The minute of meeting of this Committee of 21st January, 2013 was held as read.

I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II PLANNING APPLICATIONS

 

12-00794-FULL - 11 DEEPDALE PLACE, BROUGHTY FERRY, DUNDEE - CHANGE OF USE FROM PRIVATE DWELLINGHOUSE TO RESIDENCE FOR DEPENDANT YOUNG ADULT CARE

 

The Committee acceded to requests which had been received for deputations to address the Committee both in support of and relative to objections to the above application.

 

After the deputations had stated their cases, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Councillor Dawson, moved approval of the application subject to the conditions recommended by the Director of City Development.

 

As an amendment, Councillor Bidwell, seconded by Councillor Guild, moved refusal of the application on the grounds that:-

 

(i) the proposed development fails to provide adequate appropriate car parking relative to the needs of occupants, visitors and support staff to the detriment of the amenity of adjoining residents and of road safety in the area. It therefore contravenes Policy 10 (Non-Mainstream Residential Uses) of the Dundee Local Plan Review 2005 and Policy 13 (Residential Accommodation for Particular Needs) of the Proposed Dundee Local Development Plan. There are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan;

(ii) the proposed development to change the use of a private dwelling to residence for dependent young adult care, would result in increased noise impact on surrounding neighbours which would adversely affect the environmental quality they enjoy; and

 

(iii) the proposed development fails to provide appropriate amenity space in a private location. It therefore contravenes Policy 10 (Non-Mainstream Residential Uses) of the Dundee Local Plan Review 2005 and Policy 13 (Residential Accommodation for Particular Needs) of the Proposed Dundee Local Development Plan. There are no material considerations of sufficient strength to justify the granting of planning permission contrary to the Development Plan.

 

On a division, there voted for the motion - the Convener, Bailies Sawers, Wright and Borthwick and Councillors Alexander, Black, Dawson, Lynn, Melville, Ross, Keenan, Brennan, Cruickshank, Ferguson and McCready (15); and for the amendment - Depute Lord Provost Roberts, Bailie Scott and Councillors Guild, Campbell, Cordell, McDonald, Asif, Bidwell and Macpherson (9) - whereupon the motion was declared carried.

 

III PLANNING APPEAL DECISION - LAND TO SOUTH OF 36 PEDDIE STREET, DUNDEE - NEW BUILD LOCAL AREA HOUSING OFFICE WITHINGROUNDS OF EXISTING DWELLING

 

There was submitted Agenda Note AN17-2013, making reference to Article II(a) of the minute of meeting of this Committee of 13th August, 2012, wherein the above proposal was refused planning permission because the Council considered that:-

 

(i) the application was contrary to Policy 1 (Vibrant and Sustainable Communities) of the Dundee Local Plan Review by virtue of the proposed design and layout which would be likely to result in an unacceptable degree of overlooking, loss of sunlight/daylight, a detrimental effect upon the outlook enjoyed by the existing dwelling and by virtue of the isolated position in which the development is proposed. There were no material considerations to justify a decision contrary to this;

 

(ii) the application was contrary to Policy 1 (Vibrant and Sustainable Communities) of the Dundee Local Plan Review 2005 as the proposal would lead to an increase in demand for on-street parking in the vicinity of the site where there is existing congestion. This would be to the detriment of the existing residential occupiers and be detrimental to the road safety of the area. There were no material considerations to justify a decision contrary to this; and

 

(iii) the application failed to comply with Policy 15 (Development in Garden Ground) of the Dundee Local Plan Review in relation to criteria (a) Design, (c) Amount of buildings/hard standings on site and criteria (e) No new building in front of the main elevation. These breaches would be to the detriment of the existing dwelling and surrounding area. There were no material considerations to justify a decision contrary to this.

 

It was reported that the decision was subsequently appealed by the applicant under the provisions of Section 47 and Schedule 4 of the Town and Country Planning (Scotland) Act 1997 and had been dismissed.

 

IV DELEGATED ITEMS

 

There was submitted Agenda Note AN18-2013, advising that from 22nd December, 2012 to 21st January, 2013, 27 applications were decided under delegated powers. Three of these applications attracted objections and all three were approved.

 

The Committee noted accordingly.
