In the case of applications nos 7, 8 9 and 10 the Committee noted that the applicants had failed to pass the Street Knowledge Test within the prescribed period and agreed that the applications be refused.
There being no objections, the Committee agreed that the remaining applications be granted.
The Committee resolved, under Section 50(A)(4) of the Local Government (Scotland) Act 1973, that the public be excluded from the meeting for the undernoted items of business on the grounds that it would involve the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part 1 of Schedule 7A to the above Act.
IV CIVIC GOVERNMENT (SCOTLAND) ACT, 1982
(a) TAXI DRIVER'S LICENCE - NEW APPLICATION
There was submitted an application by Mr. W.D. for a Taxi Driver's Licence.
The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application. Part of the representation referred to convictions which were spent in terms of the Rehabilitation of Offenders Act and after hearing the Chief Constable's representative as to their age and nature, the Committee agreed they be considered since justice could not otherwise be done.
Thereafter, having heard the applicant on his own behalf agreed that the application be granted.
(b) SUSPENSION HEARINGS - TAXI DRIVERS
There was submitted a letter of complaint by the Chief Constable relative to the conduct of Mr B.S. during the currency of his Taxi Driver's Licence.
After being informed that the licence holder was not present, the Committee agreed that the Taxi Driver's Licence held by Mr. B.S. be suspended for the unexpired portion of its duration.
There were submitted letters of complaint by the Chief Constable relative to the conduct of Mr. B.W. during the currency of his Taxi Driver's Licence.
After being informed that the licence holder was not present the Committee agreed to defer consideration of this item to a future meeting.
(c) TAXI LICENCE AND TAXI DRIVER'S LICENCE - RENEWAL
There was submitted letters of complaint by the Chief Constable relative to the applications for renewal of taxi driver's licence and taxi operator's licence by Mr R M.
The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application. Part of the representation referred to convictions which were spent in terms of the Rehabilitation of Offenders Act and, after hearing the Chief Constable's representative as to their age and nature, the Committee agreed that they be considered since justice could not otherwise be done.
Thereafter, having heard an agent on behalf of the applicant, the Committee agreed that the applications be granted.
The Convener agreed that the undernoted item be considered as a matter of urgency in terms of Standing Order No 52(3)(b) in view of the timescales involved.
(d) taxi driver's licence
There was tabled a letter of request by an agent on behalf of the widow of Mr J H seeking approval that she be allowed to continue to hold the licence held by her late husband until she had completed the administration of the estate.
After consideration of the letter, the Committee agreed that the widow of Mr J H be granted a three month extension of the period allowed in terms of paragraph 8(3) of Schedule 1 of the Civic Government (Scotland) Act 1982.
