The minute of meeting of this Committee of 19th August 2002 was held as read.

I DUNDEE AND ANGUS STRUCTURE PLAN PANEL MEETING, 17TH JUNE 2002

 

There was submitted Report No 612-2002 by the Director of Planning and Transportation advising the Committee of the items that were discussed at the last meetings of the Dundee and Angus Joint Structure Plan Panel which took place on 17th June 2002 and indicating the proposed future actions.

 

The Committee agreed to note and approve the minute of meeting of the Panel of 17th June 2002.

 

II SOCIAL INCLUSION PARTNERSHIPS (SIP) SOCIAL SURVEY

 

There was submitted Report No 479-2002 by the Director of Planning and Transportation informing the Committee that the Social Inclusion Partnership 1 (SIP 1) Socio-Economic Survey, initially undertaking in 1995 and repeated in 2001 was now complete, notifying the Committee of the key results of the survey, highlighting the implications arising from these, and informing the Committee that further analysis of the survey results would be carried out over the new few months.

 

The Committee agreed to note the results of the survey and implications arising therefrom.

 

III REVIEW OF STRATEGIC PLANNING: CONCLUSIONS ANDNEXT STEPS

 

There was submitted Report No 584-2002 by the Director of Planning and Transportation advising the Committee of the Scottish Executive's conclusions following the analysis of responses to its consultation paper "Review of Strategic Planning" and outlining the next steps which the Scottish Ministers propose to take as part of the review process.

 

The Committee agreed:-

 

(1)to note the implications of the conclusions and next steps arising from the Review of strategic Planning; and

 

(2)to have regard to the provisions of the report when considering its response to more detailed proposals which would, in due course, emerge from the Scottish Executive.

 

IV SITE OF FORMER LOGIE CENTRAL SCHOOL - SITE PLANNING BRIEF (FEEDBACK ON CONSULTATION)

 

There was submitted Agenda Note AN196-2002 wherein reference was made to Article IV of the minute of meeting of this Committee of 27th August 2001 whereby the Committee approved the above mentioned brief as a consultative draft. The Director of Planning and Transportation was remitted to consult with the West End Community Council and Logie Residents Association and thereafter report back to the Committee.

 

It was reported that these organisations and Dundee Civic Trust were invited to provide comments on the brief by 24th September 2001. No comments had been received from Logie Residents Association or Dundee Civic Trust by that date, but the West End Community Council had provided detailed comments on a number of issues.

 

The Committee, having considered all the points raised in the response by the West End Community Council, agreed that the brief be adopted without amendment, and that it be referred to the Development Quality Committee as a material consideration in the determination of future planning applications.

 

V SHARP'S COURT AND YEAMAN'S COURT DEMOLITION - CONSEQUENTIAL STOPPING-UP

 

There was submitted Report No 560-2002 by Director of Planning and Transportation advising the Committee that, as a result of the demolition of housing, it was recommended that a Stopping-Up Order for those lengths of Kirk Street and Yeaman's Lane which serviced Sharp's and Yeaman's Courts be prepared.

 

The Committee approved the preparation of an Order under the powers of the Roads (Scotland) Act 1984 to stop-up lengths of the roads and footpaths in Kirk Street and Yeaman's Lane and delete them from the List of Public Roads, where applicable.

 

VI SALTON CRESCENT AREA - STOPPING-UP OF FOOTPATHS

 

There was submitted Report No 556-2002 by Director of Planning and Transportation considering the necessity to stop-up the footpaths in the Salton Crescent area.

 

The Committee approved the preparation of a Stopping-Up Order under the powers of the Town and Country Planning (Scotland) Act 1977 (S 189) to allow for a new housing development in the Salton Crescent area.

 

VII ANGUS COUNCIL AND DUNDEE CITY COUNCIL (GOURDIE BRAE, DUNDEE) (40 MPH SPEEDLIMIT) ORDER 2002

 

There was submitted Agenda Note AN184-2002 whereby reference was made to Article XIV of the minute of meeting of the Planning and Transportation Committee of 25th February 2002 instructing and authorising the preparation of an Order to improve safety by reducing speeds on a narrow length of road linking existing 30 mph speed limits.

 

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Committee agreed to authorise formal publication of the Order as drafted.

 

VIII DUNDEE CITY COUNCIL (GOURDIE BRAE, DUNDEE) (RESTRICTED ROADS) ORDER 2002

 

There was submitted Agenda Note AN185-2002 making reference to Article XIV of the minute of meeting of the Planning and Transportation Committee of 25th February 2002 instructing and authorising the preparation of an Order to improve safety by reducing speeds on a narrow road with concealed accesses.

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Committee agreed to authorise formal publication of the Order as drafted.

