I DECLARATION OF INTEREST

 

Councillor Asif declared a non-financial interest in the item of business at Article IV(ix) by virtue of the agent for the applicant being known to him in a personal capacity.

 

Councillors Alexander and Brennan declared non-financial interests in item of business at Article V(i) by virtue of the licence holder being known to them in a personal capacity and withdrew from the Chamber during its consideration.

 

Councillor Brennan declared a non-financial interest in item of business at Article VI(c) by virtue of the applicant being known to her in a personal capacity and withdrew from the Chamber during its consideration.

The minutes of meetings of the Licensing Sub-Committee held on 27th August, 4th September, 8th September and 10th September, 2014 were submitted for information and record purposes, copies of which are attached to this minute as Appendices I, II, III and IV.

In the case of Application No 1, reference was made to Article III(b) of the minute of meeting of this Committee held on 4th September, 2014, wherein the Committee agreed to defer consideration of the application to allow the applicant to be present.

 

There was submitted an application by Mr Rashid Ismail for a Late Hours Catering Licence.

 

The Committee noted that the application was to allow for hours of operation until 1.00 am on Mondays to Wednesdays and 11 pm to 4 am Fridays to Sundays and that this was outwith the current policy on late hours catering. The Committee noted that the Unique Tax Reference Number had now been submitted. Thereafter, having heard the applicant on their own behalf and consideration of the advice of the Legal Officer, and noting that the hours of operation would be 11 pm to 3.30 am Fridays to Sundays as corrected by the applicant, the Committee agreed that the application be granted, subject to compliance with the policy on late hours catering.

In the case of Application No 2, there was submitted an application by Khans, Dundee Ltd for a Late Hours Catering Licence.

 

The Committee noted that the applicant was not present and agreed that the matter be considered in their absence.

 

The Committee noted that the application was to allow for hours of operation until 1.00 am on Fridays and Saturdays and 11 pm to 12 midnight Sundays to Thursdays. Thereafter, having heard a representative of the Environmental Health Department and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted, subject to the satisfactory inspection of the premises by the Environmental Health Department.

 

(c) SKIN PIERCING AND TATTOOIST LICENCE - NEW APPLICATION

In the case of Application Nos 1 to 6, having heard a representative of the Housing Department and the applicants on their own behalf, the Committee agreed that the applications be granted.

 

In the case of Application Nos 7 and 8, the Committee gave consideration to a letter of observation which had been submitted by the Private Sector Services Manager of the Housing Department relative to these applications. Thereafter, having heard from a representative of the Housing Department, an agent on behalf of the applicants and consideration of the advice of the Legal Officer, the Committee agreed that the applications be granted, subject to works being completed and certified to the satisfaction of the Housing Department.

 

In the case of Application No 9, the Committee gave consideration to a letter of objection which had been received from a member of the public relevant to this application. Thereafter, having heard the representative of the Housing Department, the objector on their own behalf, an agent on behalf of the applicant and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted and that an update be provided by the Housing Department to the Committee after a period of six months on the operation of the licence.

 

In the case of Application Nos 10 to 16, the Committee agreed that consideration of these applications be deferred to a future meeting of the Committee.

 

The Convener agreed that the undernoted item of business be considered as a matter of urgency in terms of Standing Order No 17(b) in view of the timescales involved.

 

(b) HOUSES IN MULTIPLE OCCUPATION - REQUEST FOR VARIATION

In the case of this application, having heard the representative of the Housing Department and the applicant on their own behalf, the Committee agreed that the application be granted and that an update be provided by the Housing Department to the Committee after a period of six months on the operation of the licence.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part I of Schedule 7A of the Act.

 

V ANTI-SOCIAL BEHAVIOUR (SCOTLAND) ACT 2004 - REGISTRATION OF CERTAIN LANDLORDS

 

(i) Reference was made to Article VII(i) of the minute of the meeting of this Committee held on 4th September, 2014, wherein it was agreed to take no action in relation to the registration of Ms M H. There was submitted the original memorandum from the Housing Department relevant to this matter, together with supporting documentation from an agent on behalf of the licence holder. Thereafter, having considered the advice of the Legal Officer, the Committee agreed that a fresh hearing be held at the meeting of this Committee to be held in November, 2014.

 

(ii) Reference was made to Article II(ii) of the minute of meeting of the Licensing Sub‑Committee held on 4th September, 2014, wherein it was agreed to hold a hearing in relation to the suitability of Mr G MacF to be registered as a landlord. There was submitted a letter of information from the Housing Department relevant to the registration of Mr G MacF as a landlord.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Housing Department, the Clerk and consideration of the advice of the Legal Officer, the Committee agreed that Mr G MacF be removed from the register of landlords.

