been reached between the parties to issue overnight permits to people registered in the hotel to allow them to park their vehicles in the car park.

 

The charge would be 5 for any time between 2pm on one day and noon the following day. It was proposed to vary the Off-Street Car Parks Order to include the necessary amendment in the Order.

 

The Committee approved this proposal.

 

VIII CAR PARKING

 

There was submitted Report No 253-2008 by the Director of Planning and Transportation considering the necessity to prepare a Traffic Regulation Order to control parking in Tayside House car park, other off-street car parks and on street.

 

The Committee agreed:-

 

(a) to approve the preparation of a Traffic Regulation Order to control the use of the Tayside House Car Park to permit holders only;

 

(b) to note that anyone parking their car in Tayside House Car Park without a permit or in any other Council off-street car park in contravention of the Dundee City Council (Off‑Street Car Parks) Order 1996 or on a road illegally would be liable to be issued with a Fixed Penalty Notice and to have their vehicle clamped;

 

(c) that anyone parking their car in Tayside House Car Park without a permit or in any other Council off-street car park in contravention of the Dundee City Council (Off‑Street Car Parks) Order 1996 or on a road illegally would be liable to have it removed in terms of Sections 35(b)(iv) and 99 of the Road Traffic Regulation Act 1984 and that the 1996 Order should be varied accordingly; and

 

(d) to approve the advertising and making of the Order in the event that there are no objections.

 

IX CONFIRMATION OF TREE PRESERVATION ORDER 03/2008 - GROUND AT 76 GROVE ROAD, DUNDEE

 

There was submitted Agenda Note AN101-2008, advising that on 21st March, 2008, the Council made a provisional Tree Preservation Order on the abovementioned site, in response to a planning application that was refused for alterations and an extension to the nursing home. The Council considered that the trees merited protection due to their arboreal and visual amenity. One objection to the Tree Preservation Order had been received from James Paul Associates, on behalf of the owners of the nursing home.

 

The Committee noted the terms of the objection and the response of the Council's Forestry Officer and Engineer thereto, and authorised the Depute Chief Executive (Support Services) and the Director of Planning and Transportation to undertake the necessary procedures to confirm the above Tree Preservation Order.

 

X HORSEWATER WYND/HAWKHILL FOOTPATHS - STOPPING-UP

 

There was submitted Report No 252-2008 by the Director of Planning and Transportation considering the necessity to stop-up lengths of footpath between Horsewater Wynd and Hawkhill utilising the powers of the Town and Country Planning (Scotland) Act 1997.

 

The Committee approved the preparation of a Stopping-Up Order to stop-up lengths of footpaths between Horsewater Wynd and Hawkhill to accommodate a new development following planning consent.

 

XI DUNDEE AREA WAITING RESTRICTIONS VARIATION

 

There was submitted Report No 278-2008 by the Director of Planning and Transportation considering all the requests during the last year for additions and alterations to waiting restrictions throughout the City.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to affect the changes to the waiting restrictions in the relevant Traffic Regulation Orders for Dundee, as detailed in the report.

 

XII TRAFFIC ORDERS ETC

 

There was submitted Agenda Note AN97-2008 relative to the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (20 MPH SPEED LIMITS AROUND SCHOOLS) (VARIATION) (NO 2) ORDER 2008

 

Reference was made to Article IX of the minute of meeting of this Committee of 26th January, 2004, wherein the Committee authorised the preparation of an Order to create a safer environment around schools that would encourage children to walk and cycle to school.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

The Committee therefore authorised formal publication of the Order as drafted.

 

(b) DUNDEE CITY COUNCIL (TOM McDONALD AVENUE AND KIRSTY SEMPLE WAY, DUNDEE) (BUS ONLY FACILITIES) ORDER 2008

 

Reference was made to Article V of the minute of meeting of this Committee of 12th November, 2007, wherein the Committee authorised the preparation of an Order to create a bus facility whilst still protecting access for emergency vehicles to the Accident and Emergency Unit at Ninewells Hospital.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received. Comments were received from the Chief Constable who agreed with the proposals in principle but had also noted his concerns.

 

Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(c) DUNDEE CITY COUNCIL (CITY QUAY AREA) (VARIATION OF WAITING RESTRICTIONS) ORDER 2008

 

Reference was made to Article IV of the minute of meeting of this Committee of 12th November, 2007, wherein the Committee authorised the preparation of an Order to relieve congestion by controlling parking to safe areas, to restrict the length of stay in the available parking spaces to deter commuter parking, to provide an opportunity for visitor parking to residents and to the Frigate Unicorn, and to give the residents the opportunity to purchase a residents' parking permit for the pay and display spaces.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(d) DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) ORDER 2008

 

Reference was made to Article III of the minute of meeting of this Committee of 22nd October, 2007, wherein the Committee authorised the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

It was reported that the proposed Order was duly drafted and during the statutory consultation period, no adverse comments were received.

 

The Order was duly advertised and eight objections were received. After consultation with some of the objectors, the Director of Planning and Transportation had recommended that the proposed restrictions in Yeamans Alley were no longer required and should be deleted from the Order.

 

The Committee noted that four other single objections had been received for Magdalen Yard Road, Hyndford Street, Ramsay Street and Camphill Road and that following consultation with these objectors, the Director of Planning and Transportation recommended that the Order be confirmed without any further amendment.

 

The Committee agreed to make the Order subject to the amendment in relation to Yeamans Alley.