 

IX DUNDEE CITY COUNCIL (NINEWELLS HOSPITAL AREA, DUNDEE) (VARIATION OF WAITINGRESTRICTIONS) ORDER 2002

 

There was submitted Agenda Note AN186-2002 making reference to Article X of the minute of meeting of the Planning and Transportation Committee of 25th February 2002 instructing and authorising the preparation of an Order to revoke unnecessary restrictions on unadopted roads following the decision of the Car Park Operator to enforce the restrictions privately.

 

The proposed Order was duly drafted and during the statutory consultation one objection was received from Travel Dundee which was later withdrawn.

 

The Order was duly advertised and there were no objections.

 

The Committee agreed to make the Order as advertised.

 

X DUNDEE CITY COUNCIL (MIDMILL ROAD, DUNDEE) (VARIATION OF TRAFFIC REGULATION)(EXEMPTION FOR CYCLES) ORDER 2002

 

There was submitted Agenda Note AN187-2002 making reference Article X of the minute of meeting of the Planning and Transportation Committee of 28th January 2002 instructing and authorising the preparation of an Order to increase accessibility and improve safety for cyclists in the area.

 

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Order was duly advertised and there were no objections.

 

The Committee agreed to make the Order as advertised.

 

XI DUNDEE CITY COUNCIL (NETHERGATE AND PERTH ROAD AREA, DUNDEE) (EXTENSION TO CONTROLLEDPARKING ZONE) ORDER 2002

 

There was submitted Agenda Note AN188-2002 making reference to Article XII of the minute of meeting of the Planning and Transportation Committee of 3rd December 2001 instructing and authorising the preparation of an Order to improve control and encourage turnover of parking in the area.

 

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Order was duly advertised and there were no objections.

 

The Committee agreed to make the Order as advertised.

 

XII DUNDEE CITY COUNCIL (VARIATION OF ON AND OFF-STREET PARKING REGULATIONS) (SUNDAYCHARGES) ORDER 2002

 

There was submitted Agenda Note AN189-2002 making reference to Article I of the minute of meeting of the Policy and Resources Committee of 14th February 2002 instructing and authorising the preparation of an Order to introduce Sunday charging in the Off-Street Car Parks Order.

 

The proposed Order was duly drafted and during the statutory consultation period comments were received from the Chief Constable. These comments relate to the issue of enforcement of the regulations and copies are available through the Group Secretaries and in the Members' Lounge.

 

Notwithstanding the comments, the Committee agreed to authorise publication of the Order as drafted.

 

XIII DUNDEE CITY COUNCIL (OLD GLAMIS ROAD, DUNDEE) (CYCLE ROUTES) ORDER 2002

 

There was submitted Agenda Note AN190-2002 making reference to Article VI of the minute of meeting of the Planning and Transportation Committee of 27th May 2002 instructing and authorising the preparation of an Order to increase accessibility and to improve safety for cyclists in Old Glamis Road.

 

The Order was duly prepared and advertised in the Dundee Courier and Advertiser and The Edinburgh Gazette and the relevant statutory undertakers were consulted. No objections were received.

 

The Committee agreed to authorise and confirm the Order and authorise formal publication of the confirmation after which the Order would become operative.

 

XIV DUNDEE CITY COUNCIL (VARIATION OF WAITING RESTRICTIONS) (NO 2) ORDER 2002

 

There was submitted Agenda Note AN191-2002 making reference to Article I of the minute of meeting of the Planning and Transportation Committee of 29th October 2001 instructing and authorising the preparation of an Order introducing further measures to vary the provisions of numerous existing Waiting Restrictions Orders affecting Dundee.

 

The proposed Order was duly drafted and during the statutory consultation period no adverse comments were received.

 

The Order was duly advertised and two objections were received, one of which was later withdrawn.

 

The Committee agreed to make the Order despite the objection.

There was submitted Agenda Note AN202-2002 detailing the following proposals:-

(b) LIST OF PUBLIC ROADS

 

It was agreed that on the satisfactory completion of these roads and, if so requested by the applicants, they be entered on the List of Public Roads for the purposes of management and maintenance in terms of the Roads (Scotland) Act 1984.

 

The Committee resolved under Section 50(A)(4) of the Local Government (Scotland) Act 1973 that the public be excluded from the meeting for the undernoted items of business on the grounds that they involved the likely disclosure of exempt information defined in Paragraphs 6 and 9 of Part I of Schedule 7(A) of the Act.

 

XVI COMPULSORY PURCHASE ORDER, 21 TO 25 UNION STREET, DUNDEE

 

There was submitted Agenda Note AN203-2002 informing the Committee that due to the delay experienced in having the above Compulsory Purchase Order confirmed by the Scottish Executive, the timetable drawn up by the City Council and the willing restorative third party, S L Developments, had resulted in interest charges being claimed by one of the parties who was disposing of his interests in 21-25 Union Street to S L Developments. While the delay in the confirmation of the Compulsory Purchase Order firmly rested with the Scottish Executive, it was felt that the interest charges due ought to be met by the City Council.

 

The Committee approved accordingly.