 

(iii) Reference was made to Article II(iii) of the minute of meeting of the Licensing Sub‑Committee held on 4th September, 2014, wherein it was agreed to hold a hearing in relation to the suitability of Ms A MacF to be registered as a landlord. There was submitted a letter of information from the Housing Department relevant to the registration of Ms MacF as a landlord.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Housing Department, the Clerk and consideration of the advice of the Legal Officer, and having noted that the licence holder had indicated their wish to relinquish registration as a landlord, the Committee agreed that Ms A MacF be removed from the register of landlords.

 

(iv) Reference was made to Article II(i) of the minute of meeting of the Licensing Sub‑Committee held on 4th September, 2014, wherein it was agreed to hold a hearing in relation to the suitability of Mr C W to be registered as a landlord. There was submitted a letter of information from the Housing Department relevant to the registration of Mr C W as a landlord.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Housing Department, a representative on behalf of the licence holder, the Clerk, the representative of the Chief Constable and consideration of the advice of the Legal Officer, Councillor Hunter, seconded by Councillor Bowes, moved that consideration of the application not be deferred.

 

As an amendment, Councillor Asif, seconded by Councillor Brennan, moved that consideration of the matter be deferred for a period of one month.

 

On a division, there voted for the motion - Councillors Hunter, Bowes, Alexander, Black and Ferguson (5); and for the amendment - Councillors Asif and Brennan (2) - whereupon the motion was declared carried and the matter was submitted for consideration, whereupon the Committee agreed to remove Mr C W from the Register of Landlords.

 

VI CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) SECOND HAND DEALER'S LICENCE - RENEWAL APPLICATION

 

Reference was made to Article VIII(b) of the minute of meeting of this Committee held on 4th September, 2014, wherein it was agreed to defer consideration of the application submitted by Mr J A for renewal of his Taxi Drivers Licence to await the outcome of court proceedings.

 

There was submitted an application by Mr J A for renewal of his Taxi Drivers Licence.

 

The Committee gave consideration to a letter of objection which had been submitted by the Chief Constable relevant to this application. Thereafter, having heard the representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the Taxi Drivers Licence held by Mr J A be renewed and that the matter be recalled to the meeting of this Committee to be held in February, 2015 for an update on the operation of the licence.

 

(b) SKIN PIERCING AND TATTOOIST LICENCE - NEW APPLICATION

 

Reference was made to Article VII(a) of the minute of meeting of this Committee held on 5th June, 2014, wherein the Committee agreed to grant the application by Mr D F for a Skin Piercing and Tattooist Licence and to recall the matter at this meeting for an update on the operation of the licence from Police Scotland.

 

There was submitted the original letter of representation from the Chief Constable relative to this application. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to grant the application until May, 2015.

 

(c) TAXI DRIVER'S LICENCE - NEW APPLICATIONS

 

(i) There was submitted an application by Mr A M for a Taxi Drivers Licence.

 

There was submitted a letter of representation from the Chief Constable relevant to this application. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the application be granted for a period of three months, subject to the UTRN and Medical Certificate being submitted to the satisfaction of the Licensing Department and that the matter be recalled after the said period of three months for an update on the operation of the licence from Police Scotland.

 

(ii) Reference was made to VIII(c) of the minute of meeting of this Committee held on 4th September, 2014, wherein consideration of the application by Mr R U for a Taxi Drivers Licence was deferred to await the outcome of court proceedings.

 

There was submitted an application by Mr R U for a Taxi Drivers Licence.

 

There was submitted the original letter of objection from the Chief Constable relevant to this application. The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the applicant on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to further defer consideration of the application until the meeting of this Committee to be held in November, 2014 to await the outcome of court proceedings.

 

(d) TAXI DRIVER'S LICENCE - SUSPENSION HEARINGS

 

(i) Reference was made to Article ll(a) of the minute of meeting of the Licensing Sub‑Committee held on 27th August, 2014, wherein it was agreed that the Taxi Driver's Licence held by Mr L McP be suspended with immediate effect and a hearing be held in relation to the fitness of Mr L McP to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr L McP during the currency of his Taxi Drivers Licence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to recall the suspension of the Taxi Driver's Licence held by Mr L McP with immediate effect and that a fresh hearing be held at the meeting of this Committee to be held in December, 2014 and that the licence holder complete and undertake an approved Taxi Drivers Training Course within the next six months.

