The minute of meeting of this Committee of 27th February, 2012 was held as read.

I DUNDEE DEVELOPMENT PLAN SCHEME 2012

 

There was submitted Report No 90-2012 by the Director of City Development setting out the revised Development Plan Scheme for the Dundee Local Development Plan.

 

The Committee agreed to:-

 

(a) approve the revised Development Plan Scheme as set out in Appendix 1 to the report;

 

(b) refer the revised Development Plan Scheme to the Scottish Government for information; and

 

(c) remit the Director of City Development to publish and implement the Development Plan Scheme.

 

II DESIGNATION OF ENTERPRISE AREAS IN DUNDEE

 

There was submitted Report No 128-2012 by the Director of City Development advising members of the Scottish Government's designation of two sites in Dundee as part of an Enterprise Area for Low Carbon/Renewables in Dundee and seeking agreement to the adoption of a protocol for dealing with future planning applications in these areas.

 

The Committee agreed to:-

 

(a) note the designation of two sites as enterprise areas within Dundee City; and

 

(b) adopt the protocol for dealing with planning applications within these areas detailed in the report.

 

III RENEWAL OF MAINTENANCE CONTRACT FOR ICE PREDICTION SERVICES

 

There was submitted Agenda Note AN50-2012 advising that the City Engineer had obtained a quotation from the current specialist provider, Vaisala, for the continuing maintenance of the ice prediction out-stations and the forecasting bureau services over the next five years for a favourable rate.

 

The total cost of the above over a five year period was 54,815, which could be met each year from the City Development Revenue Budget for Winter Maintenance.

 

The Committee authorised the appointment of Vaisala to provide the services outlined above.

 

IV ENCLOSE (ENERGY EFFICIENCY IN CITY LOGISTICS SERVICES FOR SMALL AND MID-SIZED EUROPEAN HISTORIC TOWNS) PROJECT

 

There was submitted Agenda Note AN43-2012 advising that Dundee City Council, as part of a pan European Consortium, had been advised that the above project had been selected by the European Union for funding commencing in April, 2012.

 

Funding of approximately 80,000 Euros had been allocated to Dundee to meet staff costs research support costs, hosting stakeholders in Dundee and travel costs in attending international dissemination events.

 

The Committee noted the above.

 

V TREE PRESERVATION ORDER - 37A MAINS LOAN, DUNDEE

 

There was submitted Agenda Note AN51-2012, making reference to Article I of the minute of meeting of this Committee of 23rd January, 2012, wherein this item was deferred in order to obtain a tree evaluation survey from the Council's Forestry Officer.

 

The Committee noted the contents of the survey and authorised the Depute Chief Executive (Support Services) and the Director of City Development to undertake the necessary procedures to confirm the above Tree Preservation Order.

 

VI IMPROVEMENTS TO DRAINAGE NORTH OF EMMOCK WOODS HOUSING DEVELOPMENT

 

There was submitted Agenda Note AN44-2012, advising that the City Engineer had identified drainage and maintenance improvement works within Dundee City Council owned land, which would reduce the risk of flooding to properties in William Fitzgerald Way.

 

The Committee agreed to accept an offer of 9,379.50 from the Environment Department (Construction Division) and noted that the total cost of the works would be 14,000, inclusive of professional fees and contingencies.

 

VII GELLATLY STREET MULTI-STOREY CAR PARK -CHANGE TO PAY ON FOOT FACILITY

 

There was submitted Report No 92-2012 by the Director of City Development relative to a proposal to modernise the method for paying for parking at the Gellatly Street Multi-Storey Car Park from the current Pay and Display to the ACS Pay on Foot system.

 

The Committee agreed to:-

 

(a) approve the change in the way that customers pay for parking at the Gellatly Street Multi-Storey Car Park from Pay and Display to the ACS Pay on Foot system; and

 

(b) approve the amendment of the necessary Traffic Regulation Order to change the payment method for Gellatly Street Multi-Storey Car Park from "Pay and Display" to "Pay before Exiting" by effecting changes to the Dundee City Council (Off-Street Car Parks) Order 1996.

 

VIII BRIDGE REPLACEMENTS AT DUNDEE STATION - BASIC ASSET PROTECTION AGREEMENT

 

There was submitted Agenda Note AN45-2012, making reference to Article III of the minute of meeting of this Committee of 26th September, 2011, whereby it was agreed that Dundee City Council enter into a Bridge Agreement with Network Rail for the replacement of the weight restricted bridge at Dundee Station and the Dundee Station Roundabout Bridge with a single combined bridge.

