The minute of meeting of this Committee of 26th June, 2017 was held as read.

 

Unless marked thus * all items stand delegated.

 

I DECLARATIONS OF INTEREST

 

Councillor Marra declared a non-financial interest in respect of Article IV by virtue of being the Secretary and founder of Optimistic Sound who were one of the founders of the Big Noise and had charitable status.

 

Councillor Dawson declared a non-financial interest in respect of Article IX by virtue of being an employee of SSE.

 

II CIVIC GOVERNMENT (SCOTLAND) ACT 1982 STREET NAMES

 

(a) SITE AT ARMITSTEAD HOUSE, MONIFIETH ROAD, DUNDEE

 

There was submitted Agenda Note AN67-2017 relative to the above.

 

A consultation was carried out between 29th May, 2017 and 16th June, 2017 for a new street name at the above site.

 

The consultation correspondence was sent to Ward Councillors, City Archivist, Communities Officer and the agents for the applicant.

 

The initial proposal was to name the new street 'Armitstead Court' to keep links with the current site name but, during the consultation period and reviewing of subsequent historical information where it was found that the previous name for the property was Panmure Villa, a revised name of Panmure Villa Gardens was put out to consultation and this was the name that was accepted by the majority.

 

The Committee agreed to approve "Panmure Villa Gardens" as the new street name.

 

(b) GLENCONNOR DRIVE

 

In 1938, the local authority allocated a street name of Glenconner Drive to commemorate Lord Glenconner however, since 1940, the street nameplates and all properties off this street had used the spelling Glenconnor rather than Glenconner.

As the formally approved name of the street was Glenconner Drive, it was proposed to amend the street name to the one currently used ie Glenconnor Drive. This would give this name a legal standing and would raise no issues with properties that are addressed off this street.

 

This matter had been put to the Ward Councillors and City Archivist for consultation.

 

The Committee agreed to approve Glenconnor Drive as the new street name

 

III DUNDEE CITY COUNCIL (FINAVON PLACE FOOTPATH, DUNDEE) (STOPPING‑UP) ORDER 2017

 

There was submitted Agenda Note AN63-2017 where reference was made to Article VI of the minute of meeting of the City Development Committee of 23rd January, 2017 to stop-up an area of footpath at Finavon Place, Dundee.

 

The Order was duly prepared and advertised in the Evening Telegraph and The Edinburgh Gazette, and the relevant statutory undertakers were consulted. No objections were received.

 

The Committee authorised and confirmed the Stopping-Up Order, and authorised formal publication of the confirmation, after which the Order would become operative.

 

IV DOUGLAS COMMUNITY CENTRE BIG NOISE

 

There was submitted Agenda Note AN64-2017 informing the Committee that in order to expedite the programme for accommodation works associated with the Big Noise project which was due to be launched on 7th September, 2017, it was necessary to start these works in the middle of August, 2017.

 

Given the limited timescales available, the Executive Director of City Development, in consultation with the Convener, Lord Provost, Bailie Keenan, Bailie Scott and Bailie Macpherson, accepted an offer from Construction Services to carry out these works. The contract amount was for 24,735.33 which, together with other allowances of 10,408.18, made a total expenditure of 35,143.51.

 

The Executive Director of Corporate Services confirmed that these costs would be met from the City Development Department Capital Budget for 2016/2017 and 2017/2018.

 

The Committee noted the foregoing for information.

 

V PROPOSED LOCAL DEVELOPMENT PLAN 2 AND REVISED ENVIRONMENTAL REPORT

 

There was submitted Report No 215-2017 by the Executive Director of City Development seeking approval of the Proposed Dundee Local Development Plan 2 and its supporting documents and agreement to the publication of the Proposed Dundee Local Development Plan 2, the Environmental Report and Draft Supplementary Guidance for a period of public engagement.

