I DECLARATION OF INTEREST

 

Councillor Hunter declared an interest in Article V by virtue of having a child at Balgarthno Primary School.

 

II SITE PLANNING BRIEF - QUEEN VICTORIA WORKS AND REGENT WORKS SITE

 

There was submitted Report No 309-2013 by the Director of City Development seeking approval of the above-mentioned Site Planning Brief following consultation with adjacent owners and other interested parties.

 

The Committee agreed to:-

 

(a) note the findings of the public consultation;

 

(b) approve the Queen Victoria Works and Regent Works Site Planning Brief and supplementary planning guidance to inform future development of the site; and

 

(c) refer the approved Site Planning Brief to the Development Management Committee as a material planning consideration.

 

III DUNDEE COASTAL FLOOD STUDY STAGE 2

 

There was submitted Report No 256-2013 by the Director of City Development advising the Committee of the completion of the Dundee Coastal Flood Study Stage 2, and seeking approval for the City Engineer to progress those physical measures recommended within the study for implementation as funding becomes available.

 

The Committee agreed to:-

 

(a) note the findings of the completed Dundee Coastal Study Stage 2; and

 

(b) authorise the City Engineer to progress prioritised flood measures for inclusion in the Local Flood Risk Management Plan to such detail as may be required to support an application to Scottish Government for grant funding.

 

IV TREE PRESERVATION ORDER - LAND AT STOBSMUIR, FORFAR ROAD, DUNDEE

 

There was submitted Agenda Note AN84-2013 advising the Committee that on 1st May, 2013, the Council had made a Tree Preservation Order on the above-mentioned site in order to preserve and protect the arboreal amenity of the area and provide enhanced protection from future development.

 

It was reported that no objections had been received, and the Committee therefore authorised the Head of Democratic and Legal Services and Director of City Development to undertake the necessary procedures to confirm the Tree Preservation Order.

 

V BALGARTHNO PRIMARY SCHOOL (VARIATION TO TRAFFIC REGULATIONS) ORDER 2013

 

There was submitted Report No 308-2013 by the Director of City Development regarding the necessity to extend an existing 20mph zone on various roads in close proximity to Balgarthno Primary School in Charleston, and the requirement to remove a school 'Keep Clear' marking on Craigowan Road which was no longer required.

 

The Committee approved:-

 

(a) the preparation of the necessary Traffic Regulation Order which would extend the existing 20mph zone on various lengths of Invercraig Place, Charleston Road, Craigowan Road and Craigard Road within the Charleston area of Dundee; and

 

(b) the preparation of the necessary Traffic Regulation Order which would delete Craigowan Road from the existing Dundee City Council (School Keep Clear Areas) Order 2007.

 

VI TRAFFIC ORDERS

 

There was submitted Agenda Note AN85-2013 relative to the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (DOCK STREET AREA, DUNDEE) (VARIATION OF TRAFFIC REGULATIONS) ORDER 2013

 

Reference was made to Article V of the minute of meeting of this Committee of 29th October, 2012, wherein the Committee authorised the preparation of an Order to allow for the Waterfront Masterplan to be implemented facilitating the next stage of the redevelopment of Dundee Central Waterfront

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received. Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(b) DUNDEE CITY COUNCIL (DUNDEE ROAD, BROUGHTY FERRY AND GOURDIE BRAE TO DYKES OF GRAY LINK ROAD (VARIATION TO SPEED RESTRICTIONS) ORDER 2013

 

Reference was made to Article VI of the minute of meeting of this Committee of 28th January, 2013, wherein the Committee authorised the preparation of an Order to increase safety on the highlighted lengths of carriageway and to decrease the potential for any accidents.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received. Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(c) DUNDEE CITY COUNCIL (GRAHAM STREET, DUNDEE) (WAITING VARIATIONS) ORDER 2013

 

Reference was made to Article III of the minute of meeting of this Committee of 25th February, 2013, wherein the Committee authorised the preparation of an Order to protect the junctions of St Michaels Yard and Graham Wynd due to a new housing development on the site of what was formerly Dundee College (Graham Street Centre).

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received. Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(d) DUNDEE CITY COUNCIL (SOUTH WARD ROAD/ARGYLLGAIT, DUNDEE) (VARIATION) ORDER 2013

 

Reference was made to Article IV of the minute of meeting of this Committee of 25th February, 2013, wherein the Committee authorised the preparation of an Order to avoid confusion caused by multiple legs of carriageway under the same name and to offer a unique address to any potential future development in the area.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received. Thereafter, the Order was duly advertised and there were no objections.