 

(ii) Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 10th September, 2014, wherein it was agreed that the Taxi Driver's Licence held by Mr M N be suspended with immediate effect and a hearing be held in relation to the fitness of Mr M N to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr M N during the currency of his Taxi Drivers Licence.

 

The Committee gave consideration to the content of the letter. Thereafter, having heard a representative of the Chief Constable, an agent on behalf of the licence holder and consideration of the advice of the Legal Officer, the Committee agreed to continue the suspension of the Taxi Driver's Licence held by Mr M N with immediate effect and that a fresh hearing be held at the meeting of this Committee to be held in November, 2014.

 

Councillor Asif left the Chamber prior to consideration of the undernoted item of business and did not return to the meeting.

 

(e) TAXI DRIVER'S LICENCE - SUSPENSION HEARING AND RENEWAL

 

(i) Reference was made to Article III(a)(i) of the minute of meeting of this Committee held on 28th July, 2014, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr A B during the currency of his Taxi Driver's Licence to this meeting of the Committee to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr A B during the currency of his Taxi Drivers Licence. There was also submitted a letter of objection dated 11th June, 2014 from Police Scotland to the renewal of the Taxi Drivers Licence held by Mr A B.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to adjourn the hearing until the meeting of this Committee to be held in March 2015 to await the outcome of court proceedings and to grant the renewal of the Taxi Drivers Licence.

 

(ii) Reference was made to Article III(a) of the minute of meeting of this Committee held on 28th July, 2014, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr G B during the currency of his Taxi Driver's Licence to this meeting of the Committee to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr G B during the currency of his Taxi Drivers Licence. There was also submitted a letter of objection dated 17th June, 2014 from Police Scotland to the renewal of the Taxi Drivers Licence held by Mr G B.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to take no further action and to grant the renewal of the Taxi Drivers Licence held by Mr G B for a period of three months.

 

(iii) Reference was made to Article III(c)(iii) of the minute of meeting of this Committee held on 28th July, 2014, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr R I during the currency of his Taxi Driver's Licence to this meeting of the Committee to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr R I during the currency of his Taxi Drivers Licence. There was also submitted a letter dated 8th July, 2014 from Police Scotland to the renewal of the Taxi Drivers Licence held by Mr R I.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to adjourn the hearing until the meeting of this Committee to be held on 6th November, 2014 to await the outcome of court proceedings and to grant the renewal of the Taxi Drivers Licence held by Mr R I.

 

(f) TAXI DRIVER'S/TAXI OPERATOR'S LICENCE - SUSPENSION HEARINGS

 

Reference was made to Article II(a) of the minute of meeting of the Licensing Sub‑Committee held on 8th September, 2014, wherein it was agreed that the Taxi Driver's Licence held by Mr G D be suspended with immediate effect and a hearing be held in relation to the fitness of Mr G D to be the holder of a Taxi Driver's Licence.

 

There was submitted a letter of information from the Chief Constable relevant to the conduct of Mr G D during the currency of his Taxi Drivers Licence.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard a representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed to take no further action and to issue the licence holder with a verbal warning to their future conduct.

 

(g) TAXI DRIVER'S/TAXI OPERATOR'S LICENCE - SUSPENSION HEARING AND RENEWAL

 

Reference was made to Article VIII(h) of the minute of meeting of this Committee held on 4th September, 2014, wherein it was agreed to adjourn the hearing in relation to the alleged conduct of Mr J McL during the currency of his Taxi Driver's Licence to this meeting of the Committee to await the outcome of court proceedings.

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr J McL during the currency of his Taxi Drivers Licence. There was also submitted a letter of objection dated 11th June, 2014 from Police Scotland to the renewal of the Taxi Drivers Licence held by Mr J McL.

 

The Committee noted that the licence holder was not present and agreed that the matters be considered in their absence.

 

The Committee gave consideration to the content of the letters. Thereafter, having heard a representative of the Chief Constable and consideration of the advice of the Legal Officer, the Committee agreed to adjourn the hearing until the meeting of this Committee to be held in January, 2015 to allow the licence holder to be present and to grant the renewal of the Taxi Drivers Licence held by Mr J McL.

 

(h) TAXI OPERATORS LICENCE - REQUEST FOR VARIATION

 

Reference was made to Article VIII(i)(ii) of the minute of meeting of this Committee held on 4th September, 2014, wherein it was agreed to defer consideration of the application submitted by Mr J G for variation of his Taxi Drivers Licence to allow the applicant to be present.

 

The Committee noted that the licence holder was not present and agreed that the matter be considered in their absence.