 

The Committee:-

 

(i) approved the Proposed Dundee Local Development Plan 2 and agreed to a six week period for representations;

 

(ii) approved the contents of the Environmental Report and agreed to a six week period for representations;

 

(iii) approved the contents of the Draft Supplementary Guidance on Air Quality; Developer Contributions and Householder Development; the Strategic Environmental Assessment pre-screening assessment of each item of Supplementary Guidance; and agreed to a six week period for representations;

 

(iv) approved the Proposed Action Programme prepared in support of the Proposed Dundee Local Development Plan 2;

 

(v) approved the Draft Habitats Regulations Appraisal Record prepared in support of the Proposed Dundee Local Development Plan 2;

 

(vi) noted the contents of the Development Site Assessments Document, the Housing Background Paper, the Transport Background Paper and the Main Issues Report Consultation Responses prepared in support of the Proposed Dundee Local Development Plan 2;

 

(vii) remitted the Executive Director of City Development to report the outcome of the representations period back to Committee; and

 

(viii) referred the Proposed Dundee Local Development Plan 2 to the Development Management Committee as a relevant material planning consideration.

 

VI DUDHOPE PARK ACCESS ROAD - VARIATION OF WAITING RESTRICTIONS 2017

 

There was submitted Report No 270-2017 by the Executive Director of City Development considering a request for waiting restrictions in Dudhope Park (Access Road) due to inconsiderate parking causing identified road safety issues and obstructing both pedestrians and vehicles.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Order for Dundee.

 

VII STREET LIGHTING PARTNERSHIP PROGRAMME 2015/2016

 

There was submitted Report No 109-2017 by the Executive Director of City Development providing an update on the progress and performance of the Street Lighting Partnership with Tayside Contracts on the delivery of the street lighting services within Dundee City Council to 31st March, 2016.

 

The Committee agreed to note the content of the report and that the Executive Director of City Development continue to report back annually to the Committee advising on the progress and performance of the Partnership.

 

VIII VARIATION OF WAITING RESTRICTIONS ORDER 2017

 

There was submitted Report No 347-2017 by the Executive Director of City Development considering requests received during the previous quarter for additions and alterations to waiting restrictions throughout the city.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Orders for Dundee.

 

IX STATUTORY UNDERTAKERS REINSTATEMENT PERFORMANCE IN DUNDEE 2016/2017

 

There was submitted Report No 242-2017 by the Executive Director of City Development providing a summary of the performance of Statutory Undertakers operating in Dundee during 2016/2017 based on inspections under the New Roads and Street Works Act 1991 (NRSWA), and updating the Committee on the status of the Transport (Scotland) Act 2005, Part 2 - Road Works.

 

The Committee:-

 

(i) noted the performance of Statutory Undertakers reinstatements in Dundee based on the visual sample inspection regime and the local coring results for the last year;

 

(ii) approved the continuation of the annual local coring programme and participation in the biannual national coring programme; and

 

(iii) noted the status of the Transport (Scotland) Act 2005, Part 2 - Road Works, different parts of which came into force on 1st April, 2008 and 1st October, 2008.

 

X ROAD SAFETY PROGRESS REPORT 2017

 

There was submitted Report No 245-2017 by the Executive Director of City Development informing the Committee of the progress made in reducing road accident casualties on the local road network in Dundee.

 

The Committee agreed to note that the Council had met the Scottish Government's road casualty 2015 milestone reduction targets and continued to make progress towards reducing road accident casualties in line with the road safety targets for 2020.

 

XI ROAD SAFETY SCHEMES - IMPLEMENTATION 2017-2018

 

There was submitted Report No 246-2017 by the Executive Director of City Development seeking Committee approval for a programme of road safety measures to be implemented at locations in the city.

 

The Committee approved the implementation of the Road Safety Schemes as set out in Appendix B to the report.

 

XII IMPROVING PARKING IN SCOTLAND CONSULTATION PAPER

 

There was submitted Report No 257-2017 by the Executive Director of City Development considering the requirement to keep elected members informed of the Improving Parking in Scotland Consultation Paper for the Scottish Government.

 

The Committee noted the information contained within the report as it would be sent to Transport Scotland for data analysis and processing.