 

The Committee therefore agreed to make the Order as advertised.

 

(e) DUNDEE CITY COUNCIL (BUCKLEMAKER COURT AND BUTTERBURN COURT, HILLTOWN, DUNDEE) (STOPPING-UP OF ROADS, FOOTPATHS AND FOOTWAYS) ORDER 2013

 

Reference was made to Article IV of the minute of meeting of this Committee of 25th February, 2013, wherein the Committee authorised the stopping-up of areas of roads, footpaths and footways at Bucklemaker Court and Butterburn Court, Hilltown, Dundee.

It was reported that the Order was duly prepared and advertised in the Evening Telegraph and the Edinburgh Gazette, and the relevant statutory undertakers were consulted. No objections were received.

 

The Committee therefore agreed to authorise and confirm the Stopping-Up Order, and authorise formal publication of the confirmation, after which the Order would become operative.

 

(f) DUNDEE CITY COUNCIL (EAST WHALE LANE, DUNDEE) (VARIATION OF TRAFFIC REGULATIONS) ORDER 2013

 

Reference was made to Article IX of the minute of meeting of this Committee of 22nd April, 2013, wherein the Committee authorised the prepared of an Order to allow for the effective traffic management of a road which would access and service the new Olympia Leisure Centre and Olympia Multi-Storey Car Park development.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore agreed to authorise publication of the Order as drafted.

 

VII CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - PROPOSED STREET NAMES CONCLUSION OF CONSULTATION TO RENAME CROSS ROW TO NABLUSPLACE

 

There was submitted Agenda Note AN92-2013 advising that a proposal to rename Cross Row, which lies within the Dundee University Campus, to Nablus Place had been submitted by the Dundee University Action Palestine Society (DUAPS).

 

In accordance with the Civic Government (Scotland) Act 1982, the proposal was advertised in the local press on 3rd May, 2013, and an objection had been received on the grounds of losing an established street name with a long history.

 

West End Community Council had also submitted an objection to the proposal on the grounds that there were existing addresses from Cross Row, including the University Chaplaincy, and while WECC accept that the name Cross Row has no religious significance it is felt that it would be inappropriate to name this street Nablus Place.

 

Support for the proposal was received from the Dundee Nablus Twinning Association (DNTA) stating that the request is consistent with the precedent set by the Council when it named Orleans Place and Wurzburg Court and it would be an appropriate way to recognise over 32 years of twinning.

 

No other objections were received and no comment was received from Dundee University.

 

As the objections were seen as valid and received within the consultation period, Committee agreed not to approve the renaming of Cross Row to Nablus Place.

 

However, the proposal to name a street in recognition of the Nablus Twinning had been widely welcomed during the consultation and an opportunity to utilise the Nablus street name proposal had arisen in the West End where there is a link road between Tom McDonald Avenue and Mariner Drive which currently has no official street name. The Committee agreed to put this proposal out for consultation and subsequently report the result of this consultation to Committee for a formal decision.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

There was submitted Report No 311-2013 by the Director of City Development detailing commercial leases in respect of the undernoted properties:-

The Committee noted and approved accordingly.

 

IX RENT REVIEWS

 

There was submitted Report No 312-2013 by the Director of City Development detailing rent reviews in respect of the undernoted properties:-

22-24 Dryburgh Street, Dundee

6 Crichton Street, Dundee

 

The Committee approved accordingly.

 

X PROPOSED DISPOSAL OF FORMER PRIMARY SCHOOL

 

There was submitted Report No 313-2013 by the Director of City Development, seeking the Committees approval for the disposal of the former Eastern Primary School, Broughty Ferry, Dundee.

 

The Committee approved the proposed disposal of the former school building and grounds on the terms and conditions detailed in the report.

 

XI OUT OF SCHOOL CLUB, FORTHILL PRIMARY SCHOOL

 

There was submitted Agenda Note AN36-2013, making reference to Article XIII of this Committee of 22nd April, 2013, wherein the Committee approved the acquisition and installation of a modular classroom for use by the Out of School Club at Forthill Primary School, subject to planning consent and a satisfactory leasing arrangement being entered into with the Out of School Club.

 

It was reported that terms had been agreed with the Trustees of Forthill Out of School Club in respect of the Lease and that these had been approved by the Director of City Development in view of the timescales involved in consultation with the Convener, Labour Group Spokesperson, Bailie Borthwick, Bailie Scott and Councillor Macpherson.

 

The Committee noted the Lease on the terms and conditions details in the note.
