III DUNDEE CITY COUNCIL (10E LISMORE TERRACE, MILL OMAINS) COMPULSORY PURCHASE ORDER 2013
On a reference to Article XIII of the minute of meeting of the City Development Committee of 20th May, 2013, the Council agreed to make and enact the above Order, a copy of which is appended hereto.
IV APPOINTMENT - DESIGN DUNDEE LTD
The Council approved the re-appointment of the Chief Executive.
The Council resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 7A of the Act.
V APPOINTMENTS - LEISURE AND CULTURE DUNDEE BOARD
It was reported that there were two vacancies on the Board of Trustees of Leisure and Culture Dundee for charity trustees who were neither elected members nor officials of the Council (Independent Charity Trustees).
Following consideration of expressions of interest, the Nominations Committee of Leisure and Culture Dundee agreed, at its meeting on 3rd October, 2013, to recommend to the Council the appointment of the following individuals as Independent Charity Trustees:-

The Council approved accordingly.

THE ACQUISITION OF LAND (AUTHORISATION PROCEDURE) (SCOTLAND) ACT 1947
DUNDEE CITY COUNCIL (10E LISMORE TERRACE, MILL O'MAINS, DUNDEE)
COMPULSORY PURCHASE ORDER 2013
DUNDEE CITY COUNCIL (hereinafter referred to as "the acquiring authority") in exercise of the powers conferred by Sections 9 and 10 of the Housing (Scotland) Act, 1987 hereby make the following compulsory purchase order:-

This Order may be cited as the Dundee City Council (10E Lismore Terrace, Mill O'Mains, Dundee) Compulsory Purchase Order 2013.

Subject to the provisions of this Order, the acquiring authority are hereby authorised to purchase compulsorily for the purpose of the erection of houses by persons other than the local authority and for the use for purposes necessary, desirable for or incidental to the development as a building estate, the land which is described in the Schedule hereto and forms part of the subjects delineated and partly coloured red, partly coloured green and hatched black and partly coloured yellow and hatched black on the map signed with reference to this Order and marked "Map referred to in the Dundee City Council (10E Lismore Terrace, Mill O'Mains, Dundee) Compulsory Purchase Order 2013".

In relation to the foregoing purchase Section 70 of the Railways Clauses Consolidation (Scotland) Act 1845 and Sections 71 to 78 of that Act as originally enacted and not as amended for certain purposes by Section 15 of the Mines (Working Facilities and Support) Act 1923 are hereby incorporated with the enactment under which the said purchase is authorised, subject to the modifications that references in the said sections to the company shall be construed as references to the acquiring authority and references to the railway or works shall be construed as references to the land authorised to be purchased and any buildings or works constructed or to be constructed thereon.

The registration of a conveyance, as defined in Section 106(5) of the Title Conditions (Scotland) Act 2003, in implement of this Order shall not extinguish the real burdens or servitudes affecting the land described in the Schedule hereto.
