The Committee agreed:-

 

(i) that, from 1 April 2003, the above fees be approved, and

 

(ii) that, in addition there be levied a surcharge of 35 on Taxi Licence Renewal Fees to cover the cost of the recent Taxi Survey.

In the case of applications 1-11, there being no objections the Committee agreed that the applications be granted.

 

In the case of applications Nos. 12 and 14 to 20 the Committee noted that these applications had been withdrawn from consideration by the applicants.

 

In the case of application No. 13 the Committee after noting that the applicant had failed to pass the street knowledge test within the prescribed period agreed that the application be refused.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted items of business on the grounds that this would involve the disclosure of exempt information as defined in paragraphs 3, 6, 9 and 14 of Part 1 of Schedule 7A to the above Act.

V CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

Councillor Fiona Grant declared an interest in applications (a)(i) to (a)(iv) and took no part in the discussion thereafter.

 

(a) HOUSES IN MULTIPLE OCCUPATION NEW APPLICATIONS

 

(i) There was submitted an application by S G P to licence a house in Union Street for multiple occupation.

 

The Committee gave consideration to a letter of objection which had been submitted by the Private Sector Grants Unit relative to this application.

 

Thereafter having heard a representative on behalf of the applicants, the Committee agreed that the application be refused.

 

(ii) There was submitted an application by S G P to licence a house in Union Street for multiple occupation.

 

The Committee gave consideration to a letter of objection which had been submitted by the Private Sector Grants Unit relative to this application.

 

Thereafter having heard a representative on behalf of the applicants, the Committee agreed that the application be refused.

 

(iii) There was submitted an application by S G P to licence a house in Garland Place for multiple occupation.

 

The Committee gave consideration to a letter of objection which had been submitted by the Private Sector Grants Unit relative to this application.

 

Thereafter having heard a representative on behalf of the applicants, the Committee agreed that the application be refused.

 

(iv) There was submitted an application by S G P to licence a house in Garland Place for multiple occupation.

 

The Committee gave consideration to a letter of objection which had been submitted by the Private Sector Grants Unit relative to this application.

 

Thereafter having heard a representative on behalf of the applicants, the Committee agreed that the application be refused.

 

(b) TAXI DRIVER'S LICENCE - NEW APPLICATIONS

 

(i) There was submitted an application by Mr J G for a Taxi Driver's Licence.

 

The Committee gave consideration to a letter of representation which had been submitted by the Chief Constable relative to this application. Part of the representation referred to convictions which were spent in terms of the Rehabilitation of Offenders Act and after hearing the Chief Constable's representative as to their age and nature, the Committee agreed that they be considered since justice could not otherwise be done.

 

Therafter, having heard the applicant on his own behalf and consideration of a letter of support which had been tabled by the applicant, the Committee agreed that the application be granted with a warning.

 

(ii) There was submitted an application by Mr D M for a Taxi Driver's Licence.

 

The Committee gave consideration to a letter of the representation which had been submitted by the Chief Constable relative to this application. Thereafter, having heard the applicant on his own behalf and the representative of Tayside Police, the Committee agreed that the application be granted.

 

(iii) There was submitted an application by Mr D G M for a Taxi Driver's Licence.

 

The Committee gave consideration to the letter of objection which had been submitted by the Chief Constable relative to this application. Part of the objection referred to convictions which were spent in terms of the Rehabilitation of Offenders Act and after hearing the Chief Constable's representative as to their age and nature, the Committee agreed that they be considered since justice could not otherwise be done.

 

Thereafter, having heard the applicant on his own behalf, the Committee agreed that the application be granted.

 

(iv) On a reference to Article IV(e) of the minute of meeting of 26th September, 2002 it was reported that this matter be referred back to the Committee by the Sheriff for consideration, thereafter there was submitted an application by Mr J T for a Taxi Driver's Licence.

 

The Committee gave consideration to a letter of representation which had been submitted by the Chief Constable relative to this application.

 

Thereafter, having heard the applicant on his own behalf, the Committee agreed that the application be granted.

 

(c) WINDOW CLEANER'S LICENCE - NEW APPLICATION

 

On a reference to Article III(c)(i) of Minute of Meeting of 6th March 2003 there was submitted an application by Mr D B for a Window Cleaner's Licence.

 

The Committee, after noting that the applicant was not present agreed that the application be considered in their absence and that the application be refused.
