I DECLARATIONS OF INTEREST

 

Depute Lord Provost Roberts and Councillors Ross, Alexander and Cruickshank declared a non‑financial interest in Article XI by virtue of being Council representatives on the Dundee Ice Arena Board.

 

Lord Provost Duncan and Councillors Hunter, Gordon and McCready declared a non-financial interest in Article XI by virtue of being Council representatives on Leisure and Culture, Dundee.

 

II TREE PRESERVATION ORDER 08/2013

 

The Committee acceded to a request for a deputation to address the Committee relative to objections to the above-mentioned Tree Preservation Order. After the deputation had stated its case and answered questions from members of the Committee, it was thanked for its attendance and withdrew.

 

Thereafter, there was submitted Agenda Note AN140-2014, advising that on 8th November, 2013, the Council made a Tree Preservation Order on the above-mentioned site in order to protect and preserve the arboreal amenity of the area, and that two objections from neighbouring properties had been received.

 

The Committee noted the terms of the objections, and the Council's Forestry Officer's response thereto.

 

Thereafter, the Committee authorised the Head of Democratic and Legal Services and Director of City Development to undertake the necessary procedures and confirm the above Tree Preservation Order.

 

III DUNDEE LOCAL DEVELOPMENT PLAN SUPPLEMENTARY GUIDANCE - DEVELOPER CONTRIBUTIONS(CONSULTATION DRAFT) AND AIR QUALITY AND LAND USE PLANNING (CONSULTATION DRAFT)

 

There was submitted Report No 184-2014 seeking approval of the Draft Supplementary Guidance documents "Developer Contributions" and "Air Quality and Land Use Planning" for consultation with interested parties.

 

The Committee agreed to:-

 

(a) approve the Supplementary Guidance on Developer Contributions for a six week period of consultation;

 

(b) approve the Supplementary Guidance on Air Quality and Land Use Planning for a six week period of consultation;

 

(c) remit the Director of City Development to consult with interested parties on the draft Supplementary Guidance; and

 

(d) remit the Director of City Development to report back on the results of the consultation.

 

IV AUDIT SCOTLAND - MAINTAINING SCOTLANDS ROADS AND DUNDEE CITY COUNCILS ROAD ASSETCONDITION

 

There was submitted Report No 97-2014 by the Director of City Development advising on the follow‑up progress report by Audit Scotland, 'Maintaining Scotland's Roads' May 2013, the current position and the background to the Statutory Performance Indicator used to measure carriageway condition as reported to the Scrutiny Committee, and the condition of the adopted road asset within Dundee City Council. The report also identified the continued investment required to maintain the asset at an appropriate standard.

 

The Committee noted the contents of the report and agreed to take account of this when setting future budgets.

 

V MONITORING OF ROAD TRAFFIC REDUCTIONS ACT TARGETS

 

There was submitted Report No 152-2014 by the Director of City Development, advising the Committee of the Council's progress towards Road Traffic Targets that had been set under the Road Traffic Reduction Act 1997.

 

The Committee noted the Council's progress towards the 2021 target, which was to ensure that traffic did not increase in the city centre by more than 25% by 2021, compared to 1996 levels during the morning and evening peak periods, having noted that the Council was currently on schedule to be well within this target by the year 2021 but that officers would continue to monitor traffic levels within the city.

 

VI CYCLING, WALKING, AND SAFER STREETS (CWSS) PROJECTS COMMENCING 2014/2015

 

There was submitted Report No 156-2014 by the Director of City Development, seeking Committee approval for officers to identify and deliver cycling and walking improvements across the City of Dundee.

 

The Committee approved the proposed cycling and pedestrian work themes for the year 2014/2015 detailed in the report.

 

VII CENTRAL WATERFRONT - PARKING AND VARIATION OF TRAFFIC REGULATIONS

 

There was submitted Report No 151-2014 by the Director of City Development relative to the requirement to promote the various Traffic Regulation Orders to facilitate parking provision and vehicular movement in the South Marketgait area.

 

The Committee approved:-

 

(a) the preparation of the necessary Traffic Regulation Order to effect the changes to the traffic regulations on several currently unnamed lengths of carriageway which would vary the Tayside Region (Dundee) (One-Way Traffic) (Consolidation) Order 1987;

 

(b) the preparation of the necessary Traffic Regulation Order to effect the changes to the waiting restrictions on Riverside Drive and various unnamed lengths of carriageway which would vary the Dundee City Council (Central Area, Dundee) (Controlled Parking Zone) Order 2010 and Tayside Region (Marketgait, Dundee) (Clearway) Order 1983; and

 

(c) the revocation of subsequent Traffic Regulation Orders for lengths of carriageway which would cease to exist when the new network was completed.

 

VIII ORMISTON CRESCENT FOOTPATH - STOPPING-UP ORDER

 

There was submitted Report No 166-2014 by the Director of City Development relative to a proposal to stop-up a length of footpath which required to be removed to facilitate a new housing development following planning consent.

 

The Committee approved the preparation of the necessary Traffic Regulation Order.

 

IX HARVEST FIELD CRESCENT ONE-WAY ORDER 2014

 

There was submitted Report No 179-2014 by the Director of City Development seeking Committee approval for the implementation of a Traffic Regulation Order to introduce a one-way traffic restriction in Harvest Field Crescent.

 

The Committee approved the preparation of the necessary Traffic Regulation Order to introduce a one-way traffic restriction in Harvest Field Crescent by varying the Tayside Region (Dundee) (One‑Way Traffic) (Consolidation) Order 1987.

 

X TRAFFIC ORDERS

 

There was submitted Agenda Note AN141-2014 detailing the undernoted Traffic Orders:-

 

(a) DUNDEE CITY COUNCIL (VARIATION TO DISABLED PERSONS' PARKING PLACES) (REMOVALS) ORDER 2013

 

Reference was made to Article XI of the minute of meeting of this Committee of 20th August, 2012, wherein the Committee authorised the preparation of an Order to remove bays that were no longer linked to qualifying residents because of the requirements of the Disabled Persons' Parking Places (Scotland) Act 2009.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received. The Order was duly advertised and there were no objections.

 

The Committee agreed to make the Order as advertised.

 

(b) DUNDEE CITY COUNCIL (BANK STREET, LOCHEE, DUNDEE) (VARIATION OF WAITING RESTRICTIONS) ORDER 2014

 

Reference was made to Article III of the minute of meeting of this Committee of 25th November, 2013, wherein the Committee authorised the preparation of an Order to vary waiting restrictions at Bank Street, Lochee.

 

The proposed Order was duly drafted and, during the statutory consultation period, no objections were received.

 

The Committee authorised publication of the Order as drafted.

 

XI TENDERS RECEIVED BY CITY ARCHITECT

 

There was submitted Report No 157-2014 by the City Architect detailing tenders received in respect of the undernoted projects:-

 

(a) DUNDEE ICE ARENA - REFURBISHMENT OF MALE AND FEMALE TOILETS AND CHANGING AREAS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 163,500, to which required to be added allowances amounting to 25,016, giving a total of 188,516.

 

(b) BRAEVIEW ACADEMY - INSTALLATION OF LISTS AND RAMPS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 120,534.37, to which required to be added allowances amounting to 18,442, giving a total of 138,976.37.

 

(c) CASTLEPARK CENTRE - RENEWAL OF FIRE ALARM SYSTEM

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 30,017.25, to which required to be added allowances amounting to 4,593, giving a total of 34,610.250.

 

(d) CLEPINGTON PRIMARY SCHOOL - UPGRADING OF FIRE DOORS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 20,917.88, to which required to be added allowances amounting to 3,200, giving a total of 24,117.88.

 

(e) CRAIGIEBARNS PRIMARY SCHOOL - REVIEW OF TIMBER SCREENS, CLADDING AND WINDOWS TO GYMNASIUM

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 49,713.26, to which required to be added allowances amounting to 7,606, giving a total of 57,319.26.

 

(f) DENS ROAD PRIMARY SCHOOL - RENEWAL OF ROOF COVERING (PHASE 2)

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 82,164.73, to which required to be added allowances amounting to 12,571, giving a total of 94,735.73.

 

(g) FORTHILL PRIMARY SCHOOL - CURTAIN WALLING REPLACEMENT, NORTH ELEVATION

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 155,047.24, to which required to be added allowances amounting to 23,722.23, giving a total of 178,769.47.

 

(h) GLEBELANDS PRIMARY SCHOOL ENTRANCE IMPROVEMENTS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 238,453.36, to which required to be added allowances amounting to 36,484, giving a total of 274,937.36.

 

(i) LONGHAUGH PRIMARY SCHOOL - HEATING REPLACEMENT

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 418,048.03, to which required to be added allowances amounting to 63,962, giving a total of 482,010.03.

 

(j) LONGHAUGH PRIMARY SCHOOL - FIRE ALARM INSTALLATION

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 58,229.59, to which required to be added allowances amounting to 8,909, giving a total of 67,138.59.

 

(k) LONGHAUGH PRIMARY SCHOOL - RELOCATION OF SEN UNIT

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 19,289.03, to which required to be added allowances amounting to 2,951, giving a total of 22,240.03.

 

(l) MENZIESHILL HIGH SCHOOL - REFURBISHMENT OF SCIENCE LABORATORY

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 56,113.05, to which required to be added allowances amounting to 8,585, giving a total of 64,698.05.

 

(m) ST LUKE'S AND ST MATTHEW'S PRIMARY SCHOOL - RENEWAL OF GLAZED SCREENS TO INFANT'S CORRIDORS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 39,836, to which required to be added allowances amounting to 6,095, giving a total of 45,931.

 

(n) ST VINCENT'S PRIMARY SCHOOL - REPLACEMENT OF WINDOWS AND DOORS AT KITCHEN

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 9,849.24, to which required to be added allowances amounting to 1,507, giving a total of 11,356.24.

 

(o) VARIOUS PRIMARY SCHOOLS - PROVISION FOR UNDER THREE YEAR OLDS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 403,000, to which required to be added allowances amounting to 61,659, giving a total of 464,659, having noted that works to Park Place Primary School were not included within the project.

 

(p) VARIOUS PRIMARY SCHOOLS - PROVISION OF INCREASED DINING FACILITIES FOR FREE SCHOOL MEALS PUPILS

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 405,000, to which required to be added allowances amounting to 61,965, giving a total of 466,965.

 

(q) VARIOUS PRIMARY SCHOOLS - ELECTRICAL PERIODIC TESTING

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 34,000, to which required to be added allowances amounting to 5,202, giving a total of 39,202.

 

(r) WHITFIELD LIFE SERVICES BUILDING - CAFE FIT-OUT

 

The Committee agreed to accept a negotiated offer from the Environment Department (Construction Services) in the sum of 44,017, to which required to be added allowances amounting to 14,403, giving a total of 58,420.

 

XII HIGH HEDGES (SCOTLAND) ACT 2013

 

There was submitted Agenda Note AN144-2014 advising that the High Hedges (Scotland) Act 2013 had come into force on 1st April, 2014. This allowed householders in specified circumstances to make an application to the Council seeking to have action taken over a high hedge which affected the reasonable enjoyment of their property.

 

Rather than the Scottish Government setting a standard fee for these applications, Section 4 of the Act allows Councils to charge a fee which should not exceed the reasonable costs of deciding the application, and following a costing exercise, Dundee City Council had set a charge of 400.

 

It was reported that this fee had been approved by the Convener, Labour Group spokesperson, Conservative member, Liberal Democrat member and Independent member.

 

The Committee noted the foregoing.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the press and public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information as defined in paragraphs 6 and 9 of Part I of Schedule 7A of the Act.

 

XIII COMMERCIAL LEASES AND RENT REVIEWS

 

There was submitted Report No 161-2014 detailing commercial leases and rent reviews in respect of the undernoted properties:-

 

Commercial Lease - Unit 5 Miln Street, Dundee

 

Rent Review - 14-16 St Giles Terrace, Dundee

 

The Committee approved accordingly.

 

XIV PROPOSED SALE OF LAND ADJACENT TO 89 KINGHORNE ROAD, DUNDEE

 

There was submitted Report No 173-2014 by the Director of City Development seeking approval for the sale of the above land.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XV SALE OF LAND AT 25 MURRAYFIELD GARDENS, DUNDEE

 

There was submitted Report No 173-2014 by the Director of City Development seeking approval for the sale of the above land.

 

The Committee approved the sale on the terms and conditions detailed in the report.

 

XVI PROPOSED COMPULSORY PURCHASE ORDER OF BIN STORES AND LAND AT MILL OMAINS, DUNDEE

 

There was submitted Report No 198-2014 by the Director of City Development seeking approval to promote Compulsory Purchase Orders in respect of the existing bin stores and associated land in the Mill O'Mains estate in order to progress implementation of the approved Mill O'Mains Masterplan.

 

The Committee remitted the Head of Democratic and Legal Services to promote Compulsory Purchase Orders in respect of the existing bin stores and associated land within the approved Mill O'Mains Masterplan area, on the terms and conditions detailed in the report.
