At a MEETING of the LOCAL REVIEW BODY held remotely on 20th June, 2023.

The Chair welcomed those present to the meeting and briefly outlined the role of the Local Review Body and officers, in particular advising that, although the Planning Adviser was an employee of the Planning Authority, he had not been involved in the determination of the case under review and was present to provide factual information and guidance only.

III LOCAL PLANNING REVIEW LRB05/2023

 

PLANNING APPLICATION 22/00322/FULL - PART CHANGE OF USE OF INDUSTRIAL BUILDING (CLASS 5/6) TO EVENTS AND PHOTOGRAPHY VENUE (CLASS 11) (RETROSPECTIVE) - OLD GLAMIS WORKS, 13 OLD GLAMIS ROAD, DUNDEE

 

There was submitted Agenda Note  AN18-2023 giving details of a request for a review of planning permission for the part change of use of industrial building (Class 5/6) to events and photography venue (Class 11) (Retrospective) at Old Glamis Works, 13 Old Glamis Road, Dundee.

 

The Planning Adviser gave a brief outline of the application and the reasons for refusal.

 

The Legal Adviser advised that the applicant had intimated in the Notice of Review that they had not raised any new matters which were not before the Appointed Officer at the time of reaching their decision. The appeal statement did not include anything that the Appointed Officer would not have been aware of. The Legal Adviser considered that the Local Review Body should therefore take all documents submitted into consideration during its deliberations.

 

Thereafter, having considered all the information, having taken into account the provisions of the Development Plan, all material considerations, the findings of the site visit and all matters raised at the review, the Local Review Body considered that there were material considerations of sufficient weight to justify approval of the proposal contrary to the provisions of the Development Plan and therefore reversed the Appointed Officer's decision and approved planning permission reference 22/00322/FULL subject to the undernoted conditions:-

 

1. All amplified sound shall be so controlled as to be inaudible within any adjacent residential property. Amplified music must cease by 11:30 pm.

 

Reason: In the interests of residential amenity.

 

2. Within three months of this notice, a Noise Impact Assessment shall be submitted to Dundee City Council for approval and implemented thereafter in accordance with the approval.

 

Reason: In the interests of residential amenity.

 

3. The hours of operation of events shall be restricted to 08:00hrs to midnight on Saturdays only. For the avoidance of doubt, all patrons must vacate the premises no later than midnight. The only persons permitted outwith those times are staff and contractors associated with servicing and cleaning of the venue.

 

Reason: In the interests of residential amenity.

 

4. Within three months of this notice, full details of disabled parking provision shall be submitted to Dundee City Council for approval and implemented thereafter in accordance with the approval.

 

Reason: In the interests of providing reasonable access to the proposed development.

 

5. Within three months of this notice, full details of a travel plan shall be submitted to Dundee City Council for approval and implemented thereafter in accordance with the approval.

 

Reason: In the interests of providing reasonable and safe access to the proposed development. To reduce demands and congestion on the surrounding road network.

 

6. This planning permission is granted for a temporary period of two years from the date of this decision notice.

 

Reason: To permit the monitoring of the transportation impacts and effect of the travel plan.

 

7. The level of traffic associated with any event must be monitored by the applicant for a period of eighteen months from the date of this decision notice and the results of the monitoring submitted to and agreed with Dundee City Council.

 

Reason: To ensure there is no adverse traffic impact on the road network.