 

XIII DISABLED PERSONS PARKING SPACES (VARIATION) ORDER 2017

 

There was submitted Report No 255-2017 by the Executive Director of City Development considering all the requests during the last year for disabled parking bays which required to be added, or removed, from the Dundee City Council (Disabled Persons' Parking Places) (On-Street) Order 2011.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the on-street disabled parking bay provision in the relevant Traffic Regulation Order for Dundee.

 

XIV TENDERS RECEIVED BY HEAD OF DESIGN AND PROPERTY

 

There was submitted Report No 263-2017 by the Head of Design and Property detailing tenders received and requesting decisions thereon:-

 

(i) VARIOUS PROPERTIES - NON DOMESTIC ENERGY EFFICIENCY WORKS

 

The Committee agreed to accept an offer from Vital Energi in the sum of 18,308, to which required to be added allowances of 1,000, giving a total expenditure of 19,308.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XV PROPOSED DEVELOPMENT OF SITE 12, DUNDEE CENTRAL WATERFRONT

 

There was submitted Report No 267-2017 by the Executive Director of City Development seeking approval to agree an exclusivity period and to appoint a preferred development partner for the mixed use development Site 12 at Dundee Central Waterfront and to subsequently proceed with negotiations on the terms for a Development Agreement, subject to mutual agreements between the parties.

 

The Committee agreed to the recommendations contained in the report.

 

XVI PROPOSED SALE OF LAND AT 301 CRAIGIE DRIVE, DUNDEE

 

There was submitted Report No 232-2017 by the Executive Director of City Development seeking approval for the sale of land to the west of 301 Craigie Drive, Dundee.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XVII PROPOSED SALE OF LAND AT 25 CHARLOTTE CLOSE, DUNDEE

 

There was submitted Report No 233-2017 by the Executive Director of City Development seeking approval for the sale of land to the east of 25 Charlotte Close, Dundee.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XVIII PROPOSED SALE OF LAND AT 26 CHARLOTTE CLOSE, DUNDEE

 

There was submitted Report No 234-2017 by the Executive Director of City Development seeking approval for the sale of land to the east of 26 Charlotte Close, Dundee.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XIX PROPOSED SALE OF LAND AT 20 RANKINE STREET, DUNDEE

 

There was submitted Report No 235-2017 by the Executive Director of City Development seeking approval for the sale of land to the southwest of 20 Rankine Street, Dundee.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XX PROPOSED PURCHASE OF PROPERTY AT BARRACK STREET, DUNDEE

 

There was submitted Report No 241-2017 by the Executive Director of Corporate Services seeking approval for the purchase of Friarfield House, 68 Barrack Street, Dundee.

 

The Committee agreed the purchase on the terms and conditions detailed in the report.

 

XXI PROPOSED SALE OF LAND AT 19 YARROW TERRACE, DUNDEE

 

There was submitted Report No 249-2017 by the Executive Director of City Development seeking approval for the sale of land to the north and south of 19 Yarrow Terrace, Dundee.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XXII SALE OF LAND, DICKSON AVENUE, DUNDEE

 

There was submitted Report No 259-2017 by the Executive Director of City Development seeking approval for the disposal of the ground lease interest in the Rock Public House, Dickson Avenue, Dundee.

 

The Convener, seconded by Councillor Flynn, moved to agree to the disposal on the terms and conditions detailed in the report. As an amendment, Councillor Marra, seconded by Councillor Malone, moved to defer consideration of the report.

On a division, there voted for the motion - the Convener, Depute Lord Provost Campbell, Bailies Roberts, Sawers and Macpherson and Councillors Alexander, Cordell, Dawson, Flynn, Hunter,. Lynn, Murray, Rendall, Ross and Duncan (15); and for the amendment - Bailies Keenan, Wright and Scott and Councillors Cruickshank, Gordon, McCready, McIrvine, Malone, Murray, Richardson and Scott (11) - whereupon the motion was declared carried.