 

It was reported that tenders were currently being prepared to procure a contractor for this contract and in order to progress the works, Dundee City Council required to enter into a legal Basic Asset Protection Agreement to agree terms and to meet Network Rail costs associated with this Agreement, estimated at 631,685.85.

 

The Committee granted authority for terms and conditions to be agreed with Network Rail by the Depute Chief Executive (Support Services) in consultation with the City Engineer and Director of Finance and to sign the Agreement on behalf of the Council.

 

IX LOTHIAN CRESCENT/WHITFIELD SPINE ROAD AREA (20 MPH ZONE) ORDER 2012

 

There was submitted Report No 121-2012 by the Director of City Development relative to a proposal to introduce a 20mph speed limit on various roads in and around the Lothian Crescent area of Whitfield.

 

The Committee approved the preparation of the necessary Traffic Regulation Order to introduce 20mph speed limits on various lengths of Lothian Crescent, Salton Crescent, The Rowans, Whitfield Loan, Whitfield Terrace, Haddington Place, Haddington Gardens, Haddington Avenue and Summerfield Avenue within the Whitfield area of Dundee.

 

X CENTRAL WATERFRONT - RIVERSIDE DRIVE LAY-BY (EXTENSION) VARIATION OF WAITING RESTRICTIONS

 

There was submitted Report No 111-2012 by the Director of City Development relative to a proposal to promote various Traffic Regulation Orders to alter waiting restrictions in the lay-by on Riverside Drive at Dundee Railway Station in order to accommodate its proposed extension.

 

The Committee approved the preparation of:-

 

(a) the necessary Traffic Regulation Order to effect the changes of the traffic regulations on Riverside Drive lay-by to vary the Dundee City Council (Western Area, Dundee) (Waiting and Loading Restrictions) Order 1012; and

 

(b) the necessary Traffic Regulation Order to effect the changes of the traffic regulations on Riverside Drive lay-by in order to extend a section of Taxi Rank Clearway in the Dundee City Council (Taxi Rank Clearways) Order 2007.

 

XI UNION STREET WAITING RESTRICTIONS - VARIATION

 

There was submitted Report No 85-2012 by the Director of City Development relative to a request for alterations to waiting restrictions in Union Street due to environmental improvements for the Central Waterfront Project.

 

The Committee approved the preparation of a Traffic Regulation Variation Order to effect the changes to the waiting restrictions in the relevant Traffic Regulation Order for Dundee, as detailed in the report.

 

XII MILEY/RADIAL CYCLE ROUTE - VARIATION OF TRAFFIC REGULATIONS

 

There was submitted Report No 86-2012 by the Director of City Development relative to a proposal to promote a Traffic Regulation Order to designate several lengths of footway to be used jointly as footway/cycle track along the North Radial Cycle Route between Constitution Road and Laird Street, and to promote a Traffic Regulation Order which would designate lengths of footway to be used jointly as footway/cycle track linking Dundee City Centre with the Green Circular Cycle Route.

 

The Committee approved the preparation of the necessary Traffic Regulation Order to effect the changes to the traffic regulations on various lengths of footpath and footway in the Dundee City Council (Dundee Area Cycle Routes) Order 2007 and the Tayside Regional Council (Dundee District Cycle Routes) Order 1995, as detailed in the report.

 

XIII TRAFFIC ORDERS

 

There was submitted Agenda Note AN46-2012 relative to the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (ABERCRAIG CAR PARK, DUNDEE) (NAME AND TARIFF CHANGE) ORDER 2012

 

Reference was made to Article IV of the minute of meeting of this Committee of 28th November, 2011, wherein the Committee authorised the preparation of an Order to provide more clarity for visitors accessing the area and to provide a tariff more suited to the amenities of the area.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order as drafted.

 

(b) DUNDEE CITY COUNCIL (HIGH STREET/NETHERGATE/MEADOWSIDE, DUNDEE) (VARIATION OF TAXI RANK CLEARWAYS) ORDER 2012

 

Reference was made to Article VII of the minute of meeting of this Committee of 27th September, 2010, wherein the Committee authorised the preparation of an Order to allow for additional parking for taxis throughout the City, both on a 24 hour basis and an 11pm to 6am basis.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

Thereafter, the Order was duly advertised and 93 objections had been received, all relating to the proposed taxi ranks at High Street and Nethergate, and, after consultation, it was agreed that both of these proposed taxi ranks be removed from this Order and that the Order should be named "Dundee City Council (Meadowside, Dundee) (Variation of Taxi Rank Clearways) Order 2012.

