The minute of meeting of this Committee of 22nd October, 2018 was held as read.

I DECLARATION OF INTEREST

 

There were no declarations of interest.

 

II PLANNING APPLICATIONS

 

(a) 18-00224-FULL - PHASE 1 OF HOUSING DEVELOPMENT COMPRISING OF 13 DWELLINGS - H30, HADDINGTON AVENUE, DUNDEE - FOR MR JOHN JACK

 

The Committee acceded to a request for a deputation to address the Committee relative to the above application which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development.

 

(b) 18-00300-FULL - PHASE 2 OF HOUSING DEVELOPMENT COMPRISING 27 DOMESTIC DWELLINGS - H30, HADDINGTON AVENUE, DUNDEE - FOR MR JOHN JACK

 

The Committee acceded to a request for a deputation to address the Committee relative to objections to the above application which was recommended for approval. After the deputation had stated their case and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Committee approved the application, subject to the conditions recommended by the Executive Director of City Development and subject to the additional condition that, prior to the commencement of the development hereby approved, a scheme to retain the existing footpath from Dunbar Park to Harvestfield Crescent (or an alternative footpath as close as possible to it) during construction, should be submitted to and approved in writing by the Council. Thereafter, the approved scheme would be implemented and maintained as such throughout the entire construction period of the development hereby approved.

 

(c) 18-00353-FULL ERECTION OF 5 HOUSES AND 4 FLATS WITH ASSOCIATED PARKING, AMENITY SPACE, NEW ACCESS AND ENVIRONMENTAL IMPROVEMENTS 51 MAGDALEN YARD ROAD, DUNDEE FOR F & H DEVELOPMENTS

 

The Committee acceded to requests for deputations to address the Committee both in support of and relative to objections to the above application, which was recommended for approval. After the deputations had stated their cases and answered questions from members of the Committee, they were thanked for their attendance and withdrew.

 

Thereafter, having considered objections received, the Convener, seconded by Councillor Alexander, moved approval of the application subject to the conditions recommended by the Executive Director of City Development.

 

As an amendment, Bailie Macpherson, seconded by Councillor McCready moved that the application be refused on the grounds that:-

 

1. The proposed development fails to provide private communal garden ground for the proposed flatted units and would therefore not provide a high quality residential amenity. The development is therefore contrary to Policy 9 (Design of New Housing) of the Dundee Local Development Plan (2014). There are no material considerations of sufficient weight that would justify approval of the application.

 

2. The applicant has failed to demonstrate that the stonework of the existing listed facade is beyond retention or reuse within the proposed residential development. The loss of the fabric of this prominent listed facade will have a detrimental impact on the aesthetic integrity of the local streetscape and the West End Lanes Conservation Area and is considered to be contrary to the requirements of Policy 48 (Listed Buildings) and Policy 50 (Development in Conservation Areas) of the Dundee Local Development Plan 2014. The application also fails to satisfy the requirements of the relevant provisions of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997. There are no material considerations of sufficient weight that would justify approval of the application.

 

On a division, there voted for the motion the Convener, Bailie Keenan and Councillors Alexander, Flynn, Hunter, Lynn, Murray, Ross, Short and Cruickshank (10); and for the amendment Lord Provost Borthwick, Depute Lord Provost Campbell, Bailies Scott and Macpherson and Councillors Cordell, Rendall, Smith, Gordon, McCready, McIrvine, Malone, Marra, Richardson, Hay and Duncan (15) - Bailie Roberts being absent when the vote was taken whereupon the amendment was declared carried.

 

(d) 18-00372-LBC DEMOLITION OF CATEGORY C LISTED FACADE OF FORMER TAY ROPE WORKS, 51 MAGDALEN YARD ROAD FOR F & H DEVELOPMENTS

 

Having considered objections received, the Convener, seconded by Councillor Alexander, moved approval of the application, subject to the conditions recommended by the Executive Director of City Development.

 

As an amendment, Bailie Macpherson, seconded by Councillor McCready, moved that the application be refused on the grounds that:-

III DELEGATED APPLICATIONS

 

There was submitted Agenda Note AN75-2017 advising the Committee that from 1st to 31st October, 2018 there were 50 delegated decisions. Six of those applications attracted objections. Of those six, five applications were approved and one was refused.
