Background
The Licensing (Scotland) Act 2005 means clubs that had traditionally been registered with the Sheriff for the sale of alcohol (under Part VII of the 1976 Act) now come under the remit of their local Licensing Board.
All clubs will require a premises licence, under the 2005 Act if they wish to sell alcohol.
All licensees will require to apply for a premises licence if they intend operating after 1st September, 2009. An application form is available in the Forms Section. It is intended that there will be a managed transition and that this will be achieved by having four tranches as undernoted:-
First Tranche
Licenses under the 1976 Act due for renewal in March 2008, 2009 or 2010, should apply for a premises licence under the 2005 Act by 7th March, 2008.
New applications must be accompanied by an operating plan. The application form for a new application and operating plan can be found in the Forms Section. Care should be taken when completing the plan as once approved changes to it can only be made by way of variation, or in the case of major changes, a new application.
The operating plan should also take account of the Board's policies.
The Licensing (Scotland) Act 2005 replaced the Licensing (Scotland) Act 1976 on 1st September, 2009.
Personal Licence Training Remotely
Highfield offer remote learning where the candidate can run through a 3-hour exercise at home at their leisure then let me know when they are ready to sit their exam given my 5 working day notice and Highfield are currently invigilating these at the moment. All of this is keeping with the Government guidelines and good for businesses at this time. The only requirements they need is an android or iphone or laptop with google chrome, a webcam, a designated private area to sit the exam so most people should have these basic requirements.
Please note: all licensing enquiries should be directed to 01382 434444.
All applications are non refundable as the fee covers the time to process the application, costs for police checks, officers time and also advertising costs.
Any person is eligible to object. Anyone wishing to object or make representations must not later than 21 days from the date specified in the notice of the application lodge with the Clerk to the Licensing Board a written notice of objection or representation. It is the responsibility of the person making the objection or representation to ensure that the Board has received it and it may be helpful to lodge it in one of the following ways:
