I LICENSING (SCOTLAND) ACT 2005

(a) NEW GRANTS

The Board agreed to grant the above application.

(b) VARIATIONS

The Board agreed to grant a variation to local condition 1 to allow live musicians (instrumentalists and vocalists). Core hours to commence at 11am on Sundays for both on and off sales.

The Board agreed to grant a variation to the layout plan resulting in the capacity being reduced from 97.47m2 to 81.7m2.

The Board, having heard from the applicant on their own behalf, agreed to grant a variation to allow children to attend private functions when accompanied by a responsible adult.

The Board, having heard from the applicant on their own behalf and taken into account a letter of objection, agreed to a variation to local condition 1 to include DJ, karaoke and automatic music system. Gaming, indoor/outdoor sports, dominoes, quiz nights and karaoke during core hours. Children and young persons allowed access on football match days in the bar area (two hours before and one hour after match or 8pm, whichever is the earlier). Children to be permitted access for private functions for the duration of the function. Core hours for on and off sales to commence at 11am on Sundays. Layout plan amended to show children's area.

The Board, having heard from objectors, the Chief Constable's representative, an Officer from Environmental Health and Trading Standards and the applicant on their own behalf, agreed to a variation to local condition 1 to include DJ, disco and live bands during core hours. Variation to core hours to basement to open until 2.30am and operate as a nightclub to include attachment of minimum charge condition.

The Board agreed to grant a variation to local condition 1 to allow TV, background music, televised sport, recorded music, ipod, hard drive background music system, discos, live bands (maximum of five artistes), poker/quiz nights during core hours. Variation to core hours to open for on and off sales at 11am on Sundays.

The Board agreed to grant alterations to the layout plan resulting in capacity for sale of alcohol being reduced from 44.4m2 to 23.1m2.

Bailie Regan declared a non-financial interest by virtue of frequenting the premises.

The Board, having heard from an agent on behalf of the applicant, agreed to local condition 1 being amended to include live musicians, including instrumentalists and vocalists during core hours. Core hours amended to commence at 11am on Sundays for both on and off sales.

The Board, having heard from an Officer from Environmental Health and Trading Standards and the applicant on their own behalf, agreed to a variation to core hours to commence at 11am on Sundays for on and off sales. Variation to operating plan to allow children access on match days two hours prior to kick-off and one hour after conclusion of match or 8pm, whichever is earlier. Children and young persons also to be permitted access for functions from 7pm to the end of the function. Children's access to be limited to the new lounge area shown on the layout plan.

(c) VARIATION ON TRANSFER

The Board, having heard from an agent on behalf of the applicant, agreed to a variation to local condition 1 to allow TV, projected sport, automatic music system and juke box Mondays to Sundays from 11am to 12 Midnight. Bands, DJ, karaoke, instrumentalists and vocalists (maximum of five artistes) on Wednesdays to Sundays 8pm to 12 Midnight. Dominoes, race/quiz/darts nights, charity fund raisers Mondays to Sundays 8pm to 12 Midnight. Core hours to commence at 11am on Sundays with the request for 10am Mondays to Saturdays being withdrawn.

(d) PERSONAL LICENCE

The Board, having heard from the Chief Constable's representative and the applicant on their own behalf, agreed to grant the above application.

II GAMING ACT 2005

(a) LICENSED PREMISES GAMING MACHINES - NEW

The Board agreed to grant the above application to allow three gaming machines within the premises.
