Variation to allow darts, dominoes, prize bingo and raffles.

The Board, having heard from the Chief Constables representative, the applicant on their own behalf and the Boards Legal Adviser, agreed to amend on consumption on a Friday/Saturday night from midnight to 1am as per Board policy, to permit receptions during core hours, to permit club and other group meetings during and outwith core hours, to permit recorded music to be played prior to on consumption hours, to permit live performances during core hours but no later than 12 midnight, to permit indoor sports to be played prior to on consumption, to permit televised sports to be shown prior to on consumption, to permit children and young person's entry to the lounge area for private functions and to attend the premises prior to football matches at Dens Road and Tannadice, and to add information to explain why activities are taking place outwith core hours.

 

The Board refused variations to amend question 5(f) - 'Other Activities' to explain why football supporters will be in the premises prior to on consumption and to await transport to away football matches outwith core hours.

 

A request for a Statement of Reasons was agreed to.

The Board noted that the variation to create a new external licensed area at the front of The Union to form a licensed queuing area for DUSAs largest nightclub when access is reduced to one in one out had been withdrawn.

 

Thereafter, after having heard from the applicant and the Boards Legal Adviser, the Board agreed to defer consideration of the variation to extend the footprint of the existing external licensed area to allow an additional point of access/egress via one of the fire exits from its largest nightclub pending a visit to the premises.

The Board, having heard from an agent on behalf of the applicant agreed, subject to completion of works under Building Warrant, along with necessary Section 50 approvals, to allow alcohol to be sold for consumption off the premises from 10am until 10pm Monday to Saturday. Variation to remove conference facilities, receptions, music, gaming, indoor/outdoor sport and televised sport from the operating plan.

The Board, having heard from an agent on behalf of the applicant, agreed to grant a variation to amend musical entertainment and replace with automated music playback system and TV prior to and during core hours, DJ and disco, live bands, karaoke all during core hours. Remove Local Condition 3 as the premises no longer operate as a social club in terms of Section 125 of the Licensing (Scotland) Act 2005.

 

II PREMISES LICENCE REVIEW HEARING

 

(a) DUDHOPE BOWLING CLUB, ADELAIDE PLACE

 

The Board having heard from the applicants for the review hearing, Licensing Standards Officers, an agent on behalf of the licensee, the Chief Constables representative and the licensee on their own behalf, agreed to take no further action as the grounds for review were not held to be established.

 

III MAINS CASTLE - APPLICATION FOR TRANSFER

 

The Board, having heard from an agent on behalf of the applicant and the Boards Legal Adviser, agreed to grant the application for transfer.

 

IV PERSONAL LICENCES

The Board, having heard from the Boards Legal Adviser and noted the licence holder was not present, agreed to issue a written warning.

The Board, having heard from the Boards Legal Adviser and noted the licence holder was not present, agreed to issue a written warning.

 

(iii) Saleem Shikari

 

The Board, having heard from the Boards Legal Adviser and noted the licence holder was not present, agreed to revoke the personal licence.

 

(b) REQUESTS FOR REVIEW HEARINGS - PERSONAL LICENCES

 

The Board agreed to hold personal licence reviews in respect of Jodi Thom, Nashiat Choudhury and Mohammed Arshid.