 

There was submitted an application by Mr J G for variation of his Taxi Drivers Licence.

 

The Committee gave consideration to the application and a letter of support which had been submitted by a representative on behalf of the applicant. Thereafter, having considered the advice of the Legal Officer, the Committee agreed to grant the extension of variation to the Taxi Drivers Licence held by Mr J G until 31st May, 2015.

 

(i) WINDOW CLEANERS LICENCE - RENEWAL APPLICATION

 

Reference was made to Article III(k) of the minute of meeting of this Committee held on 4th September, 2014, wherein it was agreed to defer consideration of the application submitted by Mr G A for renewal of his Window Cleaners Licence to await the outcome of court proceedings.

 

There was submitted an application by Mr G A for renewal of his Window Cleaners Licence.

 

The Committee gave consideration to a letter of representation which had been submitted by the Chief Constable relevant to this application. Thereafter, having heard the representative of the Chief Constable, the licence holder on their own behalf and consideration of the advice of the Legal Officer, the Committee agreed that the Window Cleaners Licence held by Mr G A be renewed.

There was submitted a letter of information from the Chief Constable relative to the alleged conduct of Mr L McP during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that the Taxi Driver's Licence held by Mr L McP be suspended with immediate effect and that a suspension hearing be held in due course in relation to the fitness of Mr L McP to be the holder of a Taxi Driver's Licence.

The Sub-Committee gave consideration to the content of the letter submitted by the Director of Housing. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr C W to be registered as a landlord.

 

(ii) There was submitted a letter of information from the Director of Housing relative to the alleged conduct of Mr G MacF during the currency of his registration as a landlord.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Director of Housing. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr G MacF to be registered as a landlord.

 

(iii) There was submitted a letter of information from the Director of Housing relative to the alleged conduct of Mr A MacF during the currency of his registration as a landlord.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Director of Housing. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr A MacF to be registered as a landlord.

 

(iv) There was submitted a letter of information from the Director of Housing relative to the alleged conduct of Mr C S during the currency of his registration as a landlord.

 

The Sub-Committee gave consideration to the content of the letter submitted by the Director of Housing. Thereafter, the Sub-Committee agreed that a hearing be convened in due course in relation to the fitness of Mr C S to be registered as a landlord.

 

III INDISCRIMINATE PARKING IN NETHERGATE

 

(i) There was submitted a note of information from the Licensing Department relative to the conduct of Mr A B during the currency of his Taxi Drivers Licence.

 

The Sub-Committee gave consideration to the content of the note submitted by the Licensing Department. The Sub-Committee noted that the licence holder had been observed parking indiscriminately and that he had been previously warned to stop the practice. Thereafter, the Sub‑Committee agreed that a final written warning be issued to Mr A B and to note that any further infringements would result in a request for a hearing in relation to his fitness to be the holder of a Taxi Drivers Licence.

 

(ii) There was submitted a note of information from the Licensing Department relative to the alleged conduct of Mr M M during the currency of their Taxi Drivers Licence.

 

The Sub-Committee gave consideration to the content of the note submitted by the Licensing Department. The Sub-Committee noted that the licence holder had been observed parking indiscriminately and that he had been previously warned to stop the practice and that he had also been issued with a final written warning. Thereafter, the Sub-Committee agreed Mr M M be issued with a final written warning and a hearing be held in due course in relation to the fitness of Mr M M to be the holder of a Taxi Driver's Licence.

 

The Sub-Committee agreed that the undernoted item of business be considered as a matter of urgency in terms of Standing Order No 17(b) in view of the timescales involved.

 

IV CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) TAXI DRIVER'S LICENCE - REQUEST FOR HEARING

 

There was submitted a letter of information from the Chief Constable relevant to the alleged conduct of Mr S D during the currency of his Taxi Driver's Licence.

 

The Sub-Committee gave consideration to the content of the letter. Thereafter, having heard the representative of the Chief Constable and consideration of the advice of the Legal Officer, the Sub‑Committee agreed that the Taxi Driver's Licence held by Mr S D be suspended with immediate effect and that a hearing be held in due course in relation to the fitness of Mr S D to be the holder of a Taxi Driver's Licence.

Thereafter, having heard the representative of the Chief Constable, and consideration of the advice of the Legal Officer the Sub‑Committee agreed that the Taxi Driver's Licence held by Mr G D be suspended with immediate effect and that a suspension hearing be held in due course in relation to the fitness of Mr G D to be the holder of a Taxi Driver's Licence. No action would be taken in relation to the Taxi Operator's Licence held by Mr G D during the intervening period.
