The minute of meeting of this Committee of 2nd July, 2009 was held as read.

 

Unless marked thus * all items stand delegated.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

I CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI DRIVER'S LICENCE - SUSPENSION HEARINGS

 

(i) There was submitted a letter of complaint from the Chief Constable relative to the alleged conduct of Mr D A during the currency of his Taxi Driver's Licence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of Tayside Police, the licence holder on his own behalf and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence with immediate effect until the meeting of the Committee to be held in October 2009 to allow the outcome of court proceedings to be established.

 

(ii) There was submitted a letter of complaint from the Chief Constable relative to the alleged conduct of Mr J D during the currency of his Taxi Driver's Licence. The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of Tayside Police and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence until the meeting of the Committee to be held in October 2009.

 

(iii) There was submitted a letter of complaint from the Chief Constable relative to the alleged conduct of Mr K S during the currency of his Taxi Driver's Licence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of Tayside Police, the licence holder on his own behalf and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence with immediate effect until the meeting of the Committee to be held in October 2009.

 

(iv) There was submitted a letter of information from the Occupational Health and Safety Advisory Service in relation to the fitness of Mr H O'S to be the holder of a Taxi Driver's Licence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard the Clerk, the licence holder on his own behalf, a representative on behalf of the licence holder and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence with immediate effect.

 

(b) TAXI DRIVER'S LICENCE AND TAXI OPERATOR'S LICENCE - REQUEST FOR HEARINGS

 

It was reported that complaints had been received from bus companies about 31 taxi drivers/taxi operators who had been witnessed illegally parking in the bus bay at the rear of the Nethergate rank.

 

The Committee, having heard the Clerk, agreed that the Clerk issue warnings to the 31 taxi drivers/taxi operators who had been reported. The Committee further agreed to the adoption of a procedure in relation to the processing of future complaints of a similar nature and that, in the first instance, the Clerk be authorised to issue warning letters to individuals who had been reported to the Licensing Department. Should any individual be reported on a second occasion, the matter would be reported to a meeting of the Licensing Sub-Committee for decision.
