Dundee City Licensing Board - 13/06/2013

At a MEETING of the DUNDEE CITY LICENSING BOARD held at Dundee on 13th June, 2013.

Present:-

I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board agreed to grant the above application.

The Board, having heard from an agent on behalf of the applicant, an objector and the Boards Legal Adviser, and taken into account letters of objection, agreed to refuse the above application. A request for a Statement of Reasons was agreed to.

Councillor Cruickshank declared a non-financial interest by virtue of having personal knowledge of the applicants family, withdrew from the Chamber and took no part in the debate.

The Board, having heard from the Chief Constables representative, an objector, the applicant on their own behalf, and taken into account letters of objection, agreed to refuse the above application.

(b) VARIATIONS (MAJOR)

Variation to remove the current local conditions in relation to musical entertainment consent and replace with the following:- TV, automatic music system, live bands (maximum four artistes), vocalists, karaoke, DJ, all during core hours Monday to Sunday. To vary the on consumption hours on Sunday to 11.00 am to 12 midnight and the off consumption hours on Sunday to 11.00 am to 10.00 pm; to allow club/other group meetings, live performances, gaming and indoor sports during core hours; to allow recorded music to be played outwith core hours and to allow televised sport to be shown outwith core hours.

The Board agreed to defer the above application.

Variation to increase capacity to 800.

The Board agreed to a variation to amend layout plan to increase capacity from 4.6m2 to 20.03m2 and to a name change to Princes Street Convenience Store.

The Board, having heard from the applicant on their own behalf, agreed to grant a variation to amend the local conditions for musical entertainment, TV, automatic music system, disco, DJ, karaoke (all during core hours), live music before on consumption hours for sound check purposes and live music during core hours. Change of name from "The Doghouse" to "20 Rocks", amendment from midnight closing to 2.30 am, subject to imposition of the minimum charge condition, remove conference facilities, amend club or other groups to outwith core hours (club meetings), live performance outwith core hours (rehearsals), theatre during and outwith core hours (rehearsals), televised sport outwith core hours (special sporting events outwith core hours) and all under 18's from the licence completely.

(a) BETTING (OTHER) - FULL GRANT

The Board agreed to grant the above application.

III PREMISES LICENCE UPDATE

(a) NO 57, 57-58 DOCK STREET, DUNDEE

The Board, having noted the licence holder was not present, agreed to defer the update.

IV REVIEW HEARING - PERSONAL LICENCE

(a) THOMAS A HARKIN

Councillor Georgia Cruickshank declared a non-financial interest by virtue of having personal knowledge of the applicants family, withdrew from the Chamber and took no part in the debate.

The Board, having heard from the Chief Constables representative and the licence holder on their own behalf, agreed to revoke the licence.

V REVIEW HEARING - PREMISES LICENCE

(a) NON-ZEROS, CASTLE STREET, DUNDEE

The Board, having heard from an agent on behalf of the licensee, the licence holder, an officer from the Environment Department and the Boards Legal Adviser, held the grounds for review to have been established and thereafter agreed to defer the review hearing for three months.

VI REQUEST FOR REVIEW HEARINGS - PREMISES LICENCES

The Board agreed to premises review hearings in respect of the Victoria Bar, 4Js and The Social.
