The Freedom of Information (Scotland) Act 2002 gives a general right of access to all types of recorded information held by public authorities, sets out exemptions from that right and places a number of related obligations on public authorities including publication schemes and records management. The Act applies to any records held by the authority no matter when they were created.
The Environmental Information (Scotland) Regulations 2004 came into effect on 1st January 2005 at the same time as the Freedom of Information (Scotland) Act 2002.
Scottish Information Commissioner
The Act will be enforced by the Scottish Information Commissioner. The Scottish Information Commissioner deals only with Scottish public authorities as defined by Section 3 of the Freedom of Information (Scotland) Act 2002.
The Freedom of Information (Scotland) Act 2002 requires Scottish public authorities to adopt and maintain a Publication Scheme in which they list the types of information which they make available as a matter of course to the public. Dundee City Council's Publications Scheme is available below.
