Complying with Section 11 of the Homelessness etc. (Scotland) Act 2003

The Scottish Government will from 1 April 2009, be introducing a new duty on all Registered Social Landlords (RSLs), Private Landlords and Creditors under section 11 of the Homelessness etc. (Scotland) Act 2003.

This duty will require Landlords and Creditors (other than local authority Landlords) to notify the relevant local authority when they raise legal proceedings for possession of a property or serve certain notices relating to a mortgage.

What is the purpose of the notification?
The purpose of the notification is to enable early intervention by local authorities for those households who may be at risk of becoming homeless due to action being taken to evict.