 

The Committee agreed to make the Order, subject to the above amendment.

 

(c) DUNDEE CITY COUNCIL (ST COLUMBA GARDENS, NORTH LINDSAY STREET AND SOUTH MARKETGAIT, DUNDEE) (ONE-WAY AND VARIATION TO WAITING RESTRICTIONS) ORDER 2012

 

Reference was made to Article III of the minute of meeting of this Committee of 31st October, 2011, wherein the Committee authorised the preparation of an Order to reduce vehicle congestion on St Columba Gardens, while promoting safety for vehicles, pedestrians and school children by reducing potential for vehicle conflict, and to allow for the Waterfront Masterplan to be implemented, facilitating the next stage of the redevelopment of Dundee Central Waterfront.

 

It was reported that the proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee therefore authorised publication of the Order as drafted.

 

XIV NEW ROADS - ROAD CONSTRUCTION CONSENT

 

There was submitted Agenda Note AN47-2012, making reference to Article IV of the minute of meeting of the Policy and Resources Committee of 27th April, 2009, wherein the grant of road construction consent was delegated to the Director of City Development with the proviso that any consents granted be reported to the City Development Committee as soon as practicable thereafter.

XV RELOCATION OF DOUGLAS FAMILY SUPPORT CENTRE

 

There was submitted Report No 96-2012 by the Director of City Development detailing the cost of relocating Douglas Family Support Centre from its current location at Balmerino Road to accommodation within Douglas Community Centre and seeking approval of this expenditure.

 

The Committee approved acceptance of the offer submitted by Dundee City Council, Environment Department in the sum of 49,012, together with allowances of 1,640, giving a total expenditure of 50,652.

 

XVI COST OF REINSTATING DAMAGE AT 17 TO 19 KING STREET

 

There was submitted Report No 97-2012 detailing the cost of reinstating the building at 17 to 19 King Street which had been damaged by water ingress.

 

The Committee approved acceptance of the offer submitted by Dundee City Council, Environment Department in the sum of 73,013.

 

XVII TENDERS RECEIVED

 

There was submitted Report No 123-2012 by the Director of City Development detailing tenders received in respect of the demolition of Standards House.

 

The Committee agreed to accept the lowest offer from Gowrie Contracts Ltd in the sum of 49,336, to which required to be added allowances amounting to 31,260, giving a total expenditure of 80,596.

 

XVIII TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 130-2012 detailing tenders received in respect of the undernoted projects:-

 

(a) CLEPINGTON PRIMARY SCHOOL, CARETAKER'S HOUSE - WINDOW REPLACEMENT

 

The Committee agreed to accept a negotiated offer from Dundee City Council, Environment Department in the sum of 17,615.75, to which required to be added allowances amounting to 3,042.36, giving a total expenditure of 20,658.11.

 

(b) FORTHILL PRIMARY SCHOOL - CURTAIN WALL REPLACEMENT TO THE SOUTH AND EAST ELEVATIONS

 

The Committee agreed to accept a negotiated offer from Dundee City Council, Environment Department in the sum of 180,375, to which required to be added allowances amounting to 27,056.25, giving a total expenditure of 207,431.25.

 

(c) GLEBELANDS PRIMARY SCHOOL - ROOFWORKS TO MAIN ROOF

 

The Committee agreed to accept a negotiated offer from Dundee City Council, Environment Department in the sum of 99,313.40, to which required to be added allowances amounting to 14,897.01, giving a total expenditure of 114,210.41.

 

(d) NEW BALLUMBIE PRIMARY SCHOOL - REMOVAL OF FURNITURE AND EQUIPMENT

 

The Committee agreed to accept a negotiated offer from Dundee Removal Services in the sum of 25,600, to which required to be added allowances amounting to 1,800, giving a total expenditure of 27,400.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XIX COMMERCIAL LEASES

 

There was submitted Report No 124-2012 by the Director of City Development detailing commercial leases agreed in respect of the undernoted properties:-

 

1.143 hectares of ground at King's Cross Road

Unit 3, Miln Street, Dundee

 

The Committee approved the leases on the terms and conditions detailed.

 

XX RENT REVIEWS

 

There was submitted Report No 125-2012 by the Director of City Development detailing rent reviews in respect of the undernoted properties:-

XXI SALE AND LEASE OF LAND AT LIFF ROAD, DUNDEE

 

There was submitted Report No 24-2012 detailing a proposal to reduce the lease area of a plot of land at Liff Road to one party, and to part loan and part sell this land to another party.

 

The Committee approved the sale and lease of land on the terms and conditions detailed in the report.
