II CASES SUB-COMMITTEE - MINUTES OF MEETINGS

The minutes of meetings of the Cases Sub-Committee held on 18th November, 2013 and 20th March, 2014 were submitted and noted for information and record purposes, copies of which are attached to this minute as Appendices I and II.

III SOCIAL CARE (SELF-DIRECTED SUPPORT) (SCOTLAND) ACT 2013

Reference was made to Article III of the minute of the meeting of the Social Work and Health Committee held on 23rd September, 2013, wherein the response on the then draft Regulations and Guidance issued by the Scottish Government to support the Social Care (Self-Directed Support) (Scotland) Act 2013 was noted.

There was submitted Report No 222-2014 by the Director of Social Work providing information about the finalised regulations and guidance accompanying the Social Care (Self-Directed Support) (Scotland) Act 2013 as well as the Social Work Departments arrangements to support the introduction of the 2013 Act which came in force on 1st April, 2014.

The Committee agreed:-

(i) to note the content of the finalised regulations which accompanied the Social Care (Self-Directed Support) (Scotland) Act 2013 as set out in Section 4 of the report;

(ii) to note the content of and approve the Social Work Departments implementation arrangements to support the Social Care (Self-Directed Support) (Scotland) Act 2013; and

(iii) to instruct the Director of Social Work to provide information to Committee on any changes in the policy required as a consequence of the experience of implementation of the Act, including the impact on carers.

IV STANDARD CHARGES FOR LOCAL AUTHORITY RESIDENTIAL UNITS 2014/2015

There was submitted Report No 221-2014 by the Director of Social Work recommending the level of standard charge to be applied in 2014/2015 for local authority residential accommodation for adults and older people.

The Committee agreed the standard charges for local authority residential accommodation as laid out in Appendix 1 of the report.

V SCOTTISH GOVERNMENT CARER'S LEGISLATION - CONSULTATION ON PROPOSALS

There was submitted Report No 216-2014 by the Director of Social Work providing information about the Social Work Department Officers response to Scottish Government Carers Legislation - Consultation on Proposals.

The Committee agreed:-

(i) to approve the recently submitted Social Work Department Officers response to the Scottish Governments Carers Legislation - consultation on Proposals, as appended to the report; and

(ii) to instruct the Director of Social Work to provide information to Committee on any subsequent implications arising from the outcome of Scottish Government consultation.
