I MINUTE OF MEETING OF THE LIAISON COMMITTEE OF 17TH APRIL, 2001

 

The minute of meeting of the above Committee was submitted and approved with the exception of Article III(b) with relation to the clarification of footwear in Condition 21 of the conditions annexed at Appendix 2, which was referred back to the Liaison Committee for further discussion.

 

II CIVIC GOVERNMENT (SCOTLAND) ACT 1982

 

(a) PUBLIC PROCESSION

 

There was submitted an application by Mr H Strachan on behalf of Fred Roshier Memorial Orange Lodge for a public procession on Saturday 30th June, 2001.

 

After hearing Mr R Cruden on behalf of the applicant and having given consideration to an observation submitted by the Chief Constable regarding the starting time and route of the Public procession, the Convener, seconded by Councillor Mackie, moved that the application be granted on condition that the Public Procession start at 8 am and follow the route recommended by Tayside Police.

 

As an amendment, Councillor Petrie, seconded by Councillor Beattie, moved that the application be granted with the condition that the Public Procession commence at 7.30 am.

 

On a division, there voted for the motion - the Convener, the Lord Provost and Councillors Grant, Regan, Fordyce, Dawson and Mackie (7); and for the amendment - Councillors Petrie and Beattie (2) - Councillor Letford declining to vote - whereupon the motion was declared carried.

 

(b) LATE HOURS CATERING LICENCE - NEW APPLICATIONS

IV CIVIC GOVERNMENT (SCOTLAND) ACT 1982 - TAXI DRIVER'S LICENCE - SUSPENSION HEARINGS

 

The Committee gave consideration to a letter of complaint submitted by the Plant and Vehicle Officer relative to the condition in which Mr Thomas A Burns, had submitted his vehicle for test.

 

After hearing Mr Burns on his own behalf the Committee agreed that no action be taken.

 

Councillor Regan declared an interest in this item and took no part in the consideration thereof.

 

The Committee gave consideration to a letter of complaint from the Plant and Vehicle Officer relative to the condition in which Mr Robert Pirie, had submitted his vehicle for test,

 

Thereafter, after hearing an Agent for the applicant, the Convener, seconded by Councillor Mackie, moved that no action be taken.

 

As an amendment, Councillor Petrie, seconded by Councillor Beattie, moved that Mr Pirie's licence be suspended for the remaining 28 days of the licence.

 

On a division, there voted for the motion - the Convener. the Lord Provost and Councillors Grant, Letford, Regan, Fordyce, Dawson and Mackie (8); and for the amendment - Councillors Petrie and Beattie (2) - whereupon the motion was declared carried.

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 3, 6 and 9 of Part 1 of Schedule 7A of the above Act.

The Committee gave consideration to an objection which had been submitted by the Chief Constable relative to this application.

 

After hearing the applicant on her own behalf, the Committee agreed that the application be granted.

The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application.

 

After hearing the applicant on his own behalf, the Committee agreed that the application be granted.

 

There was submitted an application by Mr SC for the grant of a Taxi Driver's Licence.

 

The Committee was advised that the applicant was not present and agreed that consideration of the application be deferred to the meeting on 28th June, 2001.

 

There was submitted an application by Mr KH for the grant of a Taxi Driver's Licence.

 

The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application.

 

After hearing the applicant on his own behalf, the Committee agreed that the application be granted.

 

There was submitted an application by Mr DS for the grant of a Taxi Driver's Licence.

 

The Committee gave consideration to an objection which had been submitted by the Chief Constable relative to this application.

 

Thereafter, having heard the applicant on his own behalf, the Convener, seconded by Councillor Grant, moved that the application be granted.

 

As an amendment, Councillor Letford, seconded by Councillor Fordyce, moved that the application be refused.

 

On a division, there voted for the motion - the Convener and Councillors Grant, Regan and Mackie (4); and for the amendment - Councillors Letford, Fordyce and Dawson (3) - Councillor Beattie declining to vote and the Lord Provost and Councillor Petrie being absent when the vote was taken - whereupon the motion was declared carried.

The Committee gave consideration to an objection which had been submitted by the Chief Constable relative to this application.

 

After hearing the applicant on his own behalf, the Committee agreed that the application be granted.

The Committee gave consideration to a representation which had been submitted by the Chief Constable relative to this application.
