The minute of meeting of this Committee of 13th May, 2013 was held as read.

 

Unless marked thus * all items stand delegated.

 

I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II PLANNING APPLICATIONS

 

Lord Provost Duncan and Councillor Gordon declared a non-financial interest in Item II(f) by virtue of their membership of the Board of Leisure and Culture Dundee.

 

(a) 13-00254-FULL - 19 ARCHER STREET, BROUGHTY FERRY - FORMATION OF DRIVEWAY - FOR MR M McGUIGAN

 

The Committee acceded to requests for deputations to address the Committee both in support of and relative to objections to the above application. After the deputations had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

(b) 13-00260-FULL - 21 ARCHER STREET, BROUGHTY FERRY - FORMATION OF DRIVEWAY - FOR MR J INGLIS

 

The Committee acceded to requests for deputations to address the Committee both in support of and relative to objections to the above application. After the deputations had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

(c) 13-00234-FULL - CYPRESS COTTAGE, ARBROATH ROAD, BROUGHTY FERRY - CHANGE OF USE OF OPEN SPACE TO PRIVATE GARDEN GROUND FOR IAN AND PAMELA OSBORNE

 

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

(d) 13-00261-FULL - ROCKWELL HIGH SCHOOL, LAWTON ROAD - ERECTION OF TEMPORARY CLASSROOM ACCOMMODATION - FOR DIRECTOR OF EDUCATION

 

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

(e) 13-00233-FULL - FORTHILL PRIMARY SCHOOL, FINTRY PLACE, BROUGHTY FERRY - ERECTION OF MODULAR BUILDING - FOR DIRECTOR OF EDUCATION

 

The Committee approved the application.

 

(f) 13-00289-FULL - CAIRD PARK GOLF CLUB, CAIRD PARK, MAINS LOAN - SITING OF A MODULAR BUILDING TO REPLACE THE EXISTING STARTERS HUT AND FORM A NEW PRO SHOP - FOR DIRECTOR OF LEISURE AND COMMUNITIES

 

After considering objections received, the Committee approved the application, subject to the conditions recommended by the Director of City Development.

 

III PLANNING APPEAL DECISIONS

 

There was submitted Agenda Note AN72-2013 detailing the undernoted planning appeal decisions:-

 

(a) 6 BATH STREET, BROUGHTY FERRY, DUNDEE

RETROSPECTIVE EXTENSION OF CELLAR

 

Reference was made to Article II(a) of the minute of meeting of this Committee of 17th December, 2012, wherein the above proposal was refused planning permission contrary to the Director's recommendation because the Council considered that:-

 

"By virtue of design and finish, the extension adversely impacts on the setting of the C Listed Building and the character of the surrounding Broughty Ferry Conservation Area. The proposals are therefore contrary to the requirements of Policies 60 (Alterations to Listed Buildings) and 61 (Development in Conservation Areas) of the Dundee Local Plan Review 2005. There are no material considerations that would justify approval of planning permission in this instance."

 

It was reported that the decision was subsequently appealed by the applicant, and that the Reporter had allowed the appeal and granted planning permission.

 

(b) 6 BATH STREET, BROUGHTY FERRY, DUNDEE

RETROSPECTIVE EXTENSION OF CELLAR (LISTED BUILDING CONSENT)

 

Reference was made to Article II(b) of the minute of meeting of this Committee of 17th December, 2012, wherein the above proposal was refused Listed Building Consent contrary to the Director's recommendation because the Council considered that:-

 

"By virtue of design and finish, the extension adversely impacts on the setting of the C Listed Building. The proposals are therefore contrary to the requirements of Policy 60 (Alterations to Listed Buildings) of the Dundee Local Plan Review 2005. There are no material considerations that would justify approval of Listed Building Consent in this instance."

 

It was reported that the decision was subsequently appealed by the applicant and that the Reporter had allowed the appeal and granted Listed Building Consent.

 

IV DELEGATED ITEMS

 

There was submitted Agenda Note AN73-2013, advising that from 22nd April to 21st May, 2013, 65 applications had been decided under delegated powers. Six of these applications attracted objections and, of these, three were approved and three were refused.

 

The Committee noted accordingly.
